PUBLIC\nPROSECUTOR for the\nRespondent. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE DN PATEL\n\t\t\n\t\n\n \n\n\t\t\t \nDate : 04\/07\/2008 \n\n \n\n \n\t\t\t\tORAL\nORDER<\/pre>\n<p id=\"p_1\">\t\tRule.\n<\/p>\n<p id=\"p_1\">Learned Additional Public Prosecutor Mr. Maulik Nanavati waives<br \/>\nservice of notice of Rule on behalf of the respondent-State.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\napplication has been preferred for regular bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of<br \/>\nthe Code of Criminal Procedure,1973, in connection with the offence<br \/>\nbearing C.R.No.I-98 of 2008 registered with Naranpura Police Station<br \/>\nunder <a href=\"\/doc\/538436\/\" id=\"a_1\">Sections 498-A<\/a>, <a href=\"\/doc\/92983\/\" id=\"a_2\">306<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of the Indian Penal Code and<br \/>\n<a href=\"\/doc\/876400\/\" id=\"a_4\">section 31<\/a> of the Domestic Violence Act.\n<\/p>\n<p id=\"p_3\">3.\t\tHaving<br \/>\nheard the learned counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, role played by the applicant,<br \/>\nstatements of witnesses, gravity of the offence, quantum of<br \/>\npunishment, the manner in which the applicant is involved in the<br \/>\noffence, as per the allegations of the prosecution, considering the<br \/>\nstatement of witnesses, especially of neighbour Shantaben,  looking<br \/>\nto the evidence collected by the investigating agency and also<br \/>\nlooking to the age of the present applicant who is about 24 years,<br \/>\ncoupled with the fact that the investigation is already over and<br \/>\ncharge-sheet is filed and also keeping in mind the fact that there is<br \/>\nno antecedent of the present applicant, this application is allowed.<br \/>\nThe applicant is ordered to be released on bail in connection with<br \/>\nthe offence registered with Naranpura Police Station bearing<br \/>\nC.R.No.I-98 of 2008 on his executing a bond of Rs. 5000\/- (Rs. Five<br \/>\nthousands only) with one surety of like amount to the  satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall,<\/p>\n<p id=\"p_4\">(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_5\">(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_6\">(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p id=\"p_7\">(d)\tshall<br \/>\nmark his presence before Naranpura Police Station on every first day<br \/>\nof English Calendar month between 9.00 a.m. to 2.00 p.m.;\n<\/p>\n<p id=\"p_8\">(e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p id=\"p_9\">(f)\tfurnish<br \/>\nthe address of his residence at the time of<br \/>\nexecution of the bond and shall not change the residence without<br \/>\nprior permission of this Court;\n<\/p>\n<p id=\"p_10\">(h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p id=\"p_11\">4.\tIf<br \/>\nbreach  of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_12\">5.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_13\">6.\tRule<br \/>\nis made absolute.
