Munish Kumar Sharma\nRespondent          -     Supreme Court of India (SCI)\n                        Heard &amp; Decision announced: 15.7.2010\n\n\nFacts<\/pre>\n<p id=\"p_1\">:\n<\/p>\n<p id=\"p_1\">         By an application of 14.1.09 Pt. Manish Kumar Sharma of Karnal<br \/>\n(Haryana) applied to the Chief Justice of India and Prime Minister of India stating<br \/>\nas follows:\n<\/p>\n<p id=\"p_2\">1.            &#8220;There is no section in the Industrial Dispute Act, 1947 under<br \/>\nwhich any employee can be treated as Labour Supplier \/ Contractor.\n<\/p>\n<p id=\"p_3\">2.            Giving judgment against the rules is unconstitutional and the<br \/>\nHon&#8217;ble Labour Commission has not powers to deliver judgment against<br \/>\nthe rules.\n<\/p>\n<p id=\"p_4\">3.            BSNL has cheated and disgraced the judiciary by declaring<br \/>\nme Labour Contractor without proving the same and without observing the<br \/>\nextent rules on the matter applicable in whole of the country.\n<\/p>\n<p id=\"p_5\">       I have acquired complete qualifications under Sec. 12(5) of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI<br \/>\n       Act<\/a>, which are not possessed by any PIO in the country. The same<br \/>\n       are LLB in law (2) Master Degree in Public Administration, (3) P.G.<br \/>\n       J.M.C. in Journalism and Mass Communication, (4) B.Com. Degree<br \/>\n       in Accounts and Administration (5). In public Services, I have<br \/>\n       served as outstanding leader from School to College Level and<br \/>\n       from University to 10-15 years. For my services rendered with<br \/>\n       Relief Organization in helping District Administration at the time of<br \/>\n       Gujarat Earthquake, I was rewarded at Karnal by Hon&#8217;ble Governor<br \/>\n       of Haryana and I use to write regularly to Government and Hon&#8217;ble<br \/>\n       Use for improving their efficiency.&#8221;\n<\/p>\n<p id=\"p_6\">         To this Pt. Manish Kumar Sharma received a response dated Feb. 2, 2009<br \/>\nfrom CPIO Shri Raj Pal Arora, Addl. Registrar Supreme Court of India informing<br \/>\nhim as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8220;I write to say that your request cannot be acceded to by the CPIO,<br \/>\n         Supreme Court of India under Right to <a href=\"\/doc\/1965344\/\" id=\"a_2\">Information Act<\/a>, 2005 as it<br \/>\n         relates to judicial matter i.e. SLP No. 2737-2738 of 2004 (CC No.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                            1<\/span><br \/>\n       374-375 of 2004) which has already been dismissed by this Hon&#8217;ble<br \/>\n      Court on 27.1.2004.&#8221;<\/p><\/blockquote>\n<p id=\"p_7\">      Pt. Manish Kumar Sharma has them moved an appeal again addressed to<br \/>\nthe Chief Justice of India through Registrar SCI seeking answers to a new set of<br \/>\nquestions, as below:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;1.     How the Labour Commission, High Court Chandigarh and<br \/>\n              Supreme Court have considered me as Labour Contractor<br \/>\n              when I have not supplied even a single person to the BSNL<br \/>\n              or Telecommunication Department, Govt. of India, Karnal<br \/>\n              (Haryana)\n<\/p><\/blockquote>\n<p id=\"p_8\">2.            Has the judgments delivered by the Labour Commission,<br \/>\nChandigarh, High Court Chandigarh and Supreme Court been given under<br \/>\nrules of Industrial Dispute Act 1947 ?\n<\/p>\n<p id=\"p_9\">3.            Under which Sec. of Industrial Dispute Act, 1947 an<br \/>\nemployee can be considered as Labour Supplier?\n<\/p>\n<p id=\"p_10\">4.            How the Labour Commission, High Court Chandigarh and<br \/>\nSupreme Court have powers to decide a case outside the jurisdiction of<br \/>\nIndustrial Dispute Act?\n<\/p>\n<p id=\"p_11\">5.            Why should I not be provided justice within ten days after<br \/>\nconducting a judicial enquiry for obtaining wrong judgment from Labour<br \/>\nCourt Chandigarh, High Court Chandigarh and Supreme Court by<br \/>\nmisguiding them?\n<\/p>\n<p id=\"p_12\">6.            Please convey, what punishment will be given to those who<br \/>\nhave disgraced the Judiciary by playing tactics and misguiding them.\n<\/p>\n<p id=\"p_13\">7.            How will judiciary compensate me for destroying my future<br \/>\ncareer, economic condition of my family, mental and physical torture etc.