This Writ Petition under <a href=\"\/doc\/1712542\/\" id=\"a_3\">Article 226<\/a> of the Constitution of India has<\/p>\n<p>    been filed by the Ship Owners&#8217; Association on the apprehension of<\/p>\n<p>    impending strike\/agitation in some form on the ships, ports, offices and<\/p>\n<p>    residences of petitioner and its member shipping companies, primarily, on<\/p>\n<p>    account of the show of strength between the rival unions &#8211; respondent Nos.1<\/p>\n<p>    and 2 on the issue of participating in negotiations with regard to wage<\/p>\n<p>    agreement. It is stated that the respondent No.1 Union claims to be and has<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                   3                                               545.11<\/p>\n<p>    been found to be having the largest number of membership by the Regional<\/p>\n<p>    Labour Commissioner. For that reason, it was objecting to inclusion of<\/p>\n<p>    more than three members from the respondent No.2 Union as team of<\/p>\n<p>    members for negotiations. Whereas, the respondent No.2 Union wanted<\/p>\n<p>    more than three members of their union to form part of the team for<\/p>\n<p>    negotiations. According to the petitioners, inspite of best efforts, the<\/p>\n<p>    petitioners were unable to resolve the deadlock between the stand so taken<\/p>\n<p>    by respondent No.1 and respondent No.2. On the contrary, the respondent<\/p>\n<p>    No.1 made it amply clear that petitioners ought not to negotiate with the<\/p>\n<p>    respondent No.2 union. The respondent No.2 union also informed the<\/p>\n<p>    petitioners that they should not proceed with the negotiations with<\/p>\n<p>    respondent No.1 Union by ignoring them in the process. It is the case of the<\/p>\n<p>    petitioners that both the unions have virtually threatened to go on<\/p>\n<p>    strike\/agitation in some form on the ships, ports, offices and residences of<\/p>\n<p>    the petitioner and its member shipping companies.\n<\/p>\n<p id=\"p_3\">    2.    In this backdrop, the petitioner sent detail communication to the<\/p>\n<p>    Secretary, Ministry of Shipping, Government of India, New Delhi dated 2nd<\/p>\n<p>    February, 2011. In the said communication, the petitioner placed its<\/p>\n<p>    predicament on record that as per the decision of our High Court dated 4th<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                        4                                                  545.11<\/p>\n<p>    April, 2006 in Notice of Motion No.1034 of 2006, the petitioners were<\/p>\n<p>    required to negotiate with respondent No.1 union which has been found to<\/p>\n<p>    be having a largest number of membership, but as per another order dated<\/p>\n<p>    15th February, 2008, passed by this Court in Writ Petition No.2375\/2007,<\/p>\n<p>    both unions were allowed to participate in the negotiations for determining<\/p>\n<p>    revised emoluments and conditions of service of their members. In this<\/p>\n<p>    backdrop, the petitioners wrote to the Secretary, Ministry of Shipping in the<\/p>\n<p>    following words:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>          &#8220;16. However, none of the Unions were willing to provide an assurance<br \/>\n          not to proceed with industrial action or strike, as had been verbally<\/p>\n<p>          threatened as well as conveyed by FSUI to INSA in writing. This strike<br \/>\n          notice coupled with the verbal\/oral threat of NUSI will paralyze the<br \/>\n          shipping industry and may lead to violent clashes amongst union members<br \/>\n          which will in turn lead to a colossal loss to the shipping industry and the<br \/>\n          country&#8217;s economy in general. This industrial unrest will lead to an<\/p>\n<p>          industrial dispute due to the spat between rival trade Unions. The<br \/>\n          seafarers as the employees and shipowners as the employers are perplexed<\/p>\n<p>          and disturbed as INSA has tried its level best to bring about and suggest<br \/>\n          amicable solutions but not succeeded. None of the aforesaid Unions are<br \/>\n          willing to find an amicable solution to their dispute but forcing INSA to<br \/>\n          take steps rather than they take steps and sorting out the issue which is<\/p>\n<p>          clearly due to their internal differences. Also other Unions who are not<br \/>\n          part of the meetings are pressuring INSA to include them too in Wage<br \/>\n          Negotiation.