Oza for the petitioner-Banaskantha<br \/>\nSafai Kamdar Sangh. Prayer made in this petition is,<\/p>\n<p>&#8220;11B\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or a writ in the<br \/>\nnature of mandamus or any other appropriate writ, order or directiion<br \/>\ndirecting the respondent- Municipality to respect and implement the<br \/>\n2(P) Agreement dated 5.1.2001 by by giving the compassionate<br \/>\nappointment to the 4 heirs of the deceased- sweepers viz. (1)<br \/>\nSavitaben Jagdishbhai, (2) Jayantibhai Hirabhai, (3) Anilbhai<br \/>\nMaganbhai and (4) Vimlaben Jagdishbhai.&#8221;\n<\/p>\n<p id=\"p_1\">2.\tLearned<br \/>\nadvocate Mr.Mehul H. Rathod appearing for respondent no.1-Palanpur<br \/>\nMunicipality states that the Municipality does not have any intention<br \/>\nto defy or not to implement the settlement under <a href=\"\/doc\/1418464\/\" id=\"a_1\">section 2(p)<\/a> of the<br \/>\nIndustrial Disputes Act, 1947.\n<\/p>\n<p id=\"p_2\">3.\tBesides<br \/>\nthat the learned advocate for respondent no.1-Municipality states<br \/>\nthat the petitioners are either not heirs or not eligible to get<br \/>\nappointment under clause (12) of the settlement under <a href=\"\/doc\/1418464\/\" id=\"a_1\">section 2(p)<\/a> of<br \/>\nthe Industrial Disputes Act.\n<\/p>\n<p id=\"p_3\">4.\tOn<br \/>\nthis statement being made the question involved in this petition<br \/>\nbecomes a disputed question of facts.  Therefore, this Court cannot<br \/>\ngo into the same under <a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_4\">5.\tAt<br \/>\nthe request of learned advocate Mr.Bushan Oza for the petitioner it<br \/>\nis clarified that non entertainment of this petition will not<br \/>\nprejudice the right of the petitioner to take recourse to the remedy<br \/>\navailable to them in accordance with law.  With these observations<br \/>\nthe petition is disposed of.  Notice is discharged.\n<\/p>\n<p id=\"p_5\">In<br \/>\nthe event the petitioner has already approached or approaching the<br \/>\nauthorities hereafter, it is expected that the authorities will give<br \/>\ndue priority to such applications filed by the present petitioner and<br \/>\ndecide the same at the earliest so as to see that the petitioners do<br \/>\nnot get frustrated.\n<\/p>\n<p id=\"p_6\">(RAVI<br \/>\nR.
