S t\n\n  \"J\ufb01pGMENT\n\n , A' J 'C*.J....(0ral)\n\n'   ivappeliants issued an advertisement dated\n\n \n\nI3.1'f1.2VOt\u00b0i5'j_ Vfinviting applications for appointment,\n\n againstiathe post of Junior Laboratory Technician.\n\n'A \"XfRe'sp.ondent~1 Shashikala S. responded to the aforesaid\n\n'  advertisement, weil before the last date of submission of\n\nif the application forms. It is not a matter of dispute, that\n\n\n\n\"\"*'zy'*'~';?3,.\"...,..3\"\"'tiQ\"\n\n,u--u-\n\nduring the process of selection, Respondent No.1<\/pre>\n
secured more marks than the cut-off percentage. In this<\/p>\n
behalf, it would be pertinent to mention, that the’ct1t\u00a7off<\/p>\n
percentage of marks for Category–IIA  _<\/p>\n
61.059520\/6, whereas, Respondent  <\/p>\n
66.5%. It is also apparent froni  <\/p>\n
case, that even though. 532’pVosts”0f <\/p>\n
Technician had to be \ufb01lled__uVp.,:t3e.roug.ht– process of
\nselection conducted the only 529 posts<\/p>\n
came to be filled’ up,-I-t-is1jtheifefei3e oibfiious that three
\nposts remairiled  <\/p>\n
 if j appointment, consequent
\nupon  .haV:i.ng.,”  more than the cut–off<\/p>\n
per(j:;en’tage of respondent No.1 approached this<\/p>\n
i’:’ce_:1xm jfiiing Writ Petition No.41l4\/O8. During the<\/p>\n
“‘coarse'”ef’_~p;-eieeedings of the aforesaid writ petition, the<\/p>\n
stalficev’—V:ad’o’pted by the appellant herein was, that<\/p>\n
rcspondlent no.1 Smtshashikala S. was ineligible for\n<\/p>\n
-l  ‘consideration, and as such, could not be offered<\/p>\n
“appointment against the post of Junior Laboratory<\/p>\n
Technician. Despite the aforesaid stance adopted by the<\/p>\n
:r ya<\/p>\n
  schedule<\/p>\n
appellants herein, Writ Petition No.<\ufb01l\u00bbli4\/08 was
\nallowed by the learned Single Judge of this Court on<\/p>\n
28.8.2009.\n<\/p>\n
3. Through the instant Writ Appeal,   <\/p>\n
have assailed the order passed_on._28.8.;2C0i\u00a7; iifherebyllll<\/p>\n
Writ Petition No.4114\/08 came to b\u00e9jaiioxiiedp    <\/p>\n

\nof Junior  the course of
\nhearing, v’t_hle.:>’ap’pellants, invited our
\nattention”   liarnataka Health and
\n Services (Recruitment to<\/p>\n
certain cadre’s]._'{.Sp–elcial Recruitment], Rules, 2006,<\/p>\n
 relferred to as the 2006 Rules) were<\/p>\n
  :to..:determine the eligibility for appointment to<\/p>\n
th’e__:post .’Cl)ll\ufb02.rJ’K:1:.lI1lOI’ Laboratory Technician. The learned<\/p>\n
V’-..couns”elV__ll?-for the appellants, accordingly, invited our<\/p>\n
ltlattelntion to the schedule appended thereto. The<\/p>\n
interalia enumerates the minimum<\/p>\n
it qualifications for appointment against the posts<\/p>\n
&” regulated by the 2006 Rules, including post of Junior
\nLaboratory Technician. Clausew3 from the aforesaid
\nschedule was brought to our notice which isv-‘being<\/p>\n

the alternative conditions of eligibiiity stipulated for
\nappointment against the post of Junior Laboratory<\/p>\n

