M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tWe<br \/>\nhave heard Mr Mayank Desai holding brief of Mr Nilesh M Shah, learned<br \/>\ncounsel for the appellant.\n<\/p>\n<p id=\"p_2\">2.\t\tThe<br \/>\nappellant was working with the respondent Bank till he superannuated<br \/>\non 1st May, 1998 after a tenure of more than two decades.  However,<br \/>\nhis retiral dues were withheld by the respondent Bank. Since the<br \/>\nleave encashment for 279 days was not granted to the appellant, he<br \/>\nhad preferred Recovery Application before the Labour Court, Vadodara<br \/>\nunder <a href=\"\/doc\/1774629\/\" id=\"a_1\">section 33(c)(2)<\/a> of the Industrial Disputes Act (hereinafter<br \/>\nreferred to as &#8220;the Act&#8221;). The Labour Court, by order dated<br \/>\n16.3.2009 passed in Recovery Application No.458 of 1999, rejected the<br \/>\napplication of the appellant on the ground that it had  no<br \/>\njurisdiction to declare that the appellant was a &#8216;workman&#8217; and he was<br \/>\nentitled for the amount as claimed by him  for his pre-existing right<br \/>\nof leave encashment.  The appellant  challenged the order of the<br \/>\nLabour Court before the learned Single Judge by means of Special<br \/>\nCivil Application No.7359 of 2009.  The learned Single Judge affirmed<br \/>\nthe findings of the Labour Court on the application filed by the<br \/>\nappellant under <a href=\"\/doc\/1774629\/\" id=\"a_1\">section 33(c)(2)<\/a> of<br \/>\nthe Industrial Disputes Act as not maintainable before it.\n<\/p>\n<p id=\"p_3\">3.\tIt<br \/>\nis well settled that it is not open to the Labour Court to decide the<br \/>\nquestion as to whether an employee is a &#8216;workman&#8217; or not in a<br \/>\nproceeding under <a href=\"\/doc\/1774629\/\" id=\"a_2\">section 33(c)(2)<\/a> of the Act and such an adjudication<br \/>\ncan only be made in a proceeding under <a href=\"\/doc\/1669932\/\" id=\"a_3\">section 10<\/a> of the Act.\n<\/p>\n<p id=\"p_4\">4.\tIn<br \/>\nview of the aforesaid reasons, we are in complete agreement with the<br \/>\nview taken by the learned Single Judge.
