Respondents\n\nPrayer\n\nPetition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India praying\nfor the issuance of a Writ of Certiorarified Mandamus, calling the entire\nrecords pertaining to M.M.No.21202\/10\/A1, dated 23.08.2010 from the file of the\nfirst respondent and quash the same and direct the first respondent to issue\nlegal heir certificate that the petitioner is the legal heir of the deceased\nhusband Abdul Latheef within a time frame fixed by this Hon'ble Court.\n\n!For petitioner\t\t... M\/s.N.Murugesan\n^For respondent 1\t... Mr.R.Manoharan\n \t \t            Government Advocate\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">  \tThis writ petition has been filed challenging the order of the first<br \/>\nrespondent, dated 23.08.2010, and to direct the first respondent to issue a<br \/>\nLegal Heir Certificate to the petitioner stating that she is the wife of the<br \/>\ndeceased Abdul Latheef.\n<\/p>\n<p id=\"p_1\">\t2. Mr.R.Manoharan, the learned Government Advocate takes notice for the<br \/>\nfirst respondent.\n<\/p>\n<p id=\"p_2\">\t3. The learned counsel appearing on behalf of the petitioner had submitted<br \/>\nthat the first respondent, by the impugned order, dated 23.08.2010, had directed<br \/>\nthe petitioner to approach the Civil Court to obtain the relief sought for by<br \/>\nher, as the claim of the petitioner could only be decided based on oral, as well<br \/>\nas documentary evidence, as it involved complicated questions of fact and law.\n<\/p>\n<p id=\"p_3\">\t4.  In such circumstances, this Court does not find sufficient cause or<br \/>\nreason to grant the relief, as prayed for by the petitioner, in the present writ<br \/>\npetition. Hence, the writ petition stands dismissed.  However, it is made clear<br \/>\nthat it would be open to the petitioner to initiate legal proceedings before the<br \/>\nappropriate forum, if so advised, in the manner known to law.
