    First defendant in O.S.46\/1984 on the file<\/p>\n
of  Sub  Court,  Thrissur  is   the  appellant.<\/p>\n
Respondents are the plaintiffs and the other<\/p>\n
defendants.  A preliminary decree for partition<\/p>\n
was  passed  in   O.S.46\/1984  on   28.11.1989.<\/p>\n
Though the preliminary decree was challenged by<\/p>\n
filing  an   appeal   the  appeal   was   later<\/p>\n
withdrawn. The preliminary decree thus became<\/p>\n
final. I.A.289\/1996 was filed for passing a<\/p>\n
final decree in accordance with the preliminary<\/p>\n
decree.     Learned  Sub   Judge  appointed   a<\/p>\n
Commission to divide the property in accordance<\/p>\n
with the preliminary decree.   The Commissioner<\/p>\n
divided the properties and allotted   different<\/p>\n
sharers and submitted the report.    Under the<\/p>\n
order dated 5.4.2005, learned Sub Judge passed<\/p>\n
RFA345\/2005                 2<\/span><\/p>\n
a final decree in accordance with Ext.C1 report and<\/p>\n
Ext.C2 plan submitted by the Commissioner.      It is<\/p>\n
challenged in this appeal.\n<\/p>\n
     2.    Case of the appellant is that    subsequent<\/p>\n
to the preliminary decree, there was a settlement<\/p>\n
between the sharers and as agreed to by the parties<\/p>\n
a  partition     was  entered   into  whereunder   the<\/p>\n
properties were divided and though defendants 7 to<\/p>\n
12   are    not   parties  to   the  partition   deed,<\/p>\n
properties were allotted to them also and therefore<\/p>\n
learned     Sub  Judge   should  have   accepted   the<\/p>\n
partition deed     and should not have passed a final<\/p>\n
decree in accordance with Ext.C1 report and Ext.C2<\/p>\n
plan and therefore the final decree is to be set<\/p>\n
aside.\n<\/p>\n
     3.    Learned counsel appearing for appellant and<\/p>\n
contesting respondents were heard.<\/p>\n
     4.    On hearing the learned counsel appearing<\/p>\n
for appellant, I find no reason to interfere with<\/p>\n
the   final    decree.    It  is  admitted  that   the<\/p>\n

preliminary decree passed by the Sub Judge in<\/p>\n
O.S.46\/1984,  though challenged by filing an appeal<\/p>\n
which    was later withdrawn,  has  become   final.<\/p>\n
Unless the sharers together settled the dispute and<\/p>\n
executed   a partition  deed,  there  cannot  be  a<\/p>\n
modification of the preliminary decree.  By the act<\/p>\n
of some of the sharers, excluding other sharers,<\/p>\n
dividing the property in between them and allotting<\/p>\n
a portion of the property in favour of those<\/p>\n
sharers who did not join   the partition deed, the<\/p>\n
preliminary decree cannot be modified as canvassed<\/p>\n
by the appellant.\n<\/p>\n
     5. It is admitted case that in the partition<\/p>\n
deed executed by some of the sharers, subsequent to<\/p>\n
the preliminary decree, defendants 7 to 12 are not<\/p>\n
parties. Hence  whatever  be the settlement between<\/p>\n
the other sharers, it is not binding on defendants.<\/p>\n
Defendants 7 to 12 and they  entitled to get their<\/p>\n
shares ignoring the partition deed as found in the<\/p>\n
preliminary decree.  Their right cannot be defeated<\/p>\n

by an agreement between the other sharers to allot<\/p>\n
the   properties    according  to  their  whims  and<\/p>\n
fancies. When there cannot be equitable division by<\/p>\n
allotting the properties as the share of defendants<\/p>\n
7 to 12, there cannot be equitable division in<\/p>\n
accordance with the partition deed.   It is more so<\/p>\n
when defendants 7 to 12 do not accept the said<\/p>\n
division.    Without the properties to be allotted<\/p>\n
to defendants 7 to 12, there cannot be a division<\/p>\n
of the properties in accordance with the partition<\/p>\n
deed.    In such circumstances learned Sub Judge was<\/p>\n
fully    correct in   ignoring  that  partition  and<\/p>\n
dividing the property.    Nothing was pointed out to<\/p>\n
interfere with the allotment made by Commissioner<\/p>\n
or  the    final decree  passed  by  the  Sub  Judge<\/p>\n
accepting    the  report   and   plan.     In   such<\/p>\n
circumstance there is no merit in the     appeal and<\/p>\n
it is dismissed.\n<\/p>\n
