Prasad, A.P.P\n                              -----\n\n07\/23.06.2010<\/pre>\n<p id=\"p_1\">      Invoking the inherent jurisdiction of this Court under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section<br \/>\n            482<\/a> of the Code of Criminal Procedure, the petitioners have filed<br \/>\n            the present application for quashing the order dated 15.07.2005<br \/>\n            whereby, the learned court below had rejected the petitioners&#8217;<br \/>\n            prayer for their exemption from personal appearance in the case,<br \/>\n            vide C-III Case No. 342 of 1982 under <a href=\"\/doc\/1245435\/\" id=\"a_1\">Section 205<\/a> of the Code of<br \/>\n            Criminal Procedure.\n<\/p>\n<p id=\"p_1\">            2.     Heard counsel for the petitioner and counsel for the State.\n<\/p>\n<p id=\"p_2\">            3.     The case against the petitioners was registered on the basis<br \/>\n            of complaint filed by the Provident Fund Inspector alleging that in<br \/>\n            spite of several notices, the petitioners had failed to deposit the<br \/>\n            Linked Insurance Contributions of their employees for the month of<br \/>\n            November, 1980 to January, 1981. On the basis of the complaint,<br \/>\n            cognizance for the offence under <a href=\"\/doc\/437139\/\" id=\"a_2\">Section 14<\/a> of the Employees<br \/>\n            Provident Fund Act and <a href=\"\/doc\/269107\/\" id=\"a_3\">Miscellaneous Provisions Act<\/a>, 1952, was<br \/>\n            taken against the petitioners by the court below.\n<\/p>\n<p id=\"p_3\">            4.     Assailing the impugned order, learned counsel for the<br \/>\n            petitioners raises the following grounds:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                   (i)     No summon was ever served upon the petitioners<br \/>\n                           informing them of the institution of the case and of the<br \/>\n                           cognizance being taken for the offences against them.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                   (ii)    The petitioners happen to be the Directors of M\/s Aron<br \/>\n                           Chemicals (P) Ltd. living at Kolkata and they have no<br \/>\n                           knowledge whatsoever about the present case.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                   (iii)   The offence is of technical nature and the petitioners<br \/>\n                           being old persons, living at Kolkata, will face acute<br \/>\n                           hardship and physical inconvenience, if they are<br \/>\n                           compelled to appear before the trial court on each and<br \/>\n                           every date.<\/p><\/blockquote>\n<p id=\"p_4\">                   (iv)    The petitioners are respectable persons and they<br \/>\n       have genuine grounds for availing the privilege of benefits<br \/>\n      under <a href=\"\/doc\/1245435\/\" id=\"a_4\">Section 205<\/a> of the Code of Criminal Procedure. The<br \/>\n      impugned order of the learned court below is bad in law and<br \/>\n      has been passed only on the ground that the discretion<br \/>\n      under <a href=\"\/doc\/1245435\/\" id=\"a_5\">Section 205<\/a> of the Code of Criminal Procedure cannot<br \/>\n      be invoked after issuance of warrant of arrest.\n<\/p>\n<p id=\"p_5\">5.    Learned counsel for the petitioners explains that the<br \/>\nissuance of warrant of arrest against the petitioners, even without<br \/>\nreceipt of any service report of summons issued against the<br \/>\npetitioners, is in itself illegal and contrary to the provisions of<br \/>\nprocedure in law. Even otherwise, the provisions of <a href=\"\/doc\/1245435\/\" id=\"a_6\">Section 205<\/a> of<br \/>\nthe Code of Criminal Procedure do not debar the trial court to<br \/>\nexercise its discretion in appropriate cases to exempt the accused<br \/>\npersons from personal appearance. To buttress his arguments,<br \/>\nlearned counsel for the petitioners would refer to and rely upon the<br \/>\njudgments of the Patna High Court in the Case of Sumit Bose @<br \/>\nSumit Ranjan Bose and Ors. Vs. State of Bihar and Anr.<br \/>\nreported in    2002 (2) East Cri. Case 507 (Pat) and another<br \/>\njudgment of the Patna High Court in the case of D.K. Jhaver &amp;<br \/>\nOrs. Vs. State of Bihar &amp; Ors. reported in 1996 (2) East. Cri.<br \/>\nCase 399 (Pat).\n<\/p>\n<p id=\"p_6\">6.    On the other hand, counsel for the State would argue that the<br \/>\npresent application is totally misconceived and not maintainable.