7. It is not a matter of dispute that the
\nrespondent no.1 possessed the quali\ufb01cation of SSLC,<\/p>\n
and as such, to determine her eligibility, one has<\/p>\n
ascertain whether in addition to <\/p>\n
o<\/p>\n
qualification, she aiso possessed the qualificiatpion of  2 it
\nyears Diploma in a vocationaigcourse in ‘A.Laboifa.torjJA<\/p>\n
Technician. It is the submission ofthe iearne\u00a7d~.Q,ou.nsel <\/p>\n
for the appellants, that  possess the
\naforesaid quali\ufb01cations.’   asV,’v’:.:ir1,uch as, the
\nqualifications 11\/”1′($.1 is a 2 year
\ncourse    ,  Laboratory
\nTechni_0ia.n_”:”C:ourIse,   vocational course in<\/p>\n
Laboratory’ it is submitted, that<\/p>\n
theg*ua1ificatio,nV”possessed by respondent no.1 has not<\/p>\n
been certified as a recognised vocational course by the<\/p>\n
l”V_ocationlal,_ Board, and as such. the qualifications<\/p>\n
possessledbly the respondent no.1 cannot be accepted<\/p>\n
uasagvalid quali\ufb01cation for determining her eligibility for<\/p>\n
 ‘appointment against the post of Junior Laboratory<\/p>\n
 Technician.\n<\/p>\n

8. In order to repudiate the aforesaid contention,
\nlearned counsel for respondent no.1 has invited our<\/p>\n
attention to the certi\ufb01cate possessed by respondent<\/p>\n
no.1. The aforesaid certi\ufb01cate was placed  _
\nof the writ petition as Annexure;CV.p_ We yperuseclu ”<\/p>\n
the said certificate. The certificate  <\/p>\n

issneed’ by  Secretary, Paramedical Board on<\/p>\n
 aforesaid certi\ufb01cate reads as under:<\/p>\n
 “WHOM so EVER CONCERN<\/p>\n
This is to certify that Ms.S.Shashikala
\nD \/ o.Mr.’i’ Sreenivas has successfully
\ncompleted 2 years Junior Lab Technician
\nCourse from Mysore Medical College,
\nMysore. Now this course is called as Diploma
\nin Medical Laboratory Technology and
\nduration is also of 2 years.\n<\/p>\n

Therefore, Junior Lab Technician
\ncourse can be considered in par with the
\nDiploma in Medical Laboratory Technnclogy
\ncourse for appointment as Juniorj_Lab
\nTechnician.\n<\/p>\n

9. The first objection raisedlby ft_he:’lear_r1ed <\/p>\n
for the appellant can conveniently be –.by–3the 211′<\/p>\n
documents relied upon by th.el:learn_edlhcgaitlselfi for the
\nrespondent no.1. It  that the
\neducational qu;a1ifi.cat\u00a7.on    ..Zrespondent no. 1,
\nnamely, tvsfd   inlX–ray technician
\ncourse;’JuniVorT’1lec’hni’cian has officially been
\n in Medical Laboratory<\/p>\n
‘1’echnologly”.l ” We have no difficulty in<\/p>\n
  —- —the qualification possessed by<\/p>\n
.__respondent'”‘u_o’;–“1 is indeed a Diploma quali\ufb01cation in<\/p>\n
 .lLa_boratory Technician i.e. the stipulated<\/p>\n
V’-\u00bb.qualific,ation prescribed in the 2006 Rules, as also in<\/p>\n
“”ltiie_ advertisement dated 13.11.2006. It also needs to be<\/p>\n
  _pV_r_e-iterated here, that the qualification acquired by the<\/p>\n
1′ respondent no.1 was from the Medical College, Mysore.<\/p>\n

The certi\ufb01cate issued to her was authenticated by
\nofficial functionaries, representing the departments of<\/p>\n
medical education as also paramedical educatio,n,*~.an_d<\/p>\n
as such, the same cannot be treated  _<\/p>\n
acquired from an un–recognised private incsti’tu.t.ion;- ” _ <\/p>\n
10. In so far as  second .cor1tentiQI1–‘ is 2 L’<\/p>\n
concerned, that there, is  on record of
\nthis case to demonstrate’  acquired

\nthe  “something which was not<\/p>\n
prescribeddd\/\u00abrequired.’;_ ” Tile fact, that the certificate<\/p>\n
 by  ——– petitioner, had been issued by<\/p>\n
_Go\\ferninen,tai_’ authorities (referred to above), in our<\/p>\n
