Sri. Gangeqowda when he wee going in his\n\nbicycle to purchase some articles on 2\u20ac.Q3.2006 at\n\nV\/\/o.\n\n\n\n3 MFA No.11239\/O8\n\nabout 6.30 p.m. at Anchekoppaly, the driver of the\nTempo Traveler, bearing reg. No.KA 05 D 2?28g{o:iven\nby its driver in a rash and negligent mahher hit the\ncyclist. On account of the r3ooident,r afiahw\nGangegowda sustained Zggriefoeethiliinahries.h\nSubsequently, he succumbed to the injhgie\u00e9 in the\nhospital. He was an agfionlturistib\u00a7 orotessionr\nHe was also plucking ooco\ufb01eta in ooconet oarden and\nalso doing cane etioke ihaeineee}trt;Therefore, his\nwife [1\" claimant}, hie ehiieren feiaimant Nos.2 and\n3] preferree g tlaie oetition under Section 166 of\nthe Motor_hVehic;es,\ufb01\ufb02ot;'talaiming compensation of\n\nRs. 30330.1oo3%4d3';V-_r:\"i  'A\n\n4. tAfter_]$erviee of notice, the respondent\n\n\"&lt; entered iappearanoe&quot; and filed their statement of\n\nhV1ob\u00a7eotio\ufb01s;\u00bboontesting the claim. But, they did not\n\ndegywthe--aeoioent or the insurance coverage to the\n\n-- vehioiee involved in the accident.\n\nh5. The Tribunal framed 3 issues. In aupport\n\ni&quot;,\ufb02iof\u00a7the claim, the 13&#039; claimant was examined as P.W.1\n\nhrand an eye~witness by name Sri. Mukunda was examined\n\nas P.W.2. They produced 21 documents, which are\n\nmarked as Exs.Pl to P21. The Tribunal on\n\n\n\n4 MFA No.11239\/O8\n\nconsideration of the aforesaid oral and docueentary\nevidence on record heldr that the accident &quot;dag on\naccount of rash and negligent driving \u00a7\u00a7Wt\u00a7\u00e9i\u00e9&amp;\u00a7\u00a79F\nof the tempo traveler and thee actionable,negligencelg\n\nis established. ,A :gr&#039;: 3 ._--. nae ,i.\n6. The deceased was aged about 46 years at the\n\ntime of the accident and Q83 an&#039;agrionltnriat. it\nis the case of the elaimantS,that the deceased was\nalso plucking cocon\ufb01ta and aellieo cane sticks. In\nthe circumstances, ;t&quot;t\u00a7pk*incoee of the deceased at\nRs.3,000&quot;QQioreEi dedected lid toeards his personal\nexpenses&#039; aooiiedithax\ufb01nltiolier of &#039;E3&#039; and awarded\na sum oi @Rs\u00a73;i\u00a7;bCd%G\ufb01&quot; as compensation under the\n\nhead of loeseof~deoendency. In fact, it has awarded\n\nlV* a &#039;a\u00a7m,_0f\u00ab Rs.7d}GO\ufb01~0G towards other conventional\n\ni_heads[&quot; W Thee in all it awarded a sum of\n\nRe,\u00a7g82,0dQ~bO with interest at 6% p.a. from the\n\n&#039;xudate ~.or;_ the petition till the date of payment.\n\n&#039;ff\ufb01gerieved by the said award, the present appeal is\n\n&#039;i oreferred.\n\n7. The learned. counsel for the appellants\nassailing the impugned Judgment and Award contended\n\nthat the deceased was carrying on business of\n\nh\/.\n\n\n\n5 MFA No.11239\/O8\n\nselling cane sticks and he was also plucking\ncoconuts from the trees. Therefore, the irihnnal\n\ncommitted an error in taking only Rs.3gG0O\u00a7QQ gone\n\nas the monthly income of the deceased and therefore; k\n\nshe submits that a case for esha\u00a7\u00a2\u00a2m\u00a7ng[;gima\u00a7\u00a7\u00bb9\u00a7\u00a2.\n\n8. From the aforesaid nateriak it is clear\nthat the deceased was    was an\nagriculturist and v\u00e9oingi gi\ufb01kging of ecoconuts and\nselling cane sticks after ss\ufb01aiging license from the\nForest Department, ehieh is not a regular business.\n\nIn fact, no dec\ufb01menteiydejidence produced to show as\n\nto the income ideri\u00e9ed _from the selling of cane\nsticksos Except the essertion of P.W.1, there is no\n\nevidence in this*regerd. Under these circumstances,\n\n~w_the Tribune} is j\ufb01stified in taking the income of\n\ni1itne&quot;gdeceasedn at Rs.3,000~0O p.m., applying the\n\neuitiplierh\ufb01of &#039;l3&#039;, deducting 1\/3 towards the\n\ninhpersonai expenses of the deceased and awarding the\n\njvoompensation. In fact, it is very liberal in\n\ndranting a sum of Rs.?0,0GO~00 towards other\n\nWoonventional heads.
