     The    revision    petitioner   is  the    accused   in<\/p>\n
CC.No.126\/1993 on the file of the Judicial Magistrate of<\/p>\n
First Class, Ettumanoor.      The Sub Inspector of Police,<\/p>\n
Gandhi Nagar Police Station who was examined as Pw10<\/p>\n
prosecuted the revision petitioner alleging offence under<\/p>\n
Sec.377 IPC<\/a> with an allegation that at 4.30 pm on 10.6.1993<\/p>\n
the revision petitioner had carnal sexual intercourse against<\/p>\n
the order of nature with a girl who was examined as Pw1,<\/p>\n
daughter of Pw4 and 5.\n<\/p>\n
     2.   The offence was committed at a time when Pws.4<\/p>\n
and 5 had gone out of the house. On their return Pw1<\/p>\n
reported the matter.     Pws.4 and 5 took Pw1 to Gandhi<\/p>\n
Nagar Police Station and lodged Ext.P1 First Information<\/p>\n
Crl.R.P.No.372 of 2002.\n<\/p>\n

Statement.       Pw6, the Head Constable recorded Ext.P1<\/p>\n
statement given by Pw1 and registered the case as Crime<\/p>\n
No.313\/1993 for offence under Sec.377 IPC<\/a>.         Pw9, the<\/p>\n
Assistant     Sub     Inspector   of Police  conducted  the<\/p>\n
investigation.      The investigation conducted by Pw9 was<\/p>\n
verified by Pw10 and filed the charge sheet before the trial<\/p>\n
court.\n<\/p>\n
      3.    The learned Magistrate took cognizance and<\/p>\n
issued process, responding to which the revision petitioner<\/p>\n
entered appearance.        Copies of the charge sheet and<\/p>\n
relevant records were furnished. After hearing the revision<\/p>\n
petitioner and prosecution, charge for offence under<\/p>\n
Sec.377 was framed. When it was read over and explained,<\/p>\n
revision petitioner pleaded not guilty. Hence, he was sent<\/p>\n
for trial.\n<\/p>\n
      4.    On the side of prosecution Pws.1 to 10 were<\/p>\n
examined and Exts.P1 to P6 and MO1 were marked. When<\/p>\n
questioned under Sec.313 Crl.P.C., the revision petitioner<\/p>\n
Crl.R.P.No.372 of 2002.\n<\/p>\n

took up a defence that the case was falsely foisted because<\/p>\n
of an earlier money dispute. However, no defence evidence<\/p>\n
was let in.      The learned Magistrate on appraisal of the<\/p>\n
evidence arrived a finding that the prosecution had<\/p>\n
succeeded to establish the offence alleged. Consequently<\/p>\n
the revision petitioner was convicted and sentenced to<\/p>\n
rigorous imprisonment for two years.<\/p>\n
      5.    Being aggrieved by the above conviction and<\/p>\n
sentence, the revision petitioner preferred an appeal as<\/p>\n
Crl.Appeal No.21\/1998 before the Court of Sessions,<\/p>\n
Kottayam. The Addl.Sessions Judge, to whom the appeal<\/p>\n
was made over, by judgment dated 7.1.2002 came to the<\/p>\n
finding that the prosecution had succeeded to establish the<\/p>\n
offence. Consequently, the conviction was confirmed. But<\/p>\n
the sentence was reduced to rigorous imprisonment for one<\/p>\n
year.\n<\/p>\n
      6.    Assailing the legality, correctness and propriety of<\/p>\n
the conviction and sentence as was modified in appeal, this<\/p>\n
Crl.R.P.No.372 of 2002.\n<\/p>\n

