Middle School, Adapur\n             (boys), Adapur, East Champaran..................Respondents\n                                       --------\n<\/pre>\n<p id=\"p_1\">4   08.11.2011            Heard        learned    counsel        for      the<\/p>\n<p>                 petitioner as well as learned counsel for<\/p>\n<p>                 the State.\n<\/p>\n<p id=\"p_1\">                          Learned counsel for the petitioner<\/p>\n<p>                 confines the prayer of the petitioner in<\/p>\n<p>                 this writ application to a challenge to the<\/p>\n<p>                 order    of    the    District     Superintendent         of<\/p>\n<p>                 Education,       East    Champaran          contained     in<\/p>\n<p>                 Letter    no.1059        dated     14.05.2008,           vide<\/p>\n<p>                 Annexure-3, by which he has been directed<\/p>\n<p>                 to deposit an amount of Rs.1,48,774\/- in<\/p>\n<p>                 one instalment in the treasury, allegedly<\/p>\n<p>                 paid to him in excess of his entitlement.<\/p>\n<p id=\"p_2\">                          Learned counsel for the petitioner<\/p>\n<p>                 submits    that       petitioner      was    paid   Matric<\/p>\n<p>                 Trained       scale    under    the    orders       of   the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>District Superintendent of Education dated<\/p>\n<p>22.12.1993 in the light of some judgment of<\/p>\n<p>this Court, vide Annexure-1. He admits that<\/p>\n<p>subsequently in view of the judgment of the<\/p>\n<p>larger      Bench       of    this      Court,       physical<\/p>\n<p>Trained         Teachers      have      been       held     not<\/p>\n<p>entitled for Matric Trained scale. Hence he<\/p>\n<p>does not press this               application        for any<\/p>\n<p>direction to the respondents                   to    pay    the<\/p>\n<p>petitioner        Matric     Trained      scale.      But   he<\/p>\n<p>submits that since scale was paid to him,<\/p>\n<p>may   be    wrongly,         on   the     orders      of    the<\/p>\n<p>competent authority, in the light of the<\/p>\n<p>some judgment of this Court, excess amount<\/p>\n<p>paid to him should not be recovered.<\/p>\n<p id=\"p_3\">         A counter affidavit has been filed.<\/p>\n<p>Learned counsel for the respondents submits<\/p>\n<p>that since petitioner was not entitled for<\/p>\n<p>Matric Trained scale, the order of recovery<\/p>\n<p>has been issued directing him to deposit<\/p>\n<p>the   excess       amount     paid      to     him   in     the<\/p>\n<p>treasury.\n<\/p>\n<p id=\"p_4\">         Annexure-1 shows that the order for<\/p>\n<p>grant      of    Matric      Trained      scale      to     the<\/p>\n<p>petitioner        was     issued     by      the     District<\/p>\n<p>Superintendent of Education on the basis of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                      3<\/span><\/p>\n<p>     some   orders       of    this       Court.        As    such,<\/p>\n<p>     apparently      there       was        no      fraud       or<\/p>\n<p>     misrepresentation         on     the        part    of    the<\/p>\n<p>     petitioner in the matter.\n<\/p>\n<p id=\"p_5\">            As           such,            on            equitable<\/p>\n<p>     considerations, this Court finds that the<\/p>\n<p>     respondents     should         not     be     allowed      to<\/p>\n<p>     recover the amount paid to petitioner in<\/p>\n<p>     excess of his entitlement on the basis of<\/p>\n<p>     said   Annexure-1.          The        impugned          order<\/p>\n<p>     (Annexure-3)        is,   therefore,         quashed       and<\/p>\n<p>     respondents are restrained from recovering<\/p>\n<p>     the alleged amount paid to him pursuant to<\/p>\n<p>     the said order of District Superintendent<\/p>\n<p>     of Education as contained in Annexure-1.<\/p>\n<p id=\"p_6\">            The writ application is allowed with<\/p>\n<p>     the aforesaid observations and directions.<\/p>\n<p id=\"p_7\">                          (J.
