Respondent\n\nPrayer: Appeal against  the  judgment  and  decree  dated  30.4.1992  made  in\nL.A.O.P.No.11 of 1988 by the learned Subordinate Judge, Sivagangai.\n\n!For Appellant  :       Mr.E.Sampath Kumar\n                        Government Advocate\n\n^For Respondent :       Mr.A.S.Vijayaraghavan\n\n:J U D G M E N T\n<\/pre>\n<p id=\"p_1\">(The judgment of this Court was delivered by P.D.DINAKARAN,J.)<\/p>\n<p>        The  appeal  is directed against the judgment and decree dated 30.4.19<br \/>\n92 of the learned Subordinate Judge, Sivagangai made in L.A.O.P.No.11 of 1988,<br \/>\nincreasing the compensation awarded  by  the  Land  Acquisition  Officer  from<br \/>\nRs.23.40  per  cent  to  Rs.650\/-  per cent, for the land of an extent of 1.20<br \/>\nacres located in Survey No.255\/4 in Rahinipattai Village, Sivagangai District,<br \/>\nacquired pursuant to the notification dated  27.8.1986  issued  under  <a href=\"\/doc\/169774\/\" id=\"a_1\">Section<br \/>\n4(1)<\/a>  of  the Land Acquisition Act, for the purpose of providing housing sites<br \/>\nto Adi Dravidars.\n<\/p>\n<p id=\"p_1\">        2.1.  Mr.E.Sampath Kumar, learned Government Advocate  challenges  the<br \/>\nenhancement  of  compensation made by learned Subordinate Judge, Sivagangai in<br \/>\nthe judgment and  decree  dated  30.4.1992  made  in  L.A.O.P.No.11  of  1988,<br \/>\npreferred   under   <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section   18<\/a>   of   the   Land   Acquisition  Act  by  the<br \/>\nrespondent\/claimant, on the ground that the enhancement was made  without  any<br \/>\nbasis and without taking into consideration any documentary evidence.\n<\/p>\n<p id=\"p_2\">        2.2.  Mr.E.Sampath Kumar, learned Government Advocate also invited our<br \/>\nattention  to the documents relied upon by the Land Acquisition Officer in the<br \/>\naward proceedings dated 15.12.1987, whereunder land of an extent of  41  cents<br \/>\nlocated  in  the very same village, in the same survey No.255\/6 was sold under<br \/>\ndocument No.1330, registered on 16.9.1984 at the rate of  Rs.220\/-  per  cent.<br \/>\nSince  the  impugned  lands  are  also  in  the very same survey number, viz.,<br \/>\nS.No.255\/4 in the same village, there cannot be any objection for taking  into<br \/>\nconsideration  the  document  relating  to  sale  of land pertaining to Survey<br \/>\nNo.255\/6 of Rahinipattai Village, Sivagangai District, as referred  to  above,<br \/>\nas a basis for arriving at the compensation.\n<\/p>\n<p id=\"p_3\">        3.    Per  contra,  Mr.A.S.Vijayaraghavan,  learned  counsel  for  the<br \/>\nrespondent\/claimant,  reiterating  the  reasons  that  weighed   the   learned<br \/>\nSubordinate  Judge, Sivagangai in enhancing the compensation from Rs.23.40 per<br \/>\ncent to Rs.650\/- per cent in the order dated 30.4.1992 under appeal,  contends<br \/>\nthat  there is no necessity to interfere with the said compensation awarded by<\/p>\n<p>the learned Subordinate Judge, Sivagangai taking the market value of one  cent<br \/>\nat  Rs.300\/- and awarding a compensation for the trees and better location and<br \/>\nfinally arriving at Rs.650\/- per cent.\n<\/p>\n<p id=\"p_4\">        4.  After careful consideration,  we  are  unable  to  appreciate  the<br \/>\nreasons that  weighed  the learned Subordinate Judge, Sivagangai.  It is true,<br \/>\nin the fixation of rate of compensation under the <a href=\"\/doc\/7832\/\" id=\"a_2\">Land Acquisition Act<\/a>,  there<br \/>\nis always  some  element  of  guesswork.    But  that  has to be based on some<br \/>\nfoundation.  It must spring from the totality  of  evidence,  the  pattern  of<br \/>\nrate, the pattern of escalation and escalation of price in the years preceding<br \/>\nand succeeding  the  notification  issued  under  <a href=\"\/doc\/169774\/\" id=\"a_3\">Section 4(1)<\/a> of the Act.  In<br \/>\nother words, the guesswork could reasonably be inferable  from  it.    In  the<br \/>\ninstant  case,  the  enhancement  of  the  compensation under the judgment and<br \/>\ndecree under appeal from Rs.23.40 per cent to Rs.650\/-  per  cent  is  without<br \/>\nbasis or reasons.  When documentary evidence is available with respect to sale<br \/>\nof  land  located  in  the  very  same  survey  number, viz., Survey No.255\/6,<br \/>\nregistered as document No.1330 on 16.9.1984,  there  is  no  justification  to<br \/>\nignore the same.  The failure to consider the said document, in our considered<br \/>\nopinion,   vitiates   the   judgment   and  decree  dated  30.4.1992  made  in<br \/>\nL.A.O.P.No.11 of 1988 by the learned Subordinate Judge, Sivagangai.\n<\/p>\n<p id=\"p_5\">        5.  We are, therefore, inclined to take the document bearing  No.1330,<br \/>\nregistered on 16.9.1984, with reference to the land located in Survey No.255\/6<br \/>\nin  Rahinipattai  Village, Sivagangai District of an extent of 41 cents at the<br \/>\nrate  of  Rs.220\/-  per  cent,  as  a  basic  document  for  arriving  at  the<br \/>\ncompensation  and  propose  to add 15% appreciation value per year on the same<br \/>\nand thus, arrive at a rate of Rs.300\/- per  cent  as  a  fair  and  reasonable<br \/>\ncompensation to the respondent\/claimant.\n<\/p>\n<p id=\"p_6\">        6.  In  the  result, we allow the appeal in part.  The market value is<br \/>\nfixed at Rs.300\/- per cent along with statutory benefits, viz., 12% additional<br \/>\ncompensation under <a href=\"\/doc\/125033668\/\" id=\"a_4\">Section 23(1)(a)<\/a> of the Land Acquisition Act from the  date<br \/>\nof  the  notification made under <a href=\"\/doc\/169774\/\" id=\"a_5\">Section 4(1)<\/a> of the Land Acquisition Act till<br \/>\nthe date of award or taking possession, whichever is earlier and 30%  solatium<br \/>\non  the same with additional interest at the rate of 9% per annum for a period<br \/>\nof one year from the the date of taking  possession  and  thereafter  15%  per<br \/>\nannum till  the date of payment.  However, as there is no serious objection as<br \/>\nto the award of compensation to the trees and buildings fixed by judgment  and<br \/>\ndecree   dated  30.4.1992  made  in  L.A.O.P.No.11  of  1988  by  the  learned<br \/>\nSubordinate Judge, Sivagangai, we do not propose to interfere with  the  same.<br \/>\nNo costs.<\/p>\n<pre id=\"pre_1\">\n\nIndex   :Yes\nInternet:       Yes\n\nsasi\n\nTo:\n\n1.
