1.\tHeard
\nMr.Nanavati, learned advocate for the applicant and Mr.Dabhi, learned
\nAPP for the respondent-State.\n<\/p>\n
2.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Borsad Police
\nStation bearing
\nProhibition CR
\nNo.5155 of 2010 for
\nthe offence punishable under Sections 66(1), 65(A),  81, 83 and
\n116(B) of the Bombay Prohibition Act.\n<\/p>\n
3.\tMr.Nanavati,
\nleaned advocate for the applicant has submitted that when the bail
\napplication was preferred, charge sheet was not filed and the
\napplicant was arrested in respect of another offence. However, now,
\nhe has been released on bail in all cases registered against him
\nexcept the
\npresent matter. He submitted that in other case, co-accused have also
\nbeen released on bail. Mr.Nanavati, learned advocate has further
\nsubmitted that he was arrested on 12th
\nMarch, 2011 and the only offence alleged against him under the
\nProhibition Act and that is done only on the basis of statement of
\ndriver\/cleaner and not in view of any recovery. He submitted that as
\nthe co-accused have also been released, present applicant may be
\nenlarged on bail.\n<\/p>\n
4.\tThe
\napplication is opposed by Mr.Dabhi, learned APP, who has submitted
\nthat the applicant committed the alleged offence which is serious in
\nnature and that therefore the application deserves to be rejected.\n<\/p>\n
5.\tHaving
\nheard the learned counsel for both the sides and considering the
\nfacts and circumstances of the case, the gravity of the offence, the
\nquantum of punishment, the allegations against the applicant, the
\nmanner in which the applicant is allegedly involved in the case as
\nper the allegation of the prosecution, coupled with the fact that
\nco-accused have also been released on bail, I am of the view that the
\napplicant deserves to be released on regular bail, I am inclined to
\nallow this application and release the applicant.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicant
\n in connection with Prohibition
\nCR
\nNo.5155 of 2010 registered
\nwith Borsad
\nPolice
\nStation,
\nbe released on bail, in respect of the offences alleged against him
\nin this application, on his executing and furnishing a bond of
\nRs.10,000\/- (Rupees: Ten Thousand Only) with two solvent sureties of
\nlike amount, by the concerned Police Officer, and on condition that
\nhe shall:-\n<\/p>\n
\t(a)
\nnot take undue advantage of or abuse the liberty.\n<\/p>\n
(b)
\nnot act in manner injurious to the interest of the prosecution.\n<\/p>\n
(c)
\nmaintain law and order.\n<\/p>\n
(d)
\nnot leave the State of Gujarat without prior permission of the
\nSessions Court concerned.\n<\/p>\n
(e)
\nfurnish the address of his residence at the time of execution of bond
\nand shall not change the residence without prior permission of the
\nSessions Court\/this Court.\n<\/p>\n
(f)
\nsurrender his passport, if any, to the lower court within 4 days from
\nthe date of this order.\n<\/p>\n
(g)
\nmark his presence at the Borsad
\nPolice Station,
\ninitially
\non 23rd
\nJune, 2011 and
\nthereafter on every first and fifteenth day of every month,
\nbetween
\n11.00 a.m. to
\n3.00 p.m., till
\nthe trial is over.\n<\/p>\n
(h)
\nnot enter the revenue limit of District Anand and Taluka Danera till
\nthe trial is over and for 6 months shall not enter revenue limits of
\nTaluka Danera without prior permission of the Sessions Court, but for
\nmarking his presence and attending the Court in connection with this
\ncase the applicant will be free to enter the limits for a period to
\nthe extent necessary and will leave the limits of Anand District
\nimmediately after the case is adjourned.\n<\/p>\n
7.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
8.\tIf
\nbreach of any of the above conditions is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
9.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely prima facie, tentative and preliminary
\nnature and have been made only for the purpose of examining prayer
\nfor bail pending the trial. The Court shall arrive at its own
\nconclusion independently on the basis of the evidence and other
\naspects of the case.\n<\/p>\n
11.\tRule
\nis made absolute to the aforesaid extent. Direct service is
\npermitted.\n<\/p>\n
