Application No.2210\/2004<br \/>\n\tfor a period of six months on the ground that the applicant is<br \/>\n\tdesirous to go for pilgrimage.\n<\/p>\n<p id=\"p_3\">\tThe<br \/>\n\tapplicant-accused is charged with having committed offences under<br \/>\n\t<a href=\"\/doc\/455468\/\" id=\"a_1\">Sections 307<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_1\">333<\/a>, <a href=\"\/doc\/1522870\/\" id=\"a_2\">224<\/a>, <a href=\"\/doc\/308927\/\" id=\"a_3\">225<\/a>, <a href=\"\/doc\/1599401\/\" id=\"a_4\">341<\/a>, <a href=\"\/doc\/1432790\/\" id=\"a_5\">188<\/a>, <a href=\"\/doc\/488479\/\" id=\"a_6\">186<\/a>, <a href=\"\/doc\/1096965\/\" id=\"a_7\">143<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_8\">147<\/a> and <a href=\"\/doc\/999134\/\" id=\"a_9\">149<\/a> of the<br \/>\n\tIndian Penal Code, under Section 135 of the Bombay Police Act and<br \/>\n\tunder <a href=\"\/doc\/126810723\/\" id=\"a_10\">Sections 3<\/a> and <a href=\"\/doc\/31388593\/\" id=\"a_11\">7<\/a> of the Damage to Public Property Act,<br \/>\n\ttherefore, the case is with regard to assault on the Police and the<br \/>\n\tcase is said to have been committed for trial.\n<\/p>\n<p id=\"p_4\">\tLearned<br \/>\n\tcounsel for the applicant-accused, Mr.M.M. Tirmizi submitted that<br \/>\n\tearlier co-accused had filed Criminal Misc. Application No.9167\/2007<br \/>\n\tin Criminal Misc. Application No.2210\/2004 and the High Court as per<br \/>\n\tthe order dated 24.08.2007 modified the conditions and permitted the<br \/>\n\tco-accused to go for pilgramage. Mr.Tirmizi, therefore, submitted<br \/>\n\tthat in order to enable the present applicant for going to<br \/>\n\tpilgrimage (Haj), conditions may be modified.\n<\/p>\n<p id=\"p_5\">\tLearned<br \/>\n\tA.P.P., Mr.A.J. Desai has produced the report made by the Police<br \/>\n\tSub-Inspector, Godhra Town Police Station and it has been confirmed<br \/>\n\tin the said report that Haj Committee has recommended the name of<br \/>\n\tthe applicant-accused and his wife for pilgrimage and the amount has<br \/>\n\talso been deposited by them. However, it has been apprehended that<br \/>\n\tsince the aforesaid case being Criminal Case No.129\/2009 has been<br \/>\n\tcommitted to the Court of Sessions and is likely to commence, the<br \/>\n\tapplicant-accused may not return back and, therefore, he should not<br \/>\n\tbe allowed to go, otherwise, it would affect the trial and his<br \/>\n\tpresence may not be secured.\n<\/p>\n<p id=\"p_6\">\tHaving<br \/>\n\tregard to the facts and circumstances and also considering the<br \/>\n\treport, it is evident that Haj Committee has recommended the name of<br \/>\n\tthe applicant and his wife for pilgrimage\/haj and, therefore, the<br \/>\n\tpassport is required to be returned back to the applicant-accused<br \/>\n\tfor a limited period.\n<\/p>\n<p id=\"p_7\">However,<br \/>\n\tas there is no clarity about the period, the present application<br \/>\n\tstands allowed partly. Condition Nos.8(d), 8(e) and 8(g) imposed as<br \/>\n\tper the order passed in Criminal Misc. Application No.2210\/2004<br \/>\n\tdated 30.04.2004 are suspended for a period of three months. The<br \/>\n\tapplicant-accused viz., Iqbal<br \/>\n\tAhmed Ishaq Aalam is permitted to leave India during<br \/>\n\tthese period of three months for a Haj pilgrimage on submitting<br \/>\n\tnecessary details to the I.O. The trial Court<br \/>\n\tis directed to hand over the passport to the applicant-accused for<br \/>\n\tnecessary preparation for such travel for Haj yatra. All the<br \/>\n\tother conditions imposed on the applicant-accused as<br \/>\n\tper the order dated 30.04.2004 passed in Criminal Misc. Application<br \/>\n\tNo.2210\/2004 shall remain unaltered.\n<\/p>\n<p id=\"p_8\">The<br \/>\n\tapplicant-accused shall report to the Trial Court as well as to the<br \/>\n\tInvestigating Agency and also surrender his passport within a week<br \/>\n\tof his return from Haj pilgrimage.\n<\/p>\n<p id=\"p_9\">Rule<br \/>\n\tis made absolute to the aforesaid extent.
