Justice ANTONY DOMINIC\n\n Dated :15\/01\/2008\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">                         ANTONY DOMINIC, J.\n<\/p>\n<p id=\"p_1\">              &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p id=\"p_2\">                        W.P.(C) 1685 of 2008\n<\/p>\n<p id=\"p_3\">             &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_4\">                       Dated:JUDGMENT 2008<br \/>\n                              January 15,<\/p>\n<p>       Petitioners had participated in Orchestra in the District level<\/p>\n<p>Higher Secondary School Youth Festival. They were given the 3rd<\/p>\n<p>prize. It is stated that the poor performance of the petitioners was<\/p>\n<p>on account of the fact that there was intermittent power failure, as a<\/p>\n<p>result of which, two instruments could not be played.<\/p>\n<p id=\"p_5\">     2. When this writ petition came up in the morning, in view of<\/p>\n<p>the assertion made by the counsel for the petitioner, I had<\/p>\n<p>adjourned the case to the afternoon with a direction to the<\/p>\n<p>Government Pleader to get instructions.<\/p>\n<p id=\"p_6\">     3.     The Government Pleader on instructions submits that,<\/p>\n<p>according to the judges, there was no such power failure and no<\/p>\n<p>such remark is noted in the tabulation sheet.<\/p>\n<p id=\"p_7\">     4.      In view of this and in the absence of any material<\/p>\n<p>suggesting to the contrary, I am not in a position to accept the plea<\/p>\n<p>of the petitioner.