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>          17.    Therefore, it is prayed that to avoid the strike, agitation, industrial<br \/>\n          unrest, it is incumbent upon the Central Government to constitute a<\/p>\n<p>          Tribunal of one or more persons adjudicating the disputes as contemplated<br \/>\n          u\/s.150 of <a href=\"\/doc\/681709\/\" id=\"a_4\">Merchant Shipping Act<\/a>, 1958 at the earliest and on urgent basis<br \/>\n          preferably within 72 hours due to the exigencies of the situation and the<br \/>\n          perceived threat of a strike\/obstructions\/disruption by which the industrial<br \/>\n          peace will be affected on the vessels of the INSA members and refer the<br \/>\n          following issues for adjudication.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><\/p>\n<pre id=\"pre_1\">                                        5                                                  545.11\n\n\n          a)     Determine the representation between the two unions on the\n          Negotiation Committee.\n\n\n\n\n                                                                                  \n<\/pre>\n<blockquote id=\"blockquote_2\"><p>          b) Determine the representatives of the Unions for signing the negotiated<br \/>\n          agreement.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>          c) If above is not possible, what steps the management should take to<br \/>\n          negotiate and resolve the industrial disputes with its employees and\/or<br \/>\n          Unions.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>          d) Whether the NMB constitution ought to be Amended? If so, then what<br \/>\n          amendments ought to be made in the NMB constitution?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>          e) Pending the above adjudication, the Central Government be pleased to<br \/>\n          stay the strike.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>          18. It is not out of place to mention that if the Central Government delays<\/p>\n<p>          in constituting a Tribunal and notifying the same in the official gazette and<br \/>\n          passing relevant injunction orders under Section 151 of the M.S. Act 1958<br \/>\n          then there would be nationwide industrial disputes which will cripple the<\/p>\n<p>          Shipping Industry and cause great monetary loss to the shipowners and the<br \/>\n          National Exchequer.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>          19.    INSA trusts that their prayers may be considered expeditiously on<br \/>\n          urgent basis and for this act of kindness INSA shall be duty bound forever<\/p>\n<p>          pray.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_4\">    3.    Without waiting for the response of the Appropriate Authority, the<\/p>\n<p>    petitioners rushed to this Court by way of present Writ Petition for<\/p>\n<p>    declaration that the members of respondents 1 and 2 unions ought not to<\/p>\n<p>    resort to strike\/agitation in any form on the ships, ports, offices and<\/p>\n<p>    residences of petitioner and its member shipping companies till the<\/p>\n<p>    respondent No.3 (Union of India) constitutes a Tribunal and award is<\/p>\n<p>    passed therein. Further declaration has been sought that the conduct of the<\/p>\n<p>    members of respondent Nos.1 and 2 is opposed to public policy and public<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                    6                                               545.11<\/p>\n<p>    duty. Further relief claimed in the Writ Petition is to issue direction to<\/p>\n<p>    respondent No.3 (Union of India) to forthwith constitute a Tribunal under<\/p>\n<p>    <a href=\"\/doc\/1479192\/\" id=\"a_5\">Section 150<\/a> of the Merchant Shipping Act, 1958 and refer the dispute<\/p>\n<p>    relating to the strike\/agitation threatened by respondent Nos.1 and 2 as well<\/p>\n<p>    as the Charters of Demand submitted by the respondent Nos.1 and 2 dated<\/p>\n<p>    19th May, 2010 and 28th April, 2010 respectively for adjudication. Further<\/p>\n<p>    relief has been claimed against respondent Nos.1 and 2 to cease and desist<\/p>\n<p>    from instigating and\/or continuing with its strike and stoppage of work in<\/p>\n<p>    connection with the members of petitioner ships in all ports or to cause any<\/p>\n<p>    damage\/destruction\/agitation    to   the   members       of     the     petitioner&#8217;s<\/p>\n<p>    ships\/vessels, ports, offices all over India, container terminals, warehouses,<\/p>\n<p>    etc. in any manner whatsoever and also from holding dharnas, staging<\/p>\n<p>    demonstrations, making threats to the petitioner, members of the petitioner,<\/p>\n<p>    its officers, employees, servants, agents, etc. within the radius of 500 mtrs.