No.2018 of 2008\n                      -------------------------------------\n               Dated this the 11th day of June, 2008\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">     Petitioner is the defacto complainant in a prosecution for<\/p>\n<p>offences punishable, inter alia, under <a href=\"\/doc\/1439698\/\" id=\"a_1\">Sections 120<\/a> B, 395 and<\/p>\n<p>201 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. Altogether there are 7 accused persons. Accused 2, 3,<\/p>\n<p>5 and 6 have been found guilty, convicted and sentenced.<\/p>\n<p>Accused No.1 expired during the pendency of the proceedings.<\/p>\n<p>Accused No.4 was found not guilty and acquitted. Accused No.7<\/p>\n<p>was not available for trial. He was absconding. The case against<\/p>\n<p>him was split up and was refiled.\n<\/p>\n<p id=\"p_1\">     2. Against the verdict of guilty, conviction and sentence, an<\/p>\n<p>appeal has been preferred before this Court and that is pending<\/p>\n<p>as Crl.Appeal No.901 of 2008. In the judgment of the court below,<\/p>\n<p>there is a direction to return M.Os 8 and M.Os 13 to 146 which<\/p>\n<p>are gold ornaments belonging to the petitioner herein to him. He<\/p>\n<p>was held entitle to get back the gold ornaments.               The gold<\/p>\n<p>ornaments, being valuables belonging to PW4, were directed to<\/p>\n<p>be returned to him after the appeal period is over. All other M.Os<\/p>\n<p>were directed to be disposed of after the appeal period is over<\/p>\n<p>and after the split up case-S.C.No.93 of 2008 is disposed of. No<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No.2018 of 2008         2<\/span><\/p>\n<p>person has preferred any appeal against the direction under<\/p>\n<p><a href=\"\/doc\/1289794\/\" id=\"a_2\">Section 452<\/a> Cr.P.C to return the gold ornaments M.O 8 and M.Os<\/p>\n<p>13 to 146 to the petitioner herein.\n<\/p>\n<p id=\"p_2\">     3.    To be doubly sure, notice was given to the learned<\/p>\n<p>counsel for the appellants in Crl.Appeal No.901 of 2008, ie.<\/p>\n<p>accused 2, 3, 5 and 6. Their counsel submits that they have no<\/p>\n<p>objection against the release of the articles to the petitioner<\/p>\n<p>herein straightaway.\n<\/p>\n<p id=\"p_3\">     4.    The learned Magistrate had directed release of the<\/p>\n<p>gold ornaments to the petitioner pending disposal of the appeal<\/p>\n<p>on condition that the petitioner must produce bank guarantee for<\/p>\n<p>an amount of Rs.1 crore. He was also directed to execute a bond<\/p>\n<p>for Rs.2 lakhs with two solvent sureties.      Aggrieved by that<\/p>\n<p>condition, the petitioner came to this Court and by order dated<\/p>\n<p>01.01.2007 in Crl.M.C.No.4093 of 2006 those conditions were<\/p>\n<p>modified and it was directed that the said articles can be released<\/p>\n<p>to the petitioner on condition that he executes a bond for Rs.1<\/p>\n<p>crore with two solvent sureties each.\n<\/p>\n<p id=\"p_4\">     5.    The petitioner has again come to this Court now with<\/p>\n<p>the grievance that he is unable to comply even with that condition<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No.2018 of 2008         3<\/span><\/p>\n<p>and that consequently it has become impossible for him to take<\/p>\n<p>back the articles from court. They are kept in the custody of the<\/p>\n<p>court and are not released to the petitioner as he has not<\/p>\n<p>executed the bond as directed.\n<\/p>\n<p id=\"p_5\">     6.    Notice was given to the counsel for the appellants in<\/p>\n<p>Crl.Appeal No.901 of 2008. Notice was given to the learned Public<\/p>\n<p>Prosecutor also. The learned Public Prosecutor as well as the<\/p>\n<p>counsel for accused 2, 3, 5 and 6 submit that they have<\/p>\n<p>absolutely no objection against the release of the gold ornaments<\/p>\n<p>to the petitioner herein subject to appropriate safeguards. It is<\/p>\n<p>submitted that no one has any dispute about the entitlement of<\/p>\n<p>the petitioner to take back the gold ornament from the custody of<\/p>\n<p>the court. Considering all the circumstances, I am satisfied that<\/p>\n<p>the said M.O 8 and M.Os 13 to 146 can now be directed to be<\/p>\n<p>released to the petitioner notwithstanding the pendency of the<\/p>\n<p>appeal on condition that he executes a bond for Rs.1 crore<\/p>\n<p>without any sureties undertaking to produce the M.Os before<\/p>\n<p>court as and when called for.\n<\/p>\n<p id=\"p_6\">     7.    This Crl.M.C is accordingly allowed. It is directed that<\/p>\n<p>M.O 8 and M.Os 13 to 146 can now be released to the petitioner<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.M.C.
