Justice K.T.SANKARAN\n\n Dated :15\/09\/2009\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                       B.A. NO. 3969 OF 2009\n              ------------------------------------------------------\n               Dated this the 15th September, 2009\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">       Accused No.3, A.Aboobacker, in Crime No.273 of 2009 of<\/p>\n<p>Perinthalmanna Police Station, has filed this application for anticipatory<\/p>\n<p>bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal Procedure.<\/p>\n<p id=\"p_1\">       2.   The offences alleged against the petitioner and the other<\/p>\n<p>accused are under <a href=\"\/doc\/647828\/\" id=\"a_1\">Sections 307<\/a> and <a href=\"\/doc\/445276\/\" id=\"a_2\">506(ii)<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_3\">Section 34<\/a> of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">       3. On 9.4.2009 at about 11.15 AM, one Asif Ali sustained injuries<\/p>\n<p>due to stabbing. The incident occurred at Mattarakal Bazaar. At 1 PM on<\/p>\n<p>that day, the First Information Statement of one Biju was recorded. In the<\/p>\n<p>First Information Statement, it was alleged that the first accused, namely,<\/p>\n<p>Jafar @ Pathiri Jafar, stabbed Asif Ali. Asif Ali tried to escape. Even<\/p>\n<p>thereafter, he was chased by Jafar and another person and he was again<\/p>\n<p>stabbed.    Asif Ali sustained serious injuries and he was taken to the<\/p>\n<p>hospital.   The petitioner is not shown as an accused in the First<\/p>\n<p>Information Statement.      During investigation, it was revealed that the<\/p>\n<p>incident occurred and the offence was committed as directed and at the<\/p>\n<p>instance of the petitioner.     According to the prosecution, the accused<\/p>\n<p>B.A. NO.3969 OF 2009<\/p>\n<p>                                      :: 2 ::\n<\/p>\n<p id=\"p_4\">persons conspired together and attacked Asif Ali.        Asif Ali was an<\/p>\n<p>accused in a case in which the petitioner was the de facto complainant.<\/p>\n<p>Asif Ali was granted anticipatory bail.       It was during that period,<\/p>\n<p>according to the prosecution, Asif Ali was attacked by the accused<\/p>\n<p>persons.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">       4.   The petitioner claims that he is engaged in cultural and<\/p>\n<p>charitable activities. He has founded a charitable trust under the name<\/p>\n<p>and style &#8220;Deshasnehi&#8221; at Perinthalmanna. It is stated that the Trust was<\/p>\n<p>registered in the year 2005. The petitioner is the Chairman of the Trust.<\/p>\n<p>The petitioner was fighting against the liquor lobbies. He even filed a<\/p>\n<p>Writ Petition before the High Court to see that a toddy shop is shifted<\/p>\n<p>from a place. According to him, his cultural and social activities were not<\/p>\n<p>to the liking of several persons and there was an attempt to malign him<\/p>\n<p>among the general public.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       5. According to the prosecution, there arose lot of complaints<\/p>\n<p>against the activities of the petitioner. In the name of the Trust, the<\/p>\n<p>petitioner was indulging in unlawful activities. Mass petitions were being<\/p>\n<p>filed by the local public against the activities of the petitioner. Asif Ali<\/p>\n<p>had a quarrel with the petitioner. The petitioner was infuriated by the<\/p>\n<p>acts of Asif Ali. The conspiracy was hatched in these circumstances.<\/p>\n<p>B.A. NO.3969 OF 2009<\/p>\n<p>                                        :: 3 ::\n<\/p>\n<p id=\"p_9\">       6. In the First Information Statement itself, there is mention of the<\/p>\n<p>acts of Asif Ali against the petitioner. It is stated in the First Information<\/p>\n<p>Statement that the first accused proclaimed after stabbing Asif Ali that<\/p>\n<p>the same fate would occur to all who dare to touch Backer. According to<\/p>\n<p>the prosecution, Backer is the petitioner.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">       7. The injuries sustained by Asif Ali are grievous. Stab injuries<\/p>\n<p>were inflicted on him. He was in the hospital for several days. Learned<\/p>\n<p>Public Prosecutor submitted that if anticipatory bail is granted to the<\/p>\n<p>petitioner, it would seriously affect the progress of the investigation of the<\/p>\n<p>case.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">       8.