\n<\/p>\n<p id=\"p_5\">    of such ships\/vessels, ports, offices and residents all over India, container<\/p>\n<p>    terminals, warehouses, etc.<\/p>\n<p id=\"p_6\">    4.    While this Petition was placed for admission, the respondents raised<\/p>\n<p>    preliminary objection regarding maintainability of the Petition on the<\/p>\n<p>    argument that the petitioners were essentially claiming substantive reliefs<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                         7                                                   545.11<\/p>\n<p>    against private parties i.e. Unions. During the pendency of the Petition,<\/p>\n<p>    however, the respondent No.3-Union of India vide its communication dated<\/p>\n<p>    24th February, 2011 informed the Chief Executive Officer of the petitioners<\/p>\n<p>    as follows:\n<\/p>\n<blockquote id=\"blockquote_8\"><p>          &#8220;F.No.B-11011\/2\/2011-MA                New Delhi dated the 24th February, 2011<\/p>\n<p>          To,<\/p>\n<p>          Shri Anil Devli,<\/p>\n<p>          Chief Executive Officer<br \/>\n          Indian National Shipowners&#8217; Association,<\/p>\n<p>          22, Maker Tower-F,<br \/>\n          2nd Floor, Cuffee Parade,<br \/>\n          Mumbai-400 005.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>          Subject : Request to constitute Tribunal for Adjudication of disputes as<br \/>\n                    contemplated u\/s.150 of the <a href=\"\/doc\/681709\/\" id=\"a_6\">Merchant Shipping Act<\/a>, 1958 and W.P.No.<br \/>\n                    258\/2011 filed by INSA in the High Court of Judicature at Bombay<br \/>\n                    against NUSI and others.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>          Sir,<\/p>\n<p>                  I am directed to refer to representation dated 02.02.2011 addressed to<br \/>\n          Secretary(S) on the above subject and the Court Case as mentioned above filed by<br \/>\n          INSA in which Ministry is the third Respondent and to say that after careful<br \/>\n          consideration of the representation, INSA is advised to abide and honour the<br \/>\n          judgment of High Court of Judicature, Bombay dated 04.04.2006 in Notice of<\/p>\n<p>          Motion No.1034 of 2006 in Appeal No.950 of 2005 in W.P. No.1751 of 2000 filed<br \/>\n          by FSUI against NUSI.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_11\"><p>          2. In the light of this communication, the petitioner has amended the<\/p>\n<p>    Petition seeking further reliefs in terms of prayer clauses (aa) and (ab),<\/p>\n<p>    thereby praying for striking down the impugned order dated 24th February,<\/p>\n<p>    2011 issued by the respondent No.3 and to direct the respondent No.3 to<\/p>\n<p>    exercise its powers under <a href=\"\/doc\/1479192\/\" id=\"a_7\">Section 150<\/a> of the Merchant Shipping Act, 1958<\/p>\n<p>    and to make an order of reference of industrial dispute arising from the<\/p>\n<p>    strike notice dated 14th January, 2011 issued by the respondent No.2 and<\/p>\n<p>    threat to strike notice dated 2nd February, 2011 issued by the respondent<\/p>\n<p>    No.1.\n<\/p><\/blockquote>\n<p id=\"p_7\">    6.      We have reproduced the relevant portion of the communication sent<\/p>\n<p>    by the petitioners to the Secretary, Ministry of Shipping dated 2nd February,<\/p>\n<p>    2011 which ought to be the guiding document to consider the efficacy of<\/p>\n<p>    the reliefs claimed by the petitioners. Before examining the matter further,<\/p>\n<p>    we would first deal with the issue of the maintainability of the Petition.\n<\/p>\n<p id=\"p_8\">    Even if we were to agree with the argument of the respondents that<\/p>\n<p>    considering that the reliefs originally claimed in the Petition were<\/p>\n<p>    essentially directed against private parties (respondent Nos.1 and 2 unions),<\/p>\n<p>    having regard to the fact that the Petition now stands amended after receipt<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                     9                                                545.11<\/p>\n<p>    of communication from the respondent No.3 (Union of India), and which<\/p>\n<p>    decision of the respondent No.3 (Union of India) has been challenged by<\/p>\n<p>    way of further amended reliefs, the objection regarding maintainability of<\/p>\n<p>    the Petition has become insignificant.