No.5263 of 2005, on 8.5.2005, at DCB Police<br \/>\nStation, for the offences punishable under Sections  65 A E, 81 and<br \/>\n116 of the Bombay Prohibition Act. The detaining authority has<br \/>\nexplored the possibility of resorting to remedies under the ordinary<br \/>\nlaw, but, found that the prejudicial activities of the detenu can be<br \/>\ncurtailed and prevented only by exercise of power under sub-section<br \/>\n(2) of Section 3 of the PASA Act. Considering over all facts of the<br \/>\ncase, the detaining authority has passed the order of detention dated<br \/>\n1.6.2005.\n<\/p>\n<p id=\"p_2\">\tMs.\n<\/p>\n<p id=\"p_3\">Banna Dutta, learned counsel appearing for the detenu has assailed<br \/>\nthe order of detention contending that solitary incident alleged<br \/>\nagainst the detenu is not of such magnitude and intensity as to have<br \/>\nthe effect of disturbing the public order so as to pass an order<br \/>\nunder Section 3(1) of the PASA Act. According to her submission,<br \/>\nthere is no nexus between registration of crime and resultant effect<br \/>\nthereof on the public order or general health of public. She has<br \/>\nfurther submitted that the detaining authority has not applied his<br \/>\nmind to the vital facts and there was total non-application of mind<br \/>\nbefore recording the order of detention. In support of her<br \/>\ncontention, she has relied upon the following case-laws:\n<\/p>\n<p id=\"p_4\">Judgment<br \/>\n\tand order dated 22.8.2000 of the Division Bench of this Court<br \/>\n\t(Coram: M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent<br \/>\n\tAppeal No.223 of 2000 in Special Civil Application No.554 of 2000<br \/>\n\t(<a href=\"\/doc\/850148\/\" id=\"a_1\">Ashok Balabhai Makwana vs. State of Gujarat<\/a>);\n<\/p>\n<p id=\"p_5\"><a href=\"\/doc\/575391\/\" id=\"a_2\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner<\/a> of police, AIR 1989 Supreme Court<br \/>\n<span class=\"hidden_text\" id=\"span_1\">\t491<\/span><\/p>\n<p><a href=\"\/doc\/964968\/\" id=\"a_3\">Om<br \/>\n\tPrakash vs. Commissioner of Police and others, JT<\/a> 1989 (4) SC 177<\/p>\n<p>Kanuji<br \/>\n\tS. Zala vs. state of Gujrat ando thers, 1999 (2) GLH 415.\n<\/p>\n<p id=\"p_6\">\tMrs.\n<\/p>\n<p id=\"p_7\">Hansa Punani, learned Assistant Government Pleader has submitted that<br \/>\nregistration a crime at DCB Police Station would go to show that the<br \/>\ndetenu had, in fact, indulged into such activities, which can be said<br \/>\nto be disturbing the public order. She further submitted that there<br \/>\nwas sufficient material before the detaining authority to pass the<br \/>\norder of detention and no interference is called for by this Court in<br \/>\nexercise of its power under <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_8\">\tHaving<br \/>\nheard the rival submissions of the parties and perused the record of<br \/>\nthe case, I am of the view that the solitary incident or instance in<br \/>\nquestion, as alleged, has not been shown as affecting the &#8216;public<br \/>\norder&#8217; or likely to create public disturbance or prejudicial or<br \/>\nadverse to the maintenance of &#8216;public order&#8217;, and, therefore, the<br \/>\ncontinued detention of the detenu has not been shown to be<br \/>\njustifiable. It cannot be disputed that firstly, there must be cogent<br \/>\nmaterial before the detaining authority, and secondly, there must be<br \/>\nmaterial to show that the detaining authority has applied its mind to<br \/>\nthe vital and important aspects and facts before reaching the<br \/>\nsubjective satisfaction required under the law. The power to detain a<br \/>\nperson under the PASA Act is not based on simple facts about<br \/>\nregistration of crimes under the Bombay Prohibition Act or the<br \/>\nactivities of bootlegging of the detenu. There has to be nexus and<br \/>\nlink for such activities with disturbance of the public order. The<br \/>\nactivities of the detenu must, in the backdrop of the facts, reflect<br \/>\nthat such activities disturbed the even tempo or normal life of the<br \/>\ncommunity in the locality or disturbed general peace and tranquility<br \/>\nor create a sense of alarm and insecurity in the locality. On a<br \/>\ncareful perusal of the ground of detention order and relying upon the<br \/>\nthe judgment and order dated 22.8.2000 of the Division Bench of this<br \/>\nCourt (Coram: M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent<br \/>\nAppeal No.223 of 2000 in Special Civil Application No.554 of 2000, in<br \/>\nmy view, it cannot be said that the activities of the detenu are<br \/>\nprejudicial to the public order and, therefore, the order of<br \/>\ndetention  passed by the detaining authority cannot be sustained and<br \/>\nis required to be quashed and set aside.\n<\/p>\n<p id=\"p_9\">\tIn<br \/>\nthe result, the petition is allowed. The order of detention dated<br \/>\n1.6.2005 is quashed and set aside. The detenu, Prakashbhai Thakraram<br \/>\nBishnoi is ordered to be set at liberty forthwith if he is not<br \/>\nrequired in connection with any other case. Rule is made absolute<br \/>\naccordingly.
