Application is filed by one Tinaben seeking quashing of<br \/>\ncomplaint at Annexure A filed by her father  alleging, inter alia,<br \/>\noffence punishable under section 363 and 366 read with <a href=\"\/doc\/112749\/\" id=\"a_1\">section 114<\/a> of<br \/>\nthe Indian Penal Code against one Vikrambhai and others.  As stated<br \/>\nin the petition,  her case was that she was not  kidnapped by<br \/>\nVikrambhai and that she had left her parents house voluntarily.<br \/>\nAfter initially filing the quashing petition on behalf of Tinaben,<br \/>\nother accused were also joined as co-petitioners.\n<\/p>\n<p id=\"p_1\">\tCriminal<br \/>\nMisc. Application No.14437 of 2009 came to be filed by same Tinaben<br \/>\nstating, inter alia, that the allegations in the complaint are true<br \/>\nand that she had never desired to present the quashing petition.\n<\/p>\n<p id=\"p_2\">\tI<br \/>\nhad requested the learned advocates for the presence of the girl.  In<br \/>\npresence of the learned APP and in absence of others,  I had briefly<br \/>\ninterviewed her.  I find that she desires to stay with her parents.<br \/>\nHowever, the allegations made in the present  complaint  regarding<br \/>\nfiling of quashing petition without her authority is not pressed by<br \/>\nher counsel Shri A.D.Desai.\n<\/p>\n<p id=\"p_3\">\tThe<br \/>\nfact, however, remains that girl Tina does not support the quashing<br \/>\npetition.  It is, therefore, not possible to terminate the criminal<br \/>\nproceedings on her say since she has now  vitally changed her stand.<br \/>\nPrima facie, however, it appears  that she had stayed with Vikrambhai<br \/>\nfor more than a month.  Documents are  produced to show that two had<br \/>\ngot married  and she was well over 18 years of age when the incident<br \/>\ntook place.  In fact, she is stated to be about 23 years old.  I am<br \/>\nsure, the Investigating  Authority shall  bear in mind all these<br \/>\naspects while  investigating into the allegations made by the<br \/>\ncomplainant.\n<\/p>\n<p id=\"p_4\">\tIn<br \/>\nview of the above discussion, Criminal Misc. Application No.14437 of<br \/>\n2009 is disposed of as not pressed.  Criminal Misc. Application<br \/>\nNo.11244 of 2009 is disposed of subject to the above observations.<br \/>\nNotice is discharged.
