Challenge is against recovery steps initiated<\/p>\n<p>pursuant to Ext.P6 notice for realisation of amounts due to<\/p>\n<p>the respondents 1 &amp; 2 towards repayment a loan availed by<\/p>\n<p>the petitioner for construction of a residential building. On<\/p>\n<p>an earlier occasion the petitioner had approached this court<\/p>\n<p>aggrieved by recovery notices issued. This court had shown<\/p>\n<p>indulgence in permitting the petitioner to pay off the<\/p>\n<p>arrears in easy terms.           However, after effecting some<\/p>\n<p>payments, the petitioner again defaulted. As per Ext.P6<\/p>\n<p>notice, sale of immovable property is proposed for realising<\/p>\n<p>a total amount of Rs.2,53,407\/-.              It is contended by the<\/p>\n<p>petitioner that the amount shown in Ext.P6 notice is not<\/p>\n<p>correct and it is highly exorbitant. It is further submitted<\/p>\n<p>that the property which is proposed to be sold is the<\/p>\n<p>residential building wherein the petitioner is residing along<\/p>\n<p>W.P.(C)No. 35687 of 2009<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>with her children, she being deserted by her husband.<\/p>\n<p>Under the above circumstances the petitioner is confining<\/p>\n<p>her prayer to the limited extent of permitting payment of<\/p>\n<p>the balance amount within a reasonable time, in<\/p>\n<p>installments and also seeks direction to the respondents to<\/p>\n<p>consider waiver of interest\/penal interest and expenses to<\/p>\n<p>the possible extent .\n<\/p>\n<p>      2.    Considering the facts and circumstances of the<\/p>\n<p>case, I am of the opinion that eventhough no interference on<\/p>\n<p>merits is possible, some indulgence can be shown<\/p>\n<p>considering the special circumstances prevailing in this<\/p>\n<p>case, to permit the petitioner to pay off the liability within a<\/p>\n<p>reasonable period.\n<\/p>\n<p>      3.    Accordingly the petitioner is directed to make<\/p>\n<p>payment of an amount of Rs.50,000\/- (Rupees Fifty<\/p>\n<p>Thousand only) on or before 15.01.2010. The respondents<\/p>\n<p>are directed to keep in abeyance further coercive steps<\/p>\n<p>pursuant to Ext.P6 notice, including confirmation of sale if<\/p>\n<p>any taken place, till such time. If amount as directed above<\/p>\n<p>W.P.(C)No. 35687 of 2009<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>is paid, the respondents shall consider waiver of<\/p>\n<p>interest\/penal interest and expenses to the possible extent<\/p>\n<p>and shall intimate the petitioner about the net balance<\/p>\n<p>payable.      The petitioner shall continue payment of the<\/p>\n<p>balance amount so intimated in (4) four equal monthly<\/p>\n<p>installments thereafter, falling due on or before 15.02.2010<\/p>\n<p>and on or before the 15th day of the succeeding months.<\/p>\n<p>      4.    It is made clear that on the event of failure in<\/p>\n<p>payment of any of the installments as stipulated as above,<\/p>\n<p>the respondents will be free to proceed with further steps<\/p>\n<p>pursuant to the notices already issued, and on any such<\/p>\n<p>event the petitioner will be precluded from raising any<\/p>\n<p>subsequent challenge against such proceedings either<\/p>\n<p>before this court or before any other forum.<\/p>\n<p>                                        C.K.
