Justice P.R.RAMAN\n\n Dated :19\/12\/2006\n\n O R D E R\n                               P.R.RAMAN, J.\n\n                        ```````````````````````````\n\n                      W.P.(C) NO. 22944 OF 2006\n\n                        ```````````````````````````\n\n           Dated this the 19th day of December, 2006\n\n\n                              J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The limited prayer is for a direction to respondents 1 and 2<\/p>\n<p>to   consider   the   grant   of   permit   as   per   Exhibit   P1   application.<\/p>\n<p>Earlier  by  Exhibit  P3,  the  same  was  rejected  on the ground   that<\/p>\n<p>permit will violate the notified route. The said view was confirmed<\/p>\n<p>in Exhibit  P4.   Exhibit P5 is  only a proposal calling  for objection.<\/p>\n<p>Petitioner has not produced any final notification pursuant to the<\/p>\n<p>proposal   Exhibit   P5.     Hence   his   contention   based   on   Exhibit   P5<\/p>\n<p>that overlapping upto 10 Kms is permissible as is clear from the<\/p>\n<p>remark   contained,   against   Column   19   of   Exhibit   P5   at   present<\/p>\n<p>cannot   be   looked   into.   Further,   if   any   subsequent   notification   is<\/p>\n<p>issued permitting overlapping of 10 Kms. or 10% as the case may<\/p>\n<p>be and if the petitioner files a fresh application, the same shall be<\/p>\n<p>considered   in   accordance   with   law   untramelled   by   the   fact   that<\/p>\n<p>his earlier application was rejected.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      Writ petition is disposed of as above.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                                                        P.R.RAMAN, JUDGE<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.
