Brahma Deva  <\/p>\n<p> 1. The issue in this appeal covers demand of duty after finalisation of provisional assessment, of the product &#8220;FACE-TO-FACE&#8221; cream being manufactured and cleared by the respondents herein.\n<\/p>\n<p> 2.(a) The Assistant Collector, while finalizing the provisional assessments after considering the nature of the product, the HSN Notes, notes in CETA, 1985 and observing and coming to following finding&#8230;&#8230;.\n<\/p>\n<p>  &#8220;in the literature published by the assessee for marketing the product, it is printed in bold letters &#8216;FACE-TO-FACE&#8221;, The ayurvedic way to clean, fresh, glowing skin&#8221;. In the inside wrapper, under indications, it is printed &#8220;regular application of face-to-face will heal and cure pimples and acne, clear pimples, scars and bring back the natural smoothness and glossiness of your complexion&#8221;.\n<\/p>\n<p> held, it is thus obvious by the advertising literature prepared by the assessee to market the product that emphasis is on restoring natural smoothness and glossiness of the complexion; and the pharmaceutical application of the product mentioned in the literature was sub-servient to the main use of the entity for the care of the skin. It was, therefore, held to be clearly answering to the wordings of Chapter Note 33(2} and a reference to HSN note confirms the view that the item face to face is mainly a preparation for care of the skin. Thereafter, relying on the Tribunal&#8217;s decision in the case of M\/s. Alpine Industries, 1997(92) ELT 53 (Tri) wherein the Hon&#8217;ble Bench of this Tribunal was concerned with classification of the product of &#8216;Lip Salve&#8217;, used for treating chapped lips, the conclusion was reached that the entity is a cosmetic preparation for care of the skin.\n<\/p>\n<p> 2(b). On the other hand, the learned Commissioner (Appeals) has recorded the following finding, in this connection:\n<\/p>\n<p>  &#8220;4.7 The project literature given to the doctors clearly indicates the various skin conditions in which this cream could be used as a medicine. A closer glance of the brochure indicates that the product is not a cosmetic, but a medicament. Further, the extracts from various books submitted by the appellants also indicates various ailments for which the above product could be used&#8221;.\n<\/p>\n<p> This finding of the Commissioner, besides being cryptic &amp; devoid of reasons cannot, ipso facto conclude the subsidiary nature of the therapeutic effects of the entity under classification dispute.\n<\/p>\n<p> 3(a) The issue of whether an entity would fall under Chapter 30 of the CETA, 1985 or Chapter 33, is to be decided on the following principles which emerge from various Apex Court&#8217; decisions on the subject.\n<\/p>\n<p> (i) A medicine is that which is prescribed by a medical practitioner.\n<\/p>\n<p> (ii) A medicine is that which is used for a limited period of time (unless it has to be used every day to deal with a specific disease, e.g. diabetes).\n<\/p>\n<p> (iii) Drug licence is not relevant. (The Supreme Court upheld the Tribunal&#8217;s decision in 1985(22) ELT 844, in which the product was manufactured under Ayurvedic drug licence as mentioned in Para 17-iii). Common perception is more relevant.\n<\/p>\n<p> (iv) In the case of Face to Face cream, the product is recommended by the manufacturers to medicine practitioners, but the evidence that it is prescribed by them has not been considered by the lower authority. Further, indications for use indicate that it is to be used regularly every day for the desired result and indications for its use for specified periods of time or evidence that it is so prescribed has to be tested.\n<\/p>\n<p> 3(b) Reading the provisions of Chapter 30 of CETA, 1985 and Chapter 33 ibid, and the notes thereunder, its apparent that therapeutic or prophylactic uses must be the main uses of the product to classify it as a medicament. Mere fact that some ingredients are mentioned in the Authoritative text books on Ayurveda would not make the product a &#8220;medicament&#8221;. This view is supported by Note 1(d) to Chapter 30 which mentions that. &#8220;This Chapter does not cover reparations of Chapter 33 even if they have therapeutic or prophylactic properties&#8221;. This view is further strengthened from Note 2 to Chapter 33 according to which products would remain classified under Chapter 33 even if &#8220;they contain subsidiary pharmaceutical or antiseptic constituents, or are held out as having subsidiary curative or prophylactic value&#8221;.\n<\/p>\n<p> 4. In this view of the matter, the entire proceedings are required to be remitted back to the original authority, to re-fdetermine the issues in light of the additional material, which the appellants have produced before this Tribunal, as regards the product being prescribed by the doctors. Needless to add, that in the remand proceedings, the original authority will grant a hearing and thereafter establish the correct classification, based on the tests as prescribed by the Apex Court and facts in the case.\n<\/p>\n<p> 5. We, however, make it clear that the issue of provisional assessment raised being not for classification, would not assist the respondents, to urge before the original authority, since an assessment which was provisional under Rule 9B would be deemed to be provisional for all purposes.\n<\/p>\n<p> 6. With these observations, we set aside the orders allow in the Revenue appeal and remand the matter back to the original authority to re-determine the classification and consequential duties, if any, thereafter.
