and considering the material produced by the complainant,<\/p>\n

and when, after the notice mentioned in Section 66<\/a>, such person<\/p>\n

that rule only means that, so long as the higher or
\nsuperior evidence is within your possession or_..__

\nproof of the contents of the documents tendered. ii” i

\nsecondary evidence it is necessary it

submitted that, when primary evidence<\/p>\n

iiicould not h_e’giiren, the secondary evidence is given, and that<\/p>\n

–. he done only on ful\ufb01ilment of the requirement of the<\/p>\n

iproxiisionis of Section 65<\/a> of the Evidence Act.<\/p>\n

V 13. He also relied on another judgment reported in AIR<\/p>\n

2004 SC 4082 in the matter of SMTDAYAMATHI BAI VS.<\/p>\n

K.M.SHAFFI and submit that, the objection has to be raised<\/p>\n

when the document is taken on record and no objection couid be
\nraised at a iater stage. It is in this context, he submitted that,
\nwhen the compiainant in the witness box has submitted
\nwants to produce secondary evidence and mark it, .<\/p>\n

has been raised by the accused. ._<\/p>\n

14. Law requires that, best avai.ia’bie evidence”
\nproduced. If the primary evidence is:\u00a7vs_11a51e; given
\nfirst. in the absence of th’e..y_”prim’ary ‘secondary
\nevidence may be given. It is .i_’avv’_that documents
\nhave to be proved pg documents are
\nadmissible, soinieiiijreaiuired according to the law.
\nHowever, * itseifvicould not be produced,
\nsecondary evidence. .\n<\/p>\n

1,3.’ Secondaiyy\ufb02eviidence is defined under Section 63<\/a> of the<\/p>\n

vvhich reads as under:\n<\/p>\n

_ ‘3._eCtioii”6_3:ri.Secondary evidence means and includes:
\n(L) cej’rty’-\u00a7e’d copies given under the provision<\/p>\n

‘hereinafter contained;\n<\/p>\n

it ‘{2}; copies made from the original by mechanical
\nprocesses which in themselves ensure the accuracy<\/p>\n

of the copy, and copies compared with such copies;<\/p>\n

(3) copies made from or compared with the original;<\/p>\n

Court or of any person legally bound to produce it,
\nand when after the notice mentioned in Section 66<\/a>,<\/p>\n

such person does not produce it;\n<\/p>\n

(b) When the existence, condition or
\noriginal have been proved to be admittedin it
\nby the person against whom; it ‘is.pri)ved his <\/p>\n

representative in interest;\n<\/p>\n

(c) When the original has’-been destroyed”.:or”~–;lost, ‘or
\nwhen the party offe1i\ufb02Q.:Vil\u00a7:\u00bbi2_idence’of. cbntents
\ncannot, for any A..4_other 5_:reason._g_ no’t,arising from his

19. Contents of document could be given by secondary
\nevidence under Section 65<\/a> (a){c) and (d), inasmuch as when the<\/p>\n

document is in possession or power which cannot be produced<\/p>\n

\nproduce, or when original is destroyed or original cannot be
\nmoved from the place. However, if condition or contents-._ia–:e<\/p>\n

admitted, secondary evidence could be given.<\/p>\n

20. in case the document is public doc.u’meri’t- .or–certi\ufb01ed\u00ab<\/p>\n

copy as permitted by law or by the evidence of person <\/p>\n

examined and who is skilled in theiiercamination of document.<\/p>\n

21. To prove the the party must
\nadduce evidence Evidence Act<\/a>.\n<\/p>\n

However, in this The learned
\nMagistrate_h_as the Xerox copy of the<\/p>\n

M.O.U. subject <of'e.;\u00a7iste11ce of the original.<\/p>\n

22. Unidisputedly,itheapplication \ufb01led by the complainant<\/p>\n

regai’=:ds summoningvof the document from the accused has<\/p>\n

i7′.:)eeIii’1’eiee.tedarid.__thereafter the complainant has entered into<\/p>\n

thexvitixliessibioxriburing the course of evidence, the complainant<\/p>\n

has statedltphati, M.O.U. be permitted to be marked as secondaiy<\/p>\n

“\u00a7’\\!idl’:\u00a7’I1’\u20ac3.'(i’. that stage, the Court has passed the following<\/p>\n

v .i.ord:er.\n<\/p>\n

“Objections raised by the accused for marking of
\nxerox copy of M.O.U. is hereby rejected. The
\ncomplainant is permitted to lead secondary
\nevidence by producing xerox copy of M.O.U.
\nsubject to proof of existence of original M. O. U. ”<\/p>\n

23. From the order dated 23.5.2009 what appears is that,
\nneither the complainant has produced the xerox copy the
\nM.O.U. nor the original has been produced. At this stage;
\nhas been passed. The learned Judge has ‘
\nmentioned that the xerox copy to tog ii
\nexistence of the original M.O.U. in this
\nxerox copy is produced and even__v:i:etorei’the coniplainvant–‘ilhas 2 i’
\nmade effort to prove the__existencejg’~of*~original.:i\u00a7d.QiEU., this
\nCriminal Petition has been in a judgment
\nrelied by the learned. genie;-is-ce1ifnsie–1_At’o_rlithe held that,
\nthe existence of. ieiiistence in terms of
\nSection ot be disputed that the
\nexistence there, otherwise there cannot<\/p>\n

be any secondary eividencei~.._No secondary evidence is exists<\/p>\n

withoutgtheggorigirialg. under the circumstances when it is<\/p>\n

producemthe original for the reason stated under<\/p>\n

the Evidence Act<\/a>. In this case, the learned<\/p>\n

A Magistrate: has fonly permitted the complainant to produce the<\/p>\n

"'origii'1.al_,i.–' if the original itself is not in existence, it is for the<\/p>\n

i corvnplainant to produce the original to show from the evidence<\/p>\n

the condition and contents of the document by establishing one<\/p>\n

of the circumstances under Section 65<\/a> of the Act.<\/p>\n

24. in this case, so far, neither the xerox coy is produced<\/p>\n

nor any document is marked. From the order of the learned<\/p>\n

Magistrate, it is clear that, the burden is on the compi’aina’nti’to<\/p>\n

produce evidence to show the existence of the V’<\/p>\n

the existence is shown, the further question. of n1ar14<in;g_"arise:s. it<\/p>\n

is needless to mention that, every secoinda–r_fy"evidence has' <\/p>\n

proved in accordance with the provisions of VSectiovns"'t63~and 65 " V<\/p>\n

of the Evidence Act.\n<\/p>\n

Since that stage hasiniot. document is<\/p>\n

produced, in my opinion, thi’s”pet[itio11_is_pre–rnatured.<\/p>\n