\n<\/p>\n<p id=\"p_9\">    7.    Instead of dilating on the said aspect, we would prefer to examine the<\/p>\n<p>    merits of the grievance of the petitioners. As aforesaid, the petitioners had<\/p>\n<p>    requested the respondent No.3 to constitute Tribunal for agitating the<\/p>\n<p>    disputes under <a href=\"\/doc\/1479192\/\" id=\"a_8\">Section 150<\/a> of the Act on issues referred to in paragraph 17<\/p>\n<p>    of its communication. That request has been negated by the respondent No.<\/p>\n<p>    3 vide communication dated 24th February, 2011, primarily with reference<\/p>\n<p>    to the decision of this Court dated 4th April, 2006, wherein, it is held that the<\/p>\n<p>    petitioners herein must negotiate with the respondent No.1 Union which has<\/p>\n<p>    been found to be having largest number of membership. That view taken by<\/p>\n<p>    the respondent No.3, in our opinion, is unexceptionable, more particularly,<\/p>\n<p>    in the context of the specific request made by the petitioners in its<\/p>\n<p>    communication dated 2nd February, 2011 to refer issue to determine the<\/p>\n<p>    representation between the two unions on the Negotiation Committee or to<\/p>\n<p>    determine the representatives of the Unions for signing the negotiated<\/p>\n<p>    agreement. The third issue in the said communication is essentially advise<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                      10                                                 545.11<\/p>\n<p>    sought from respondent No.3 as to what steps the petitioner should take to<\/p>\n<p>    negotiate and resolve the industrial disputes with its employees and\/or<\/p>\n<p>    Unions, if the two issues could not be answered. Insofar as the fourth<\/p>\n<p>    proposed issue for adjudicated by the Tribunal formulated by the petitioner,<\/p>\n<p>    is again seeking advise whether the NMB constitution ought to be<\/p>\n<p>    amended, and if so, the nature of amendment. The fifth issue in paragraph 7<\/p>\n<p>    is in fact, requesting the Central Government to stay the strike pending the<\/p>\n<p>    adjudication of the four issued by the Tribunal.\n<\/p>\n<p id=\"p_10\">    8.    Suffice it to observe that the respondent No.3 rightly responded to the<\/p>\n<p>    said request of the petitioner by inviting attention of the petitioner to the<\/p>\n<p>    decision of this Court dated 4th April, 2006 in Notice of Motion No.1034 of<\/p>\n<p>    2006 in Appeal No.950 of 2005 in Writ Petition No.1751 of 2000 which<\/p>\n<p>    was binding on the parties to the said proceedings until it was to be<\/p>\n<p>    reversed. Our attention has been invited to the fact that the appeal in which<\/p>\n<p>    the said decision came to be passed on 4th April, 2006 by this Court was<\/p>\n<p>    itself eventually withdrawn by the respondent No.2. The order passed in<\/p>\n<p>    Appeal No.950\/2000 dated 25th July, 2007 reads thus:\n<\/p>\n<blockquote id=\"blockquote_16\"><p>          &#8220;P.C. :\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_17\"><p>          The learned Counsel appearing for the Appellant states that as a result of<br \/>\n          developments taking place during the pendency of the Appeal, the Appellant-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_8\">                                                        ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><\/p>\n<blockquote id=\"blockquote_18\"><p>                                         11                                                  545.11<\/p>\n<p>          Union is no more representative union and therefore without prejudice tot he<br \/>\n          rights of the Appellant to challenge the order in relation to recognition, the<br \/>\n          Appellant seeks leave of the court to withdraw the Appeal. Appeal is permitted to<\/p>\n<p>          be withdrawn. No order as to costs.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_11\">    9.    Suffice it to observe that considering the dictum in order dated 4th<\/p>\n<p>    April, 2006, which binds the parties, especially after the withdrawal of the<\/p>\n<p>    appeal filed by the respondent No.2 upon admitting the position that it was<\/p>\n<p>    no more representative union, the response given by the respondent No.3 in<\/p>\n<p>    its communication dated 24th February, 2011 was inevitable.\n<\/p>\n<p id=\"p_12\">    10.   