PUSHPADATTA VYAS\nfor Applicant(s) : 1 - 2. \nMR HL\nJANI, APP for Respondent(s) : 1, \nRULE SERVED for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/03\/2009 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThe<br \/>\napplicant has preferred this Application for quashing criminal<br \/>\ncomplaint   F.I.R., filed before Bharuch City  A  Division<br \/>\nPolice Station being CR No. I-187 of 2005 against the applicant and<br \/>\nother accused for the offences punishable under <a href=\"\/doc\/988620\/\" id=\"a_1\">Sections 406<\/a>, <a href=\"\/doc\/1326844\/\" id=\"a_1\">409<\/a>,<br \/>\n<a href=\"\/doc\/1436241\/\" id=\"a_2\">420<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of Indian Penal Code.\n<\/p>\n<p id=\"p_1\">\tHeard<br \/>\nlearned Senior Advocate Mr. Prakash Thakkar for the petitioner and<br \/>\nlearned APP Mr. Jani, for the respondent   State. Remaining<br \/>\nrespondent is served, but absent.\n<\/p>\n<p id=\"p_2\">\tIt<br \/>\nappears that the original complainant has also filed complaint under<br \/>\nthe provision of <a href=\"\/doc\/1823824\/\" id=\"a_4\">Section 138<\/a> of the Negotiable Instrument Act in the<br \/>\nCourt of learned Chief Judicial Magistrate, Bharuch, bearing Criminal<br \/>\nCase Nos.9851 of 2001 and 9852 of 2001, and the process was issued on<br \/>\n8.8.2001. Thereafter the applicant has filed complaint under the<br \/>\nprovisions<a href=\"\/doc\/1569253\/\" id=\"a_5\"> of Indian Penal Code<\/a> on the same and similar cause of<br \/>\naction.\n<\/p>\n<p id=\"p_3\">\tLearned<br \/>\nSenior Advocate Mr. Thakkar has contended that there is a provision<br \/>\nin<a href=\"\/doc\/445276\/\" id=\"a_6\"> Criminal Procedure Code<\/a> that during production of evidence before<br \/>\nthe learned Judge if there may be some offence in connection with the<br \/>\noffence under <a href=\"\/doc\/1132672\/\" id=\"a_7\">Sections 406<\/a>, <a href=\"\/doc\/1132672\/\" id=\"a_8\">409<\/a>, etc. of I.P. Code then the<br \/>\ncomplainant has right to make a request before the learned Judge to<br \/>\nframe charge against the applicant. He has contended that when the<br \/>\ncomplaint for the offence under <a href=\"\/doc\/1823824\/\" id=\"a_9\">Section 138<\/a> of Negotiable Instrument<br \/>\nAct is pending before the learned Chief Judicial Magistrate in<br \/>\nconnection with same offence, second complaint cannot be filed for<br \/>\nthat offence.\n<\/p>\n<p id=\"p_4\">\tLearned<br \/>\nAPP Mr. Jani has fairly contended that the complainant has right to<br \/>\nuse the provision<a href=\"\/doc\/445276\/\" id=\"a_10\"> of Criminal Procedure Code<\/a> before the trial court<br \/>\nduring recording of evidence.\n<\/p>\n<p id=\"p_5\">\tI<br \/>\nhave gone through the papers produced before me. The Honourable Apex<br \/>\nCourt in the case of G. SAGAR SURI &amp; ANR. V\/s. STATE OF U.P. AND<br \/>\nOTHERS, reported in (2000) 2 SCC 636, has observed as under :\n<\/p>\n<p id=\"p_6\"> A<br \/>\ncriminal complaint under <a href=\"\/doc\/1823824\/\" id=\"a_11\">Section 138<\/a> of the Negotiable Instruments<br \/>\nAct is already pending against the appellants and other accused. They<br \/>\nwould suffer the consequences if offence under <a href=\"\/doc\/1823824\/\" id=\"a_12\">Section 138<\/a> is proved<br \/>\nagainst them. In any case there is no occasion for the complainant to<br \/>\nprosecute the appellants under <a href=\"\/doc\/988620\/\" id=\"a_13\">sections 406<\/a>\/<a href=\"\/doc\/1436241\/\" id=\"a_14\">420<\/a> IPC and in his doing<br \/>\nso it is clearly an abuse of the process of law and prosecution<br \/>\nagainst the appellants for those offences is liable to be quashed.<br \/>\nAccordingly, the judgment of the High Court is set aside and<br \/>\nprosecution of the appellants under <a href=\"\/doc\/988620\/\" id=\"a_15\">Section 406<\/a>\/<a href=\"\/doc\/1436241\/\" id=\"a_16\">420<\/a> IPC is quashed.\n<\/p>\n<p id=\"p_7\">\tIn<br \/>\nview of above observation of the Hon&#8217;ble Apex Court, the complaint<br \/>\nfiled by the complainant under <a href=\"\/doc\/107341\/\" id=\"a_17\">Sections 406<\/a> and <a href=\"\/doc\/107341\/\" id=\"a_18\">409<\/a> I.P. Code is<br \/>\nrequired to be quashed and accordingly the same is quashed.
