Justice K.R.UDAYABHANU\n\n Dated :14\/11\/2007\n\n O R D E R\n                        K.R.UDAYABHANU, J\n                    ---------------------------------------------\n                        Crl.R.P.No.335 of 2002\n                     ---------------------------------------------\n              Dated this the 14th day of November, 2007\n\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      The revision petitioner stands convicted for the offences<\/p>\n<p>under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a> and <a href=\"\/doc\/409589\/\" id=\"a_1\">304(A)<\/a> IPC and sentenced to undergo<\/p>\n<p>R.I. for a period of one year for the offence under <a href=\"\/doc\/409589\/\" id=\"a_2\">Section 304(A)<\/a><\/p>\n<p>IPC and to pay a fine of Rs.1,000\/- for the offence under <a href=\"\/doc\/1270101\/\" id=\"a_3\">Section<\/p>\n<p>279<\/a> IPC and in default, to undergo simple imprisonment for one<\/p>\n<p>year.\n<\/p>\n<p id=\"p_1\">      2.   The prosecution case is that on 14.6.1995 at about<\/p>\n<p>9.30 a.m. the accused drove the lorry                     bearing registration<\/p>\n<p>No.KL-8-D-5929 through Vaduthala-Attupuram public road in a<\/p>\n<p>rash and negligent manner so as to endanger human life and hit<\/p>\n<p>on a boy who succumbed to the injuries.\n<\/p>\n<p id=\"p_2\">      3.   Counsel for the revision petitioner has only sought<\/p>\n<p>four modification of the sentence pointing out that more than 12<\/p>\n<p>years have elapsed since the date of the incident and the<\/p>\n<p>commencement of the proceedings and that so far the revision<\/p>\n<p>petitioner was facing the criminal proceedings. It is also<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP335\/02                      2<\/span><\/p>\n<p>submitted that the entire family of the revision petitioner is<\/p>\n<p>depending on his earnings for their livelihood.<\/p>\n<p id=\"p_3\">     4.   In the circumstances and considering the long delay,<\/p>\n<p>the sentence imposed for the offence under <a href=\"\/doc\/409589\/\" id=\"a_4\">Section 304(A)<\/a> IPC is<\/p>\n<p>modified to imprisonment till the rising of the court and to pay a<\/p>\n<p>compensation of Rs.25,000\/- to the legal representatives of the<\/p>\n<p>deceased and in default, to undergo simple imprisonment for six<\/p>\n<p>months. He is also directed to pay a fine of Rs.1,000\/- for the<\/p>\n<p>offence under <a href=\"\/doc\/1270101\/\" id=\"a_5\">Section 279<\/a> IPC and in default, to undergo simple<\/p>\n<p>imprisonment for one month. The revision petitioner is granted<\/p>\n<p>four months&#8217; time to pay the amount of compensation and fine<\/p>\n<p>amount.
