No. 2937 of 2009\n                  --------------------------------------------\n                  Dated this the 13th day of July, 2010\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">Ramachandran Nair, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      The short question arising for consideration is whether the<\/p>\n<p>appellant is entitled to have students allotted by the Commissioner of<\/p>\n<p>Entrance Examinations for admission to the first year of BHMS<\/p>\n<p>Course. Admittedly the appellant-college was not permitted to admit<\/p>\n<p>students for the academic year 2009-10 for the reason that deficiency is<\/p>\n<p>noted by the Central Council of Homoeopathy which prompted them to<\/p>\n<p>think of withdrawal of recognition and approval. However, Central<\/p>\n<p>Council of Homoeopathy after conducting fresh inspection has sent a<\/p>\n<p>communication dated 31.5.2010 to the Central Government, copy of<\/p>\n<p>which is produced in Court. It is stated by the Central Council of<\/p>\n<p>Homoeopathy that they do not propose to withdraw approval under<\/p>\n<p>Section 19 of the HCC Act because the college has improved facilities<\/p>\n<p>therein. It is specifically stated that the Executive Committee does not<\/p>\n<p>propose to prevent admission to BHMS Course for the current<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WA 2937\/2009                        2<\/span><\/p>\n<p>academic year.        Standing counsel appearing for the Central<\/p>\n<p>Government submitted that communication of Central Council of<\/p>\n<p>Homoeopathy was received by them and the Government still felt that<\/p>\n<p>instruction facility is inadequate inasmuch as there is inadequacy of<\/p>\n<p>teaching faculty members. Appellant&#8217;s counsel submitted that this is a<\/p>\n<p>common feature in every college and it is only on account of State<\/p>\n<p>Government&#8217;s delay in fixing the staff strength for the college and it is<\/p>\n<p>for the Government to do it as appellant&#8217;s college is an aided college.<\/p>\n<p>Going by the communication of Central Council of Homoeopathy<\/p>\n<p>produced before us, we do not find any justification to prevent<\/p>\n<p>allotment of students for admission to first year BHMS course to<\/p>\n<p>appellant&#8217;s college for the academic year 2010-11.<\/p>\n<p id=\"p_3\">      We dispose of the Writ Appeal by directing the Commissioner of<\/p>\n<p>Entrance Examinations to allot required number of students in<\/p>\n<p>accordance with norms to the appellant&#8217;s college to the first year<\/p>\n<p>BHMS course for the year 2010-11. We direct the Central Government<\/p>\n<p>to   take   a   decision   on   Central  Council   of   Homoeopathy&#8217;s<\/p>\n<p>recommendation and communicate the same at the earliest also by<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WA 2937\/2009                       3<\/span><\/p>\n<p>taking into account the problems expressed by the appellant stated<\/p>\n<p>above with regard to role of State Government in fixation of strength of<\/p>\n<p>teaching faculty.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                     (C.N.RAMACHANDRAN NAIR)<br \/>\n                                                    Judge.\n<\/p>\n<p id=\"p_6\">\n                                            (P.S.
