No. 8157-58-C-II of 2009 :\n<\/pre>\n<p id=\"p_1\">            For the reasons mentioned in the application, delay of 44 days<br \/>\nin filing the appeal and 37 days in re-filing the appeal is condoned.<br \/>\nMain Appeal :\n<\/p>\n<p id=\"p_2\">            This is appeal by owner and driver of the alleged offending<br \/>\nvehicle (Paver of Gujrat Apollo Marka-Model 1998) impugning Award<br \/>\ndated 14.08.2008 of learned Motor Accident Claims Tribunal, Ambala,<br \/>\nwhereby two claim petitions filed under <a href=\"\/doc\/136948773\/\" id=\"a_1\">Section 166<\/a> of the Motor Vehicles<br \/>\nAct, 1988 (in short &#8211; the Act) have been disposed of. One of the said<br \/>\npetitions had been instituted by Rijwan &#8211; respondent no.1 herein claiming<br \/>\ncompensation for injuries suffered by him in motor vehicular accident.\n<\/p>\n<p id=\"p_3\">            As per claimants&#8217; version, Rijwan, Mintu, Irshaad and others<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            F. A. O. No. 1559 of 2009 (O&amp;M)                2<\/span><\/p>\n<p>were travelling in jeep No.PB-10-BS-1837 being driven by Raman Kumar<br \/>\n(respondent no.2 herein) at moderate speed on left side of the road. After<br \/>\ncrossing the river Markanda in the area of Police Station Mullana, the<br \/>\noffending vehicle was seen coming from the opposite direction being driven<br \/>\nrashly and negligently by Sanjay Kumar (appellant no.2 herein). Appellant<br \/>\nno.2 turned the said vehicle suddenly towards right hand side and the<br \/>\nvehicle hit the jeep with great force.    Resultantly, the jeep was badly<br \/>\ndamaged and got broken into two portions separate from each other.<br \/>\nOccupants of the jeep suffered injuries. Irshaad succumbed to his injuries.<br \/>\nThe other claim petition was filed by his parents claiming compensation for<br \/>\nhis death.\n<\/p>\n<p id=\"p_4\">             I have heard learned counsel for the appellants and perused the<br \/>\ncase file.\n<\/p>\n<p id=\"p_5\">             Learned counsel for the appellants vehemently contended that<br \/>\nthe alleged offending vehicle is not a vehicle, but is a machine for making<br \/>\nroads. The contention cannot be accepted. <a href=\"\/doc\/946665\/\" id=\"a_1\">Section 2<\/a> (28) defines `motor<br \/>\nvehicle&#8217; or `vehicle&#8217; as under :-\n<\/p>\n<p id=\"p_6\">                           &#8220;(28)    &#8220;motor vehicle&#8221; or &#8220;vehicle&#8221; means<br \/>\n                                    any mechanically propelled vehicle<br \/>\n                                    adapted for use upon roads whether<br \/>\n                                    the power of propulsion is transmitted<br \/>\n                                    thereto from an external or internal<br \/>\n                                    source and includes a chassis to which<br \/>\n                                    body has not been attached and a<br \/>\n                                    trailer; but does not include a vehicle<br \/>\n                                    running upon fixed rails or a vehicle of<br \/>\n                                    a special type adapted for use only in a<br \/>\n                                    factory or in any other enclosed<br \/>\n                                    premises or a vehicle having less than<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          F. A. O. No. 1559 of 2009 (O&amp;M)                   3<\/span><\/p>\n<p>                                    four wheels fitted with engine capacity<br \/>\n                                    of not exceeding twenty-five cubic<br \/>\n                                    centimeters;&#8221;\n<\/p>\n<p id=\"p_7\">            In the instant case, Sanjay Kumar (appellant no.2) &#8211; driver of<br \/>\nthe offending vehicle admitted in his cross-examination that the aforesaid<br \/>\nmachine\/vehicle is fitted with four wheels, engine and steering as well and<br \/>\nhas ten gears and is running on diesel. In view of these admissions, there is<br \/>\nno room for doubt that the aforesaid vehicle falls within the definition of<br \/>\nmotor vehicle\/vehicle, as contained in <a href=\"\/doc\/946665\/\" id=\"a_2\">Section 2<\/a> (28) of the Act.\n<\/p>\n<p id=\"p_8\">            Learned counsel for the appellants next contended that the<br \/>\nclaimants failed to prove that the accident occurred due to rash and<br \/>\nnegligent driving of the aforesaid vehicle. This contention also cannot be<br \/>\naccepted.   Rijwan claimant appeared as PW-2 and the claimants also<br \/>\nexamined another eye-witness occupant of the jeep Mintu as PW-3. Both of<br \/>\nthem stated that the offending vehicle was being driven rashly and<br \/>\nnegligently by its driver and was turned towards right hand side suddenly<br \/>\nand hit the jeep with great impact. On the other hand, Sanjay Kumar<br \/>\n(appellant no.2) stated that his vehicle was stationary.       However, the<br \/>\nTribunal has believed the evidence of the claimants. The said finding is<br \/>\nbased on appreciation of evidence and cannot be said to be perverse or<br \/>\nunreasonable so as to warrant interference in appeal. Statement of Rijwan<br \/>\nclaimant is corroborated by independent witness Mintu. The contention on<br \/>\nbehalf of the appellants that the alleged offending vehicle was stationary at<br \/>\nthe time of accident cannot be accepted in view of statements of eye-<br \/>\nwitnesses Rijwan and Mintu.\n<\/p>\n<p id=\"p_9\">            Learned counsel for the appellants next contended that it was a<br \/>\ncase of contributory negligence. The contention has no merit because there<br \/>\nis neither any pleading nor any evidence to this effect. It has to be noticed<br \/>\nthat if the jeep had struck the stationary offending vehicle, the jeep would<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                           F. A. O. Moreover, both the vehicles turned<br \/>\nturtle, as observed by the Tribunal in paragraph 16 of the impugned Award.<br \/>\nIt would also show that the offending vehicle, which is a very heavy<br \/>\nvehicle, was being driven rashly and negligently and was not stationary. If<br \/>\nit had been stationary, it could not have overturned on being hit by a jeep.\n<\/p>\n<p id=\"p_10\">            Learned counsel for the appellants relying on a judgment of this<br \/>\nCourt in the case of <a href=\"\/doc\/1749294\/\" id=\"a_3\">Bhagwani Devi vs. Krishan Kumar Saini and others<\/a><br \/>\nreported as 1986 ACJ 331, contended that adverse presumption should be<br \/>\ndrawn against the claimants for not examining Raman Kumar (driver of the<br \/>\njeep) as witness. The contention is misconceived because Raman Kumar<br \/>\nwas arrayed as one of the respondents in claim petition and therefore, the<br \/>\nclaimants could not have examined Raman Kumar as their own witness. On<br \/>\nthe other hand, claimant Rijwan himself stepped into the witness box and<br \/>\nthe claimants also examined eye-witness Mintu, who was also occupant of<br \/>\nthe jeep.\n<\/p>\n<p id=\"p_11\">            In view of the aforesaid, I find no infirmity in the finding of the<br \/>\nTribunal that the accident occurred due to rash and negligent driving of the<br \/>\naforesaid offending vehicle.\n<\/p>\n<p id=\"p_12\">            For the reasons recorded herein above, I find no merit in the<br \/>\ninstant appeal, which is accordingly dismissed.\n<\/p>\n<pre id=\"pre_2\">May 01, 2009                                        ( L.
