Raju with learned Advocate Mr. Chetan K.<br \/>\n\tPandya and Mr. A.J. Desai learned APP for the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p id=\"p_1\">\tAdditional<br \/>\n\taffidavit dated 04.04.2011 is filed by one of the applicants and is<br \/>\n\ttaken on record.  It is submitted that as per the above affidavit,<br \/>\n\trecords pertaining to residence of applicants at Gandhinagar is<br \/>\n\tproduced on record which contain ration card, sale deed of the<br \/>\n\tresidence, telephone and electricity bills, Gas Connection receipts<br \/>\n\tand other certificate about registration of proprietary concern<br \/>\n\t&#8220;Techno shop&#8221; (under the Shops and <a href=\"\/doc\/1692639\/\" id=\"a_1\">Establishment Act<\/a>)<br \/>\n\tand therefore, it is submitted that the applicants are permanent<br \/>\n\tresidents in the State of Gujarat.\n<\/p>\n<p id=\"p_2\">\tMr. S.V.\n<\/p>\n<p id=\"p_3\">\tRaju learned Counsel for the applicants would submit that as per the<br \/>\n\tdecision of this Court in the case of <a href=\"\/doc\/587456\/\" id=\"a_1\">Neela J. Shah V. State<br \/>\n\tof Gujarat<\/a>, 1998 1 G.L.H. 594 (Coram : Hon&#8217;ble Mr. Justice<br \/>\n\tN.N. Mathur as his Lordship then was), Full Bench decision of the<br \/>\n\tMadhya Pradesh High Court in the case of <a href=\"\/doc\/551916\/\" id=\"a_2\">Nirbhay Singh and<br \/>\n\tanother V. The State of Madhya Pradesh<\/a>, 1995 CRI. L.J. 3317,<br \/>\n\tdecision of the Bombay High Court in the case of <a href=\"\/doc\/27847\/\" id=\"a_3\">Akhalaq Ahmed<br \/>\n\tF. Patel V. State of Maharashtra<\/a>, 1998 CRI. L.J. 3969 and<br \/>\n\tthe decision of the Hon&#8217;ble Supreme Court in the case of <a href=\"\/doc\/981549\/\" id=\"a_4\">Ravindra<br \/>\n\tSaxena V. State of Rajasthan<\/a>, (2010) 1 SCC 684 where it is<br \/>\n\theld that powers under <a href=\"\/doc\/1692639\/\" id=\"a_5\">Section 438<\/a> with regard to grant of<br \/>\n\tanticipatory bail can be exercised after either summons or warrant<br \/>\n\tis issued by the Magistrate and even in a successive anticipatory<br \/>\n\tbail. In view of the above decisions, it is submitted that the<br \/>\n\tapplicants would take appropriate course of action in accordance<br \/>\n\twith law before the competent Court but meanwhile, their freedom and<br \/>\n\tliberty as enshrined under Articles 19 and 21 of the Constitution of<br \/>\n\tIndia is sought to be taken away by the impugned order dated<br \/>\n\t28.03.2011 passed by the learned Judicial Magistrate First Class,<br \/>\n\tCourt No.31, Jaipur City, Jaipur and till then they may be<br \/>\n\tprotected.  It is further submitted that the applicants are ready<br \/>\n\tand willing to co-operate with the investigation and at this stage,<br \/>\n\tthis Court would only consider the case of the applicants for<br \/>\n\ttransitory bail. However, discussion on merit of the impugned order<br \/>\n\tis not be gone into.\n<\/p>\n<p id=\"p_4\">\tConsidering<br \/>\n\tthe above decisions and law laid therein and by imposing suitable<br \/>\n\tconditions, I am of the view that till the applicants approach the<br \/>\n\tCourt of competent jurisdiction, it is necessary that their freedom<br \/>\n\tand liberty be protected by exercising powers in their favour and<br \/>\n\taccordingly, transitory bail is granted to the applicants for a<br \/>\n\tperiod of two (2) weeks from today and meanwhile, the applicants<br \/>\n\tshall approach the competent Court having jurisdiction for further<br \/>\n\tremedy in accordance with law.\n<\/p>\n<p id=\"p_5\">\tThis<br \/>\n\tapplication is allowed to the aforesaid extent with a condition that<br \/>\n\tthe applicants shall approach the Court of competent jurisdiction<br \/>\n\twithin fifteen (15) days from today and till then the applicants<br \/>\n\tshall not be arrested qua the impugned order dated 28.03.2011 passed<br \/>\n\tby the learned Judicial Magistrate First Class, Court No.31, Jaipur<br \/>\n\tCity, Jaipur and applicants are accordingly, granted temporary<br \/>\n\ttransitory bail.  It is made clear that if the applicants fail to<br \/>\n\tcomply with the above conditions and do not approach the Court of<br \/>\n\tcompetent jurisdiction, the order impugned dated 28.03.2011 shall<br \/>\n\toperate.