<br \/>\nKindly provide information urgently as mandated under Sec. 7(i) of <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a><br \/>\nas more than 30 days have already elapsed and Sec. 20 of the <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a><br \/>\nhas also been violated. &#8221;\n<\/p>\n<p id=\"p_14\">      Upon this, Shri M. P. Bhadran, Appellate Authority, in his order on Appeal<br \/>\nNo. 29\/2009 delivered on 5.3.09 has directed, as follows:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>      &#8220;The request of the Appellant is to conduct a judicial inquiry about<br \/>\n      the reason for dismissal of his request by the concerned<br \/>\n      Authorities. According to him the request was disallowed by the<br \/>\n      authorities due to fraud.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      The CPIO, Supreme Court of India has informed the Appellant that<br \/>\n      the request of the Appellant as per his application dated 14.1.2009<br \/>\n      addressed to the Hon&#8217;ble the Chief Justice of India cannot be<br \/>\n      accepted since it relates to SLP Nos. 2737-2738 of 2004 (CC No.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                        2<\/span><br \/>\n        374-375 of 2004) which was dismissed by the Hon&#8217;ble Supreme<br \/>\n       Court of India on 27.1.2004.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>       I find no error in the impugned order of the CPIO, Supreme Court of<br \/>\n       India.&#8221;<\/p><\/blockquote>\n<p id=\"p_15\">       Pt. Munish Kumar Sharma has then moved his second appeal before us<br \/>\npleading as below:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>       &#8220;It is requested to Hon&#8217;ble Commission that ignoring the<br \/>\n       shortcomings in my 2nd appeal, orders be issued to achieve<br \/>\n       the objective of Right to <a href=\"\/doc\/1965344\/\" id=\"a_5\">Information Act<\/a>. Justice may be<br \/>\n       achieved for constitutional rights. I will remain obliged to your<br \/>\n       honour.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>       The facts furnished in this appeal are true to the best of my<br \/>\n       knowledge and belief, which is being made against the 1st<br \/>\n       appeal.&#8221;<\/p><\/blockquote>\n<p id=\"p_16\">       The appeal was heard on 15.7.10 through videoconference. The following<br \/>\nare present:\n<\/p>\n<blockquote id=\"blockquote_7\"><p>       Appellant (at NIC Studio Karnal)<br \/>\n             Pt. Munish Kumar Sharma<br \/>\n       Respondents<br \/>\n             Shri Devadatt Kamat, Advocate for SCI<br \/>\n             Ms. Asha Ahuja, Br. Officer, SCI<\/p>\n<p>       Shri Devadatt Learned Counsel for Supreme Court of India presented his<br \/>\nvakalatnama, which has been placed on record. Appellant Pt. Munish Kumar<br \/>\nSharma was asked what request for information he sought and his attention was<br \/>\ninvited to the definition of the &#8220;Right to Information&#8221; as contained in Sec. 2(j). Pt.\n<\/p><\/blockquote>\n<p id=\"p_17\">Munish Kumar Sharma&#8217;s response was that grave injustice had been done to him<br \/>\nand he wished to have an answer and the reasons for this from the Hon&#8217;ble Chief<br \/>\nJustice of India.\n<\/p>\n<p id=\"p_18\">                                DECISION NOTICE<\/p>\n<p>       Sec. 2(j) of the <a href=\"\/doc\/671631\/\" id=\"a_6\">RTI Act<\/a> which defines &#8216;right to information&#8217; is clear:\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                          3<\/span><\/p>\n<p id=\"p_19\">        2(j) &#8220;right to information&#8221; means the right to information accessible<br \/>\n               under this Act which is held by or under the control of any<br \/>\n               public authority and includes the right to&#8211;\n<\/p>\n<p id=\"p_20\">(i)                inspection of work, documents, records;\n<\/p>\n<p id=\"p_21\">(ii)               taking notes, extracts or certified copies of documents or<br \/>\nrecords;\n<\/p>\n<p id=\"p_22\">(iii)               taking certified samples of material;\n<\/p>\n<p id=\"p_23\">(iv)               obtaining information in the form of diskettes, floppies,<br \/>\ntapes, video cassettes or in any other electronic mode or through printouts<br \/>\nwhere such information is stored in a computer or in any other device; &#8221;\n<\/p>\n<p id=\"p_24\">       From the above it should be evident that this Commission has no authority<br \/>\nto order any action on any matter other than allowing access to records through<br \/>\nall means. In this case what Pt. Munish Kumar Sharma nurses is a grievance<br \/>\nagainst a judicial order. His remedy can only lie in using judicial means to obtain<br \/>\nwhat he perceives as justice.     The appeal is, therefore, without merit and is<br \/>\nhereby dismissed.\n<\/p>\n<p id=\"p_25\">       Announced in the hearing.