<br \/>\nSupporting the impugned order of the learned court below, learned<br \/>\ncounsel for the State would argue that the discretion vested in the<br \/>\ntrial court under the provisions of <a href=\"\/doc\/1245435\/\" id=\"a_7\">Section 205<\/a> of the Code of<br \/>\nCriminal Procedure could not be invoked after issuance of warrant<br \/>\nof arrest. Such discretion can be exercised only upon issuance of<br \/>\nsummons and before issuance of warrant of arrest. In support of his<br \/>\nsubmissions, learned counsel would refer to and rely upon the<br \/>\njudgment of the Kolkata High Court in the case of Ajit Kumar<br \/>\nChakraborty and ors. Vs. Serampore Municipality reported in<br \/>\n1989 Cr.L.J. 523.\n<\/p>\n<p id=\"p_7\">7.    I have heard counsel for the parties and also gone through<br \/>\nthe documents available on record, including the copies of the<br \/>\nordersheet of the records of the trial court.\n<\/p>\n<p id=\"p_8\">8.    From perusal of the ordersheet, it appears that though, after<br \/>\ntaking cognizance of the offence against the petitioners, the learned<br \/>\ncourt below had ordered for issuance of summons, but no service<br \/>\nreport of summons was ever received and even before obtaining<br \/>\n the service report, the trial court has proceeded to issue warrants of<br \/>\narrest against the petitioners.\n<\/p>\n<p id=\"p_9\">       The trial court appears to have rejected the prayer of the<br \/>\npetitioners for exemption under <a href=\"\/doc\/1245435\/\" id=\"a_8\">Section 205<\/a> of the Code of Criminal<br \/>\nProcedure only on the ground that the discretion vested under the<br \/>\nprovisions of <a href=\"\/doc\/1245435\/\" id=\"a_9\">Section 205<\/a> of the Code of Criminal Procedure cannot<br \/>\nbe invoked after issuance of warrant of arrest.\n<\/p>\n<p id=\"p_10\">9.     This view appears to be misconceived. The provisions of<br \/>\n<a href=\"\/doc\/1245435\/\" id=\"a_10\">Section 205<\/a> of the Code of Criminal Procedure do suggest that<br \/>\nwhenever a Magistrate issues summons, he may have sufficient<br \/>\nreasons so to do to dispense with the personal attendance of the<br \/>\naccused and to permit him to appear through his pleader, but the<br \/>\nprovisions do not impose any legal bar in exercise of the powers<br \/>\nunder <a href=\"\/doc\/1245435\/\" id=\"a_11\">Section 205<\/a> of the Code of Criminal Procedure, when initially<br \/>\nsummons were issued to the accused person, but was not taken<br \/>\ninto custody under the process of the execution of warrant. This<br \/>\nview has been taken after elaborate discussion of the provisions of<br \/>\n<a href=\"\/doc\/1245435\/\" id=\"a_12\">Section 205<\/a> of the Code of Criminal Procedure and reference to<br \/>\nseveral judgments, including the judgments of the Supreme Court<br \/>\nand earlier judgments of the Patna High Court and that of other<br \/>\nHigh Courts, by the learned single Judge in the case of Sumit<br \/>\nBose @ Sumit Ranjan Bose (supra).\n<\/p>\n<p id=\"p_11\">       As it appears, the issuance of warrant of arrest against the<br \/>\npetitioners, even without obtaining service report of summons,<br \/>\nearlier issued against them, is itself contrary to the provisions of the<br \/>\nprocedure in law, as rightly pointed out by the counsel for the<br \/>\npetitioners.\n<\/p>\n<p id=\"p_12\">10.    On      careful   consideration   of   the   entire   facts   and<br \/>\ncircumstances of the case, it appears that the petitioners, who are<br \/>\nthe residents of Kolkata living at a far away distance from the trial<br \/>\ncourt, situated at Ranchi, are facing the criminal prosecution, not on<br \/>\naccount of personal acts, but on account of their association with a<br \/>\ncorporate body. The circumstances do make out genuine grounds<br \/>\nfor exemption of the petitioners from personal attendance under the<br \/>\nprovisions of <a href=\"\/doc\/1245435\/\" id=\"a_13\">Section 205<\/a> of the Code of Criminal Procedure.\n<\/p>\n<p id=\"p_13\">11.    For the aforesaid reasons, this application is allowed. The<br \/>\nimpugned order of the court below is hereby set aside. The matter<br \/>\nis remitted back to the trial court to reconsider the petitioners&#8217;<br \/>\nprayer for exemption under the provisions of <a href=\"\/doc\/1245435\/\" id=\"a_14\">Section 205<\/a> of the<br \/>\nCode of Criminal Procedure and to pass an appropriate order. In<br \/>\n           the event the court exercises its discretion in favour of the<br \/>\n          petitioners, it will still be at liberty to direct the petitioners to give an<br \/>\n          undertaking to the satisfaction of the court below that they would<br \/>\n          not dispute their identity at the time         when the witnesses are<br \/>\n          examined by the prosecution in their absence and that they will<br \/>\n          appear before the court below as and when directed by the trial<br \/>\n          court.\n<\/p>\n<p id=\"p_14\">                                                                 (D.G.R.
