Application No.4916 of 2010.\n<\/p>\n<p id=\"p_3\">3.\tHeard<br \/>\nlearned advocate Mr Thakore for the applicant and learned APP Mr Vyas<br \/>\nfor the State.\n<\/p>\n<p id=\"p_4\">4.\tOn<br \/>\nperusal of the jail record of the applicant, it reveals that the<br \/>\napplicant is restored to prison by police on 6.2.2010, whereas the<br \/>\napplicant has preferred the restoration application on 07.05.2010<br \/>\nand, therefore, there would be delay of only about 62 days.<br \/>\nTherefore, the delay  caused in filing the Criminal Misc. Application<br \/>\ndeserves  to be condoned.  Accordingly, the application is allowed.<br \/>\nDelay is  condoned.
