Heard the parties.\n<\/p>\n<p id=\"p_3\">                             This application, under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of<\/p>\n<p>                     Criminal Procedure, has been filed on behalf of the State of<\/p>\n<p>                     Bihar, against the order dated 14.8.2007 passed by the<\/p>\n<p>                     Additional Sessions Judge, Fast Track Court No.V, West<\/p>\n<p>                     Champaran, Bettiah, in Criminal Revision No.240 of 2006\/05<\/p>\n<p>                     of 2007, whereby the Additional Sessions Judge, Fast Track<\/p>\n<p>                     Court No.V, West Champaran, Bettiah, has set aside the order<\/p>\n<p>                     dated 16.11.2006 passed by the Chief Judicial Magistrate,<\/p>\n<p>                     West Champaran, Bettiah, in Miscellaneous Case No.97 of<\/p>\n<p>                     2006 and directed him to release the seized truck bearing<\/p>\n<p>                     Registration No.BR-IG-4972         in favour of the revisionist-<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>opposite party after examining the documents produced by<\/p>\n<p>the revisionist-opposite party on executing a proper<\/p>\n<p>Jimmanama and security bond of Rs.10,000,00\/- (Ten lacs)<\/p>\n<p>with a further direction to send a copy of the order to the<\/p>\n<p>Superintendent of Police, Bettiah, West Champaran, for<\/p>\n<p>taking necessary action against the Officer-In-Charge, Bettiah<\/p>\n<p>Mufassil Police Station.\n<\/p>\n<p id=\"p_4\">        Learned A.P.P. for the State of Bihar has only<\/p>\n<p>challenged the order with regard to the direction of the<\/p>\n<p>revisional court for taking necessary action against the<\/p>\n<p>Officer-In-Charge, Bettiah Mufassil Police Station.<\/p>\n<p id=\"p_5\">        From the impugned order of the Additional Sessions<\/p>\n<p>Judge, Fast Court No.V, West Champaran, Bettiah, dated<\/p>\n<p>14.8.2007 in Criminal Revision No.240 of 2006\/05 of 2007, it<\/p>\n<p>appears that the truck bearing Registration No.BR-IG-4972<\/p>\n<p>was standing within the jurisdiction of Bettiah Mufassil<\/p>\n<p>Police Station and the same was seized by the police without<\/p>\n<p>registering the case, which is ordered to be released, and for<\/p>\n<p>that reason the Additional Sessions Judge, Fast Court No.V,<\/p>\n<p>West Champaran, Bettiah, has ordered to send a copy of the<\/p>\n<p>said order to the Superintendent of Police, Bettiah, West<\/p>\n<p>Champaran, for taking necessary action against the Officer-<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           3<\/span><\/p>\n<blockquote id=\"blockquote_1\"><p>       In-Charge, Bettiah Mufassil Police Station.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>               I find nothing wrong in the impugned order dated<\/p>\n<p>       14.8.2007 passed by the Additional Sessions Judge, Fast<\/p>\n<p>       Track Court No.V, West Champaran, Bettiah, in Criminal<\/p>\n<p>       Revision No.240 of 2006\/05 of 2007, to interfere with the<\/p>\n<p>       same in inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code<\/p>\n<p>       of Criminal Procedure.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               Accordingly, this application stands dismissed.<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">                                 (Rajendra Kumar Mishra, J)<\/p>\n<p>P.S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders The State Of Bihar vs Onkar Nath Sharma on 17 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.22709 of 2008 The State Of Bihar&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..Petitioner.
