KURIAKOSE,J.\n\n                   - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                            W.P.(C)No. 7794 of 2007\n\n                   - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                             Dated: 22nd March, 2007\n\n\n                                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">       Heard Mr.K.Ramakumar, Standing Counsel for the B.S.N.L., the<\/p>\n<p>writ   petitioner   and   Mr.P.K.Soyuz,   Standing   Counsel   for   the   1st<\/p>\n<p>respondent-Municipality.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2. The petitioner-B.S.N.L seeks quashment of the notice dated<\/p>\n<p>2.1.2007   and   24.1.2007   issued   by   the   1st  respondent-Municipality<\/p>\n<p>directing   the   petitioner   to   produce   a   certificate   from   the   Atomic<\/p>\n<p>Energy   Commission   to   the   effect   that     radiations   from   the   mobile<\/p>\n<p>tower   to   be   installed   by   the   petitioner   will   not   to   be   injurious   to<\/p>\n<p>human lives. Under Ext.P3 the Municipality has directed the petitioner<\/p>\n<p>to submit an affidavit before the Municipality that if the judgment of<\/p>\n<p>this   court   in   the   Writ   Petition   challenging   the   order   of   the<\/p>\n<p>Ombudsman on the basis of which only the Municipality insisted that<\/p>\n<p>the   petitioner   shall   produce   a   certificate   from   the   Atomic   Energy<\/p>\n<p>Commission   goes   against   the   stand   of   the   petitioner,   the   petitioner<\/p>\n<p>will remove the tower within 30 days. I had occasion to decide   Writ<\/p>\n<p>Petitions     filed  by  other  mobile   telephone   companies   impugning  the<\/p>\n<p>order   of   the   Ombudsman   and   consequential   orders   passed   by   the<\/p>\n<p>local authorities on the basis of the Ombudsman&#8217;s order. I had in fact<\/p>\n<p>relied   on   the   Division   Bench   judgment   of   this   court   in  <a href=\"\/doc\/1305317\/\" id=\"a_1\">Reliance<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C.No.7794\/07                                        &#8211;  2  &#8211;<\/span><\/p>\n<p>Infocom   Ltd.   v.   Chemanchery   Grama   Panchayat<\/a>  (2006(4)   KLT<\/p>\n<p id=\"p_3\">695) wherein the Division Bench after noticing the affidavit which was<\/p>\n<p>filed by the Atomic Energy Regulatory Board before the Bombay High<\/p>\n<p>Court as well as a report submitted by the World Health Organisation<\/p>\n<p>in   that   court   found   that   the   emission\/radiation     from   the   mobile<\/p>\n<p>towers  will   be  relatively  less   as   against   the   radiation\/emission  from<\/p>\n<p>the   radio   towers.   I   had   in   fact  occasion   to   consider     copies   of   that<\/p>\n<p>affidavit and the report of the W.H.O. in other cases decided by me.<\/p>\n<p>Under these circumstances, following the view which I have taken in<\/p>\n<p>the   earlier   cases   and  the   views   expressed   by  the   Division   Bench   in<\/p>\n<p>the decision referred to above, this Writ Petition is only to be allowed.<\/p>\n<p>Accordingly, the Writ Petition will stand allowed. Exts.P2 and P3 are<\/p>\n<p>quashed   and   the   1st  respondent-Municipality   is   directed   to   consider<\/p>\n<p>the   application   for   licence   submitted   by   the   petitioner   without<\/p>\n<p>insisting on production of any No Objection Certificate or permission<\/p>\n<p>from the Atomic Energy Commission.
