Justice S.SIRI JAGAN\n\n Dated :14\/08\/2009\n\n O R D E R\n                               S.SIRI JAGAN, J.\n\n                       ==================\n\n                         W.P(C).No.29103 of 2007\n\n                       ==================\n\n                Dated this the 14th day of August, 2009\n\n                               J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Pursuant to tenders invited for allotment of plots in the industrial<\/p>\n<p>park of the Kerala Small Industries Development Corporation Ltd. at<\/p>\n<p>Angamaly, the petitioner was allotted six plots. The petitioner paid 60<\/p>\n<p>per cent of the amount for such allotment as required by the tender<\/p>\n<p>conditions. But despite request by the petitioner, the 1st respondent<\/p>\n<p>did not give possession of the allotted plots to the petitioner without<\/p>\n<p>assigning any reasons. At the same time, the 1st respondent has issued<\/p>\n<p>notification inviting tenders for allotment of other plots in the industrial<\/p>\n<p>park. It is under the above circumstances, the petitioner has filed this<\/p>\n<p>writ petition seeking the following reliefs:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;a)   Issue a writ of mandamus or other appropriate writ or order<br \/>\n            commanding the respondents to hand over the possession of six<br \/>\n            plots to the petitioner unit in the industrial park at Angamaly as<br \/>\n            ordered in Ext.P3 to P8.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      b)    Issue writ of prohibition or other appropriate writ or order<br \/>\n            restraining the respondents from allotting any plot to any person or<br \/>\n            agencies in the industrial Park at Angamaly under SIDCO without<br \/>\n            complying Exts.P3 to P8 orders and handing over possession of six<br \/>\n            plots to the petitioner unit.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      c)    Order an enquiry against the respondents and order appropriate<br \/>\n            action against them for delaying the handing over of the<br \/>\n            possession of the 6 plots to the petitioner industrial unit by Exts.P3<br \/>\n            to P8.&#8221;<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.     Now an affidavit has been filed on behalf of respondents 1<\/p>\n<p>and 2 giving two compromise proposals as follows:<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<blockquote id=\"blockquote_3\"><p>            &#8220;3.    The first proposal is to provide balance of 16.845 cents to<br \/>\n      make up 60 cents in the very same Estate of SIDCO.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>            4.     The second proposal is to cancel the present allotment and<br \/>\n      to make fresh allotment of 60 cents lying contiguously in the very same<br \/>\n      estate of SIDCO at the same price of the earlier allotment.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">      3.    The counsel for the petitioner submits that the second<\/p>\n<p>proposal is acceptable to he petitioner. Accordingly, this writ petition is<\/p>\n<p>disposed of with the following directions:\n<\/p>\n<p id=\"p_5\">      Respondents 1 and 2 shall cancel the present allotment and<\/p>\n<p>make fresh allotment of 60 cents of land lying contiguously in the very<\/p>\n<p>same industrial estate of the 1st respondent at the same price as in<\/p>\n<p>the earlier allotment.
