2.  grieyantg\u00e9 of: the petitioner is Rule 58 of the<\/p>\n
 ._Karnait.alf.a Wakf hRVulv——-s\u00ab;’1997 specifically provides for issue of<\/p>\n
  82. The impugned show cause notice is not<\/p>\n
irrtheildform’ prescribed. Secondly, it is contended, as is clear<\/p>\n
[from the Vlprescxibed form, the said show cause notice has to be<\/p>\n
 “..:issgue’d._by’ the order of the Board. The impugned show cause<\/p>\n
–..li’.-noticelddo not show that the same is issued by the order of the<\/p>\n
My<\/p>\n
Board. Therefore, it is contended that the impi1.igne;’dt:.l’s<how<\/p>\n
cause notice is vitiated and is liable to be set aside.'  "  . _ 1 I\n<\/p>\n
3. A perusal of Rule 58 shows that the ..Wakf..Board_ has <\/p>\n
the jurisdiction to supersede  ol\\\\[,.,
\nthe managing committee const_ituted._by theinrll
\nany such action, the said mlellldfzilrox\ufb01des shall\ufb02issue notice
\nin Form 82 to a’   action is
\ncontemplated under   67 . A copy of<\/p>\n
the Fonn 82  at  perusal of the same<\/p>\n
discloselslVthast15.the notice should contain when the
\ncommittee is  for what period. then what are<\/p>\n
the reasonsufor ta_k;ing–._action against the committee, if such an<\/p>\n
 action is taken ‘tori—–tl1e basis of the audit report, it shall be<\/p>\n
 ‘ s.peei\ufb01eally;’stated so and a months time is to be given to show<\/p>\n
cause   reply is replied, then further proceedings have<\/p>\n
 to be taken in accordance with the procedure prescribed under<\/p>\n
it if\u00bb law”.\u00ab._It is true in the show cause notice impugned in this Writ<\/p>\n
Petition, the provision of law is not mentioned, date of<\/p>\n
constitution of the committee and the period of  of<\/p>\n
the committee are not mentioned. The petitionierv<\/p>\n
Petition has categorically stated Of’.-‘ what date  isj <\/p>\n
constituted and for what period.\n<\/p>\n
facts which is not in dispute is within ‘the”‘kr1ow1edge<\/p>\n
of the petitioner, the show cause n’oticeL’wo’ul’d–not.get vitiated.<\/p>\n
4. In so far as the  Board has to<\/p>\n
authorize, that ‘argument ernanateds’f1’or11.:Fo1-In 82. A format or<\/p>\n
a form cannot_:o’vfer.\u00a7ri–de4’af.statt1i.gry?.:provision. All that Rule 58<\/p>\n
prescribes’    notice. Now, admittedly a
\nnotice isissued.  Executive Officer of the Karnataka<\/p>\n
State Board of “WakifsA.”–V_is\\\/Iernely in the show cause notice it is not<\/p>\n
  ment<i_oned eVVthatAAVit'vi–s…b'y the order of the Board, it cannot be<\/p>\n
 'peresuna.edrthat' the Board has not authorized him to issue such<\/p>\n
a– noticed.' -Cindjthe contrary, when an official in discharge of his<\/p>\n
'V official functions issues a show cause notice as contempiated<\/p>\n
 t,AAt11V(;f-1:1' the Eaw, the presumption is he has been duly<\/p>\n
 'authorized. It is for the person who disputes the said fact to<\/p>\n

\nproduced except assertion. However, the said contention can
\nalso be urged in the reply\u00a3to be filed to the show caupsesnotice,<\/p>\n
