RAJ SINGH &amp; ORS.)\n\n                          DATE OF ORDER : 2\/2\/2009\n\n               HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.Nitin Ojha, for the petitioner.\nMr.G.J.Gupta, for the respondent.\n\n\n1.      This writ petition is directed against the award of the Industrial\n\nTribunal dated 11\/10\/1993, whereby, the Industrial Tribunal quashed\n\nthe termination of respondent workman and awarded reinstatement\n\nwith 50% backwages.\n\n\n\n2.      Learned counsel for the RSRTC submitted that the petitioner\n\nwas not reinstated nor he has reported back for duty. The petitioner\n\nwas appointed as Helperon 21\/6\/1979 and was served with a charge\n\nsheet containing 20 charges of gross misconduct, misbehaviour and\n\nnot maintaining the vehicles assigned to him on 16\/10\/1980 in which\n\nhe was found guilty. The Industrial Tribunal itself in para no.5 has\n\nfound that inquiry against the respondent workman was completed in\n\naccordance with the principles of natural justice and he was given full\n\nopportunity to defend himself, yet the punishment was set aside only\n S.B.CIVIL WRIT PETITION NO.3955\/94 - RSRTC Vs. Raj Singh &amp; Ors.   Order dt: 2\/2\/2009\n\n\n                                            2\/3\n\non the ground that statements of departmental officers, who appeared\n\nbefore the Industrial Tribunal were not recorded on oath and,\n\ntherefore, not admissible as per <a href=\"\/doc\/1953529\/\" id=\"a_1\">Evidence Act<\/a>.\n\n\n\n3.      No one appeared for respondent workman despite service and\n\ndespite the fact that earlier also this writ was dismissed in default on\n\n2\/4\/2004 but was restored on the application of petitioner. Therefore,\n\narguments of learned counsel for RSRTC were heard ex-parte.\n\n\n\n4.      Having heard learned counsel and having gone through the\n\nimpugned award of Industrial Tribunal, this Court is of the opinion\n\nthat looking to the nature of misconduct and in view of the fact that\n\ninquiry was completed in accordance with the principles of natural\n\njustice and termination was set aside on technical ground, this Court\n\nis inclined to modify the impugned award of the Industrial Tribunal\n\nand instead of directing reinstatement with back wages, an adhoc\n\ncompensation of Rs.10,000\/- to the respondent workman is\n\nconsidered appropriate.\n\n\n\n5.      In view of the facts and circumstances of the case, this writ\n S.B.CIVIL WRIT PETITION NO.3955\/94 - RSRTC Vs. Raj Singh &amp; Ors.   Order dt: 2\/2\/2009\n\n\n                                            3\/3\n\npetition is partly allowed and impugned award of Industrial Tribunal\n\ndated 11\/10\/1993 is modified and instead of reinstatement and 50%\n\nback wages, respondent workman is held entitled to receive adhoc\n\ncompensation of Rs.10,000\/- from the petitioner Corporation. The\n\nsaid compensation may be paid by the petitioner Corporation within a\n\nperiod of five months from today.