In any case, even if we were to consider the further amended relief<\/p>\n<p>    claimed by the petitioners for setting aside the impugned order dated 24th<\/p>\n<p>    February, 2011 and to direct the respondent No.3 to make an order of<\/p>\n<p>    reference, that could be considered only in the context of the request made<\/p>\n<p>    in the communication dated 2nd February, 2011. The petitioners, however, in<\/p>\n<p>    prayer clause (ab) have asked for relief in the context of strike notice dated<\/p>\n<p>    14th January, 2011, in relation to which, no specific issue for adjudication<\/p>\n<p>    was formulated in the communication sent to the respondent No.3. With<\/p>\n<p>    regard to the issues for adjudication formulated in paragraph 17 of the<\/p>\n<p>    communication dated 2nd February, 2011, we find force in the submission of<\/p>\n<p>    the Counsel for respondent No.1 that none of these issues would be covered<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                                            ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                    12                                              545.11<\/p>\n<p>    within the meaning of <a href=\"\/doc\/1479192\/\" id=\"a_9\">Section 150<\/a> of the Act. Notably, sub-section (9) of<\/p>\n<p>    <a href=\"\/doc\/1479192\/\" id=\"a_10\">Section 150<\/a> of the Act opens with the words &#8220;nothing contained in the<\/p>\n<p>    <a href=\"\/doc\/500379\/\" id=\"a_11\">Industrial Disputes Act<\/a>, 1947 shall apply to any dispute referred to in<\/p>\n<p>    <a href=\"\/doc\/1479192\/\" id=\"a_12\">Section 150<\/a>&#8220;. Sub-section (1) of <a href=\"\/doc\/1479192\/\" id=\"a_13\">Section 150<\/a> refers to disputes between<\/p>\n<p>    seamen or any class of seamen or of any union of seamen and the owners of<\/p>\n<p>    ships in which such seamen are employed or are likely to be employed and<\/p>\n<p>    exits or is apprehended. It further provides that such dispute must relate to<\/p>\n<p>    any matter connected with or incidental to the employment of the seamen.\n<\/p>\n<p id=\"p_13\">    In the first place, the five issues formulated in paragraph 17 of<\/p>\n<p>    communication dated 2nd February, 2011 are not covered within the sweep<\/p>\n<p>    of <a href=\"\/doc\/1479192\/\" id=\"a_14\">Section 150<\/a> as it cannot be said to be dispute between union of seamen<\/p>\n<p>    and the owners of the ships relating to any matter connected with or<\/p>\n<p>    incidental to the employment of the seamen. Counsel for the petitioner,<\/p>\n<p>    however, vehemently argued that the expression `employment&#8217; will have to<\/p>\n<p>    be interpreted liberally to include even determination of representations<\/p>\n<p>    between two unions of the Negotiation Committee and to determine the<\/p>\n<p>    representatives of the unions for signing the negotiating agreement. It is not<\/p>\n<p>    possible to countenance this submission. Answering these issues will be<\/p>\n<p>    nothing short of resolving the dispute between the two rival unions interse<\/p>\n<p>    and not adjudication of dispute between the union of seamen and the<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                     13                                                 545.11<\/p>\n<p>    owners of the ships in relation to any matter connected with or incidental to<\/p>\n<p>    the employment of the seamen as such. Even on this count, the petitioners<\/p>\n<p>    cannot succeed in challenging the impugned order dated 24th February,<\/p>\n<p>    2011 being violative of Articles 14 and 19 of the Constitution of India.\n<\/p>\n<p id=\"p_14\">    11.     Counsel for the petitioners as well as respondent No.2 was at pains<\/p>\n<p>    to rely on the decision of this Court in Writ Petition No.2375 of 2007 dated<\/p>\n<p>    15th February, 2008 whereunder both the unions, i.e. respondent Nos.1 and<\/p>\n<p>    2, were allowed to participate in the negotiations for revision of<\/p>\n<p>    emoluments and conditions of service. We are not impressed by this<\/p>\n<p>    argument. Inasmuch as the plain reading of the said order makes it more<\/p>\n<p>    than clear that it was passed on the basis of mutual arrangement agreed<\/p>\n<p>    upon between the parties which was not to be treated as precedent for the<\/p>\n<p>    future. The said order reads thus:\n<\/p>\n<blockquote id=\"blockquote_19\"><p>          &#8220;P.C.:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_20\"><p>          .      