JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 17\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tWhen<br \/>\nthe matter is taken up, today, Mr.Shalin Mehta, learned advocate for<br \/>\nMr.Nikunt K. Raval, learned advocate for the petitioner, states that<br \/>\nthe petitioner shall file an application for restoration of the<br \/>\nappeal before the Appellate Forum, within a period of 10 days from<br \/>\ntoday, and as status-quo had been granted before dismissal of the<br \/>\nappeal on the ground of non-prosecution, the Court may direct<br \/>\nstatus-quo to be maintained regarding the possession of the<br \/>\npetitioner, till a decision is arrived at by the Appellate Forum, on<br \/>\nthe application for restoration.\n<\/p>\n<p id=\"p_1\">\tMr.\n<\/p>\n<p id=\"p_2\">Chetan Pandya, learned advocate for M\/s. S.V. Raju Associates on<br \/>\nbehalf of respondent No.1, submits that the petitioner ought to have<br \/>\napproached the Appellate Forum by filing an application for<br \/>\nrestoration, instead of approaching this Court.\n<\/p>\n<p id=\"p_3\">\tHaving<br \/>\nheard the learned advocates for the respective parties, and in view<br \/>\nof the statement made by the learned advocate for the petitioner, the<br \/>\nfollowing order is passed:-\n<\/p>\n<p id=\"p_4\">In<br \/>\nthe event that the petitioner files an application for restoration of<br \/>\nthe appeal before the Appellate Forum, the said application shall be<br \/>\nheard and decided, in accordance with law.
