(hereinafter referred to as the &#8216;Creditor<br \/>\nBank&#8217;).\n<\/p>\n<p id=\"p_1\">2.\tOfficial<br \/>\nLiquidator has tendered a report dated 25th June 2011. In<br \/>\npara 14(A) to 14(D), Official Liquidator has requested that:\n<\/p>\n<p id=\"p_2\">&#8220;(A)\tThis<br \/>\nHon&#8217;ble Court may be pleased to direct the Official Liquidator to<br \/>\ndisurse an amount of Rs.9,51,044\/- amongst the workers of the company<br \/>\nconsidering the earlier payment of Rs.30,00,000\/- paid to the said<br \/>\nworker by the office of Official Liquidator pursuant to order dated<br \/>\n14.07.2009 passed in Company Application No.425 of 2008 by this<br \/>\nHon&#8217;ble Court as per their individual respective entitlemetns in full<br \/>\nand final payment and settlement against their admissible claim of<br \/>\nRs.39,51,044\/-.\n<\/p>\n<p id=\"p_3\">(B)\tThis<br \/>\nHon&#8217;ble Court may be pleased to direct the Official Liquidator to<br \/>\ndisburse an amount of Rs.9,58,254\/- to Gujarat Industrial Cooperative<br \/>\nBank after deducting an amount of Rs.41,746\/- towards 10 dividends<br \/>\ndeclared, paid and appropriated by said Bank for the period of 1998<br \/>\nto 2008, in full and final payment and settlement against their<br \/>\nadmissible claim of Rs.10,00,000\/- of said Bank adjudicated by the<br \/>\nChartered Accountants against the company in liquidation.\n<\/p>\n<p id=\"p_4\">(C)\tThis<br \/>\nHon&#8217;ble Court may be pleased to permit the Official Liquidator to pay<br \/>\nan amount of Rs.6,91,641\/- to GIDC being its dues towards lease rent,<br \/>\netc. for the period prior to the date of winding up order i.e. up to<br \/>\n07.12.1990.\n<\/p>\n<p id=\"p_5\">(D)\tThis<br \/>\nHon&#8217;ble Court may also be pleased to permit the Official Liquidator<br \/>\nto make payment of the professional fee bills of M\/s. Divyang P.<br \/>\nMajmudar, Chartered Accountant as per professional fee scales of<br \/>\nChartered Accountants already approved by this Hon&#8217;ble Court vide<br \/>\norders dated 28.08.2009 passed in OLR No.100 of 2009.&#8221;\n<\/p>\n<p id=\"p_6\">3.\tMs.\n<\/p>\n<p id=\"p_7\">Vinayak, learned Advocate for the applicant &#8211; Union has<br \/>\nadmitted that earlier a sum of Rs.30 lakhs has already been disbursed<br \/>\nin favour of the workmen and out of the total dues to the tune of<br \/>\nRs.39,51,044\/-, a sum of Rs.9,51,044\/- remains to be paid. By virtue<br \/>\nof para 14(A), the Official Liquidator has sought permission to<br \/>\ndisburse a sum of Rs.9,51,044\/- in favour of the workers. The names,<br \/>\nnumbers and identification of the workers are not in dispute, since a<br \/>\nsum of Rs.30 lakhs has already disbursed. Therefore, the Official<br \/>\nLiquidator is permitted to disburse further sum of Rs.9,51,044\/- as<br \/>\nper the settled ratio of the claim of each of the identified<br \/>\nworkers.\n<\/p>\n<p id=\"p_8\">4.\tThe<br \/>\nlearned counsel for the applicant &#8211; Union has admitted that the<br \/>\ntotal claim of the workers was to the tune of Rs.39,51,044\/- and<br \/>\ntherefore upon disbursement of the said sum of Rs.9,51,044\/- total<br \/>\nclaim of the applicant shall stand settled and no further claim of<br \/>\nthe applicant shall survive.\n<\/p>\n<p id=\"p_9\">5.\tSo<br \/>\nfar as the creditor bank is concerned, the Official Liquidator has<br \/>\nsought permission to disburse a sum of Rs.9,58,254\/- after deducting<br \/>\nan amount of Rs.41,746\/- towards 10 dividends declared and paid by<br \/>\nthe Bank during the period between 1998 and 2008. The permission has<br \/>\nbeen requested for on the ground that the admissible claim of the<br \/>\nsaid creditor bank is to the tune of Rs.10 lakhs.\n<\/p>\n<p id=\"p_10\">6.\tMr.\n<\/p>\n<p id=\"p_11\">Dave, learned Advocate for the Creditor Bank has disputed the said<br \/>\nassertion that the claim of the Bank is only to the tune of Rs.10<br \/>\nlakhs. According to the said Creditor Bank, its dues are to the tune<br \/>\nof Rs.30 lakhs. Mr. Dave has, however, submitted that without<br \/>\nprejudice to its claim and right to claim further amounts after<br \/>\nsubmitting proof in support thereof and keeping its rights and<br \/>\nobjections open, the Creditor Bank is ready and willing to receive<br \/>\nthe said sum of Rs.9,58,254\/-. Therefore, the permission as sought<br \/>\nfor by the Official Liquidator to disburse the said sum of<br \/>\nRs.9,58,254\/- to the Creditor Bank is hereby granted. It is clarified<br \/>\nthat it would be open to the Official Liquidator to take all<br \/>\ncontentions and objections against any claim which may be raised by<br \/>\nthe Creditor Bank beyond the aforesaid sum of Rs.10 lakhs. As and<br \/>\nwhen such claim is raised by the Creditor Bank and the objections, if<br \/>\nany, which may be filed by the Official Liquidator, the same will be<br \/>\nconsidered by the Court at the relevant time on the strength of<br \/>\navailable material which may be produced by the contesting parties.\n<\/p>\n<p id=\"p_12\">7.\tThe<br \/>\nOfficial Liquidator has further requested for permission to pay a sum<br \/>\nof Rs.6,91,641\/- to GIDC towards lease rent. The permission as sought<br \/>\nfor is granted.\n<\/p>\n<p id=\"p_13\">8.\tBesides<br \/>\nthe requests for aforesaid disbursements, the Official Liquidator has<br \/>\nalso sought permission to make payment towards the bills of<br \/>\nprofessional fees of Chartered Accountant.