Rule. Heard forthwith. Though a settlement had been arrived<br \/>\n          at there was a dispute as to the signatories  to the settlement. The<br \/>\n          parties, however, at the intervention of the Court, have agreed to<\/p>\n<p>          abide by the terms and to accept the present settlements which<br \/>\n          both the contesting Unions, who are parties here had agreed to<br \/>\n          in negotiations with the petitioner, considering the present situation in<br \/>\n          the industry and with the rider that this arrangement will not act as a<br \/>\n          precedent for the future.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_21\"><p>          .     Considering      the agreement between         the parties we do not<br \/>\n          propose to consider the reliefs as prayed.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_11\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><\/p>\n<pre id=\"pre_2\">                                       14                                                 545.11\n\n\n\n          .       The approach of all parties to arrive at a settlement with the\n\n\n\n\n                                                                                 \n<\/pre>\n<blockquote id=\"blockquote_22\"><p>          larger objective of maintaining industrial peace in the industry is<br \/>\n          commendable.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_23\"><p>          2.      The petitioners have tendered in Court two sets of agreed<br \/>\n          written     down terms       containing conditions      of service    and<br \/>\n          emoluments of Indian Seafarers in the category of Ratings and<br \/>\n          Petty Officers serving on foreign going, home trade and off-shore Articles<\/p>\n<p>          of Agreement. The two sets of agreed written down terms are marked<br \/>\n          as Exhibit &#8220;A&#8221; and Exhibit &#8220;B&#8221; and form part of this order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_24\"><p>          3.      The petitioners members shall within one week from the date<br \/>\n          hereof make payment in accordance with the above written down terms<\/p>\n<p>          to all the above categories of employees.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_25\"><p>          4.<\/p>\n<\/blockquote>\n<pre id=\"pre_3\">                    Respondent     Nos. 4 and 5 representing\n          hereby undertake on behalf of themselves and\n                                                                     FSUI and NUSI\n                                                                   their     respective\n          members that their members shall accept               the above       revised\n                         \n<\/pre>\n<blockquote id=\"blockquote_26\"><p>          emoluments and conditions of service in full and final settlement of all<br \/>\n          their claims upto the date hereof and further that neither their members nor<br \/>\n          they themselves shall raise any claim or demand involving any financial or<br \/>\n          any other demand or implications having a financial bearing for the period<br \/>\n          ending 31st March, 2010.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_27\"><p>          5.      The Court would like to place on record its appreciation of the<br \/>\n          efforts taken by all the Counsel representing parties as also the maturity<\/p>\n<p>          shown by the management and office bearers of the Unions in arriving<br \/>\n          at the above settlement. &#8221;                       (emphasis supplied)<\/p>\n<\/blockquote>\n<p id=\"p_15\">    12.   Suffice it to observe that the fact that respondent No.2 was also party<\/p>\n<p>    to the agreement reached on earlier occasion does not in any manner,<\/p>\n<p>    militate against the direction contained in order dated 4th April, 2006 passed<\/p>\n<p>    in Notice of Motion No.1034 of 2006 that the petitioners were required to<\/p>\n<p>    negotiate with respondent No.1 union which has been found to be having<\/p>\n<p>    largest number of membership. The impugned order passed by the<\/p>\n<p><span class=\"hidden_text\" id=\"span_12\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                    15                                              545.11<\/p>\n<p>    respondent No.3 dated 24th February, 2011 merely restates the position<\/p>\n<p>    contained in the said order.\n<\/p>\n<p id=\"p_16\">    13.   