revision petition was preferred.\n<\/p>\n
      7.    The learned counsel Sri.Jaishankar V. Nair on<\/p>\n
behalf of the revision petitioner argued that the prosecution<\/p>\n
had not succeeded to prove the offence beyond the shadow<\/p>\n
of reasonable doubt and that to support the prosecution<\/p>\n
there is only the oral testimony of victim as Pw1 and hence<\/p>\n
the prosecution story should have been disbelieved. It was<\/p>\n
further argued that there was no penetration and hence no<\/p>\n
offence under Sec.377 IPC<\/a> was made out.          Even if the<\/p>\n
revision petitioner had committed any offence, it is only<\/p>\n
under Sec.354 IPC<\/a>.\n<\/p>\n
      8.    Having gone through the judgment impugned and<\/p>\n
the evidence on record, I find that in support of the<\/p>\n
prosecution case there is only the oral testimony of Pw1.<\/p>\n
Pws.4 and 5 who are the parents of Pw1 have got only<\/p>\n
hearsay information. On a critical scrutiny of the evidence<\/p>\n
of Pw1, I find that her evidence, though that of a child<\/p>\n
witness, instil confidence. The courts below were justified<\/p>\n
Crl.R.P.No.372 of 2002.\n<\/p>\n

in giving credence to her testimony to come to a conclusion.<\/p>\n
The learned counsel for the revision petitioner could not<\/p>\n
point out anything to disbelieve the testimony of Pw1.<\/p>\n
There is nothing on record to show that Pws.4 and 5, the<\/p>\n
parents of Pw1 had fabricated a case like the one to wreak<\/p>\n
vengeance against the revision petitioner. So the argument<\/p>\n
that the evidence of Pw1 is not believable and that this is a<\/p>\n
cooked up case is devoid of any merit.\n<\/p>\n
      9.    The evidence of Pw1 would show that the revision<\/p>\n
petitioner who was familiar had been to the house of Pw1 at<\/p>\n
a time when Pw1 was alone.          The revision petitioner<\/p>\n
approached Pw1 with a request for a pen for a purpose<\/p>\n
which was known to the revision petitioner alone and after<\/p>\n
making some scribblings pen was returned. Then Pw1 was<\/p>\n
lifted and took inside the room. She was made lie over the<\/p>\n
cot. The revision petitioner removed her under garments<\/p>\n
and lay over Pw1. According to Pw1, the revision petitioner<\/p>\n
pressed his genital at her thighs and there was bleeding<\/p>\n

from the genital. It appears that there is discharge. There<\/p>\n
is nothing on record to show that there was carnal<\/p>\n
intercourse. So, the contention of the learned counsel for<\/p>\n
the revision petitioner that no offence under Sec.377 IPC<\/a> is<\/p>\n
made out has merit.        From the evidence of Pw1 it is<\/p>\n
revealed that the intension of the revision petitioner was to<\/p>\n
satisfy his lust and in that attempt her modesty was<\/p>\n
outraged and an offence under Sec.354 IPC<\/a> is made out.<\/p>\n
So, the conviction and sentence under Sec.377 are not<\/p>\n
sustainable. Whereas, offence under Sec.354 IPC<\/a> is made<\/p>\n
out and the revision petitioner is liable to be convicted and<\/p>\n
sentenced for offence under Sec.354 IPC<\/a>.<\/p>\n
      10. Having due regard to the entire circumstances<\/p>\n
and facts of the case, I find that a sentence of simple<\/p>\n
imprisonment for nine months and a fine of Rs.3,000\/- would<\/p>\n
meet the ends of justice.\n<\/p>\n
      11. In the result, this revision petition is allowed in<\/p>\n
part.    The conviction and sentence for offence under<\/p>\n
Crl.R.P.No.372 of 2002.\n<\/p>\n
                           -: 7 :-<\/span><\/p>\n
Sec.377 IPC<\/a> are set aside. Instead he is convicted for offence<\/p>\n
under Sec.354 IPC<\/a> and sentenced to simple imprisonment<\/p>\n
for 9 months and a fine of Rs.3,000\/-. In default of payment<\/p>\n
of fine, the revision petitioner shall undergo simple<\/p>\n
imprisonment for a further period of two months.<\/p>\n
