THROUGH HEIRS - Opponent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nMJ PARIKH for\nApplicant(s) : 1, \nMR JIGAR M PATEL for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/08\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">By<br \/>\n\tway of this petition, the petitioner-original defendant has<br \/>\n\tchallenged the judgment and order dated 5\/10\/2007 passed by the<br \/>\n\tlearned Additional District Judge, Fast Track Court No.1,<br \/>\n\tSurendranagar in Regular Civil Appeal No.13 of 2000 whereby the<br \/>\n\tlearned Appellate Court has allowed the appeal of the appellant and<br \/>\n\tquashed and set aside the order of the Trial Court dated 31\/3\/2000<br \/>\n\tpassed in Civil Suit No.148 of 1995 whereby the Trial Court after<br \/>\n\tconsidering the evidence on record has passed eviction decree on the<br \/>\n\tground of non-user.\n<\/p>\n<p id=\"p_1\">The<br \/>\n\tbrief facts of the case are that the respondent had filed Regular<br \/>\n\tCivil Suit No.148 of 1995 in the Court of Civil Judge (JD),<br \/>\n\tSurendranagar for recovery of possession as well as arrears of rent<br \/>\n\ton the ground of non-user and subletting.  The Trial Court dismissed<br \/>\n\tthe said suit qua possession and directed the petitioner to pay<br \/>\n\tarrears of rent of Rs.1,320\/-.  Against the said decree the<br \/>\n\trespondent filed Regular Civil Appeal No.13 of 2000 in the District<br \/>\n\tCourt, Surendranagar.  The learned Additional District Judge, Fast<br \/>\n\tTrack Court No.1 vide judgment and decree dated 5\/10\/2007 allowed<br \/>\n\tthe appeal and granted the prayers as made in para 8 of the plaint.<br \/>\n\tIt is against the said judgment and decree of the Appellate Court<br \/>\n\tthe present Revision Application has been filed.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tadvocate for the petitioner submitted that the premises were in use<br \/>\n\tand there was a compromise decree between the parties.  He submitted<br \/>\n\tthat the Lower Appellate Court has erred in holding that the rented<br \/>\n\tpremises was required for bona fide and personal use of the<br \/>\n\trespondent.\n<\/p>\n<p id=\"p_3\">Learned<br \/>\n\tAdvocate for the respondent has submitted that the Lower Appellate<br \/>\n\tCourt has considered all the facts and circumstances of the case and<br \/>\n\tno case is made out to cause interference.\n<\/p>\n<p id=\"p_4\">As<br \/>\n\ta result of hearing and perusal of the record, it is found that<br \/>\n\tthere is a clear finding of arrears of rent and non-user of the<br \/>\n\tpremises.  The Lower Appellate Court has in detail discussed the<br \/>\n\tissues before coming to such conclusion which cannot be assailed in<br \/>\n\tany manner whatsoever.\n<\/p>\n<p id=\"p_5\">I<br \/>\n\tam in complete agreement with the reasonings given by the Appellate<br \/>\n\tCourt and condition of the rented premises was not proper and the<br \/>\n\tCourt has believed the hardship of the landlord and in that view of<br \/>\n\tthe matter, the decree passed by the Appellate Court is just and<br \/>\n\tproper.\n<\/p>\n<p id=\"p_6\">In<br \/>\n\tthe premises, present Civil Revision Application deserves to be<br \/>\n\tdismissed.  Hence, the same is dismissed.
