This application has been filed for condonaton of delay<\/p>\n<p>of 77 days in re-filing the present application under Section 34. It is<\/p>\n<p>not disputed that the petition under Section 34 initially was filed<\/p>\n<p>within the period of limitation. However, the Registry raised some<\/p>\n<p>objections and the objections were not removed within time and<\/p>\n<p>there was a delay of 77 days in re-filing the petition after removal of<\/p>\n<p>objections.    The plea taken in the application is that the clerk of<\/p>\n<p>counsel for the applicant had to leave for his native place urgently<\/p>\n<p>due to some personal reasons because of which the file of the<\/p>\n<p>present petition became untraceable. The clerk of counsel for the<\/p>\n<p>applicant joined office only on 5th February, 2009 and thereafter it<br \/>\nIA No.2807\/2009 in OMP No.99\/09Page                             1 of 4<br \/>\n took 3-4 days for him to trace the relevant file of the present case.\n<\/p>\n<p>Thus, there was delay of 77 days in re-filing the present petition.\n<\/p>\n<p>2.          The application is opposed by respondent on the ground<\/p>\n<p>that the affidavit filed along with the petition regarding reasons of<\/p>\n<p>delay was not truthful.   The petitioner in another case had taken<\/p>\n<p>different stand, while counsel is same, clerk is same.      There the<\/p>\n<p>ground taken is that of confusion, here the ground taken is of clerk<\/p>\n<p>having gone to his native place.\n<\/p>\n<p>3.          This Court in <a href=\"\/doc\/69240527\/\">Delhi Jal Board vs. Digvijay Singh<\/p>\n<p>Sanitations &amp; Anr.        OMP No.<\/a> 396\/2007 decided on 26.5.2009<\/p>\n<p>observed as under:\n<\/p>\n<blockquote><p>            &#8220;6.   Counsel for the petitioner, on the other hand,<br \/>\n            relied on 2007 (10) ADL 42 DDA v R.S. Jindal wherein<br \/>\n            a Division Bench of this Court observed that the<br \/>\n            statutory authority had to rely on their counsels who<br \/>\n            conduct cases and when the counsel admitted that<br \/>\n            there was default and mistake by his office, the<br \/>\n            statutory authority should not be made to suffer for<br \/>\n            the mistake of the counsel.<\/p><\/blockquote>\n<p>            7.     A perusal of record would show that the initial<br \/>\n            filing was done on 26th August 2006 i.e. within the<br \/>\n            period of three months and refilling was done on 18th<br \/>\n            July 2007. It is obvious from the affidavit filed by the<br \/>\n            petitioner&#8217;s counsel that after the file was taken back<br \/>\n            from Registry for removing the objections, it got<br \/>\n            misplaced in another file with same cause title and<br \/>\n            the counsel could not pay attention due to ailment of<br \/>\n            his uncle. The other OMP between the same parties<br \/>\n            though came up for hearing in May, 2007 but in that<br \/>\n            only an adjournment was sought by respondent. In<br \/>\n            view of this fact, there seems to be no chance of the<br \/>\n            counsel for petitioner stumbling upon the objections<br \/>\n            lying in the file. It only seems that after execution<br \/>\nIA No.2807\/2009 in OMP No.99\/09Page                           2 of 4<br \/>\n             was filed by respondent, the petitioner&#8217;s counsel<br \/>\n            realized that objections filed by the petitioner were<br \/>\n            to be refilled after removing objections and then<br \/>\n            made efforts to trace the objections.\n<\/p>\n<p>            8.     The petitioner in this case had filed objections<br \/>\n            against the award within the stipulated period. It is<br \/>\n            only the counsel who did not rectify the petition after<br \/>\n            removing objections. The petitioner (Delhi Jal Board)<br \/>\n            in this case being a statutory body has to depend<br \/>\n            upon on its advocate. The counsel who had taken<br \/>\n            back the petition for removing office objections,<br \/>\n            could not refile the petition due to intervening<br \/>\n            circumstances. I consider that the petitioner who had<br \/>\n            filed objections within the prescribed period under<br \/>\n            the law, cannot be made to suffer for the negligence<br \/>\n            on the part of its counsel. The delay in refilling is<br \/>\n            though is of about ten and half months but due to<br \/>\n            circumstances explained by counsel and in view of<br \/>\n            the fact that nothing has come on record to show<br \/>\n            that what has been stated by counsel for the<br \/>\n            petitioner was not correct, the application deserves<br \/>\n            to be allowed. It is not a case of the respondent that<br \/>\n            the uncle of the petitioner&#8217;s counsel had not suffered<br \/>\n            from heart attack or he had not left <a href=\"\/doc\/880298\/\">Delhi. In DDA v.<br \/>\n            R.S. Jindal&#8217;s<\/a> case (supra), this Court had considered<br \/>\n            condonation of delay of 216 days in filing Intra Court<br \/>\n            Appeal and observed that since DDA had to rely on<br \/>\n            the counsel, for the mistake of counsel, the petitioner<br \/>\n            should not be made to suffer.\n<\/p>\n<p>            9.     Section 5 of the Limitation Act is not applicable<br \/>\n            as far as filing of petition under Section 34 is<br \/>\n            concerned, however, I consider that once the petition<br \/>\n            is filed within time, if there is delay in refilling, the<br \/>\n            Court can consider condonation of delay under<br \/>\n            Section 5 of the Limitation Act and if it is found that<br \/>\n            the reasons are justified, such delay can be<br \/>\n            condoned.&#8221;\n<\/p>\n<p>4.          It is apparent that in this case counsel for the petitioner<\/p>\n<p>acted negligently and there was no negligence on the part of the<\/p>\n<p>petitioner in filing objections, I therefore consider that the petitioner<\/p>\n<p>IA No.2807\/2009 in OMP No.99\/09Page                             3 of 4<br \/>\n cannot be penalized for this. But the excuses of the clerk going to<\/p>\n<p>his home town or clerk not taking steps cannot be considered as a<\/p>\n<p>valid excuse.