Counsel for the respondent No.2 was at pains to persuade us to take<\/p>\n<p>    the view that the observation in the order dated 4th April 2006 in Notice of<\/p>\n<p>    Motion No.1034 of 2006 was in the context of membership of the<\/p>\n<p>    respondent No.1 union at Mumbai and not for whole of India. This<\/p>\n<p>    argument of the respondent No.2 cannot be countenanced, having<\/p>\n<p>    withdrawn the appeal preferred by respondent No.2 union being Appeal No.<\/p>\n<p>    90 of 2000 vide order dated 25th July, 2007 and more so, having admitted<\/p>\n<p>    that it was no more representative union. This argument of respondent No.<\/p>\n<p>    2, in any case, cannot be taken forward in the present Petition. If the<\/p>\n<p>    respondent No.2 has any grievance relating to the present strength of<\/p>\n<p>    membership of the respondent No.1 within Mumbai or for that matter in<\/p>\n<p>    India, is free to agitate that matter before the appropriate forum. Thus,<\/p>\n<p>    neither at the instance of petitioner, nor the respondent No.2, that issue can<\/p>\n<p>    be examined in the present Petition.\n<\/p>\n<p id=\"p_17\">    14.   That takes us to the other relief claimed by the petitioner for<\/p>\n<p>    declaration against respondent Nos.1 and 2 Union and for issuing direction<\/p>\n<p><span class=\"hidden_text\" id=\"span_13\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                    16                                               545.11<\/p>\n<p>    as referred to in prayer clause (e). It is stated in the Petition that any hasty<\/p>\n<p>    step taken by the two unions may have far reaching cascading effect not<\/p>\n<p>    only on the owners of the ships but the entire shipping industry and<\/p>\n<p>    eventually on the economy of the Country. For that reason, the respondent<\/p>\n<p>    Nos.1 and 2 and its members have public duty not to act in the manner<\/p>\n<p>    threatened in the two communications received from the respondent Nos.1<\/p>\n<p>    and 2 dated 2nd February, 2011 and 14th January, 2011 respectively. In the<\/p>\n<p>    context of this relief, we may place on record that the argument to press this<\/p>\n<p>    relief was made by the Counsel for the petitioner only at the end of the<\/p>\n<p>    rejoinder, when the Court was about to close the case as arguments were<\/p>\n<p>    concluded. The Counsel for the petitioner asserted that he did not raise that<\/p>\n<p>    point in his opening argument, as the Court called upon the other side to<\/p>\n<p>    respond to his arguments relating to principal relief of setting-aside the<\/p>\n<p>    impugned order dated 24th February, 2011 and to direct the respondent No.3<\/p>\n<p>    to make order of reference. We corrected the Advocate for the petitioners<\/p>\n<p>    by pointing out that his assertion is incorrect, as neither he was asked to sit<\/p>\n<p>    down by the Court nor the Court called upon the other side to respond<\/p>\n<p>    while he was already on his legs.\n<\/p>\n<p id=\"p_18\">    15.   Be that as it may, the communication sent by the respondent No.1<\/p>\n<p><span class=\"hidden_text\" id=\"span_14\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 17:23:51 :::<\/span><br \/>\n                                    17                                              545.11<\/p>\n<p>    dated 2nd February, 2011 is not a communication giving notice of strike.\n<\/p>\n<p id=\"p_19\">    Indeed, the letter sent by respondent No.2 dated 14th January, 2011 does<\/p>\n<p>    indicate that 14th February, 2011 will be observed as a token protest day by<\/p>\n<p>    striking work by all the members. However, that date has elapsed long<\/p>\n<p>    back. Whereas, during the pendency of this Petition, assurance was given<\/p>\n<p>    by respondent No.2 through Counsel that it will not resort to any strike so<\/p>\n<p>    as to paralyse the work of the petitioner during the pendency of this<\/p>\n<p>    petition. It is not the case of the petitioner that the respondent No.1 and 2<\/p>\n<p>    are likely to resort to strike\/agitation without following procedure<\/p>\n<p>    established by law. Suffice it to observe that the said relief as prayed, does<\/p>\n<p>    not arise for consideration in this Petition. We will leave all questions<\/p>\n<p>    relating to the said relief claimed against respondent Nos.1 and 2 open to be<\/p>\n<p>    agitated by the petitioner before the appropriate forum as and when<\/p>\n<p>    occasion arise.\n<\/p>\n<p id=\"p_20\">    16.   For the aforesaid reasons, this Petition is disposed of with the above<\/p>\n<p>    observations.\n<\/p>\n<pre id=\"pre_4\">    (R.Y.GANOO, J.)
