            The accused in a prosecution for the offence<\/p>\n
under Section 138 of the Negotiable Instruments Act, 1881<\/p>\n
(for short ‘the N.I.Act’) approached this Court by preferring<\/p>\n
the above revision petition challenging her conviction and<\/p>\n
sentence, imposed as per judgments of the trial court as<\/p>\n
well as the lower appellate court.\n<\/p>\n
       2.    I have heard learned counsel for the revision<\/p>\n
petitioner as well as counsel for the respondents.<\/p>\n
       3. As this Court is not inclined to interfere with the<\/p>\n
order of conviction and sentence recorded by the courts<\/p>\n
below, the learned counsel for the revision petitioner<\/p>\n
submitted that one month time may be granted to the<\/p>\n
revision petitioner to pay the fine amount. Having regard to<\/p>\n
the facts and circumstances involved in the case, I find no<\/p>\n
reason to decline the above request.<\/p>\n

       4.   In the result, this Criminal Revision Petition is<\/p>\n
disposed of confirming the conviction, sentence as modified<\/p>\n
by the appellate court and also confirming the fine amount<\/p>\n
ordered by the courts below.        Accordingly, the revision<\/p>\n
petitioner is granted one month time from today to receive<\/p>\n
the sentence and to pay the fine amount. It is made clear<\/p>\n
that the default sentence fixed by the court below will be<\/p>\n
attracted only in case of failure on the part of the revision<\/p>\n
petitioner in appearing before the court below and paying<\/p>\n
the amount within the above stipulated time. On realisation<\/p>\n
of the fine amount, the same shall be paid to the<\/p>\n
complainant as compensation under Section 357(1)(b) of<\/p>\n
the Cr.P.C. Accordingly, the revision petitioner is directed<\/p>\n
to appear before the trial court on 05.02.2011 to receive<\/p>\n
the sentence and to deposit the fine amount. If there is any<\/p>\n
failure on the part of the revision petitioner in appearing<\/p>\n
before the trial court on 05.02.2011 to receive the<\/p>\n
sentence and to deposit the fine amount, the trial court is<\/p>\n

free to take coercive steps to secure the presence of the<\/p>\n
revision petitioner and to execute the sentence. Coercive<\/p>\n
