Justice P.N.RAVINDRAN\n\n Dated :06\/04\/2009\n\n O R D E R\n                          P.N.RAVINDRAN, J.\n                  -----------------------------\n                    W.P(C) No. 23421 of 2008-L\n                 ------------------------------\n                Dated this the 6th day of April, 2009.\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Heard Sri.V.N.Achuthakurup, the learned Senior Advocate<\/p>\n<p>appearing for the petitioner and Sri.M.P.Prakash, the learned Special<\/p>\n<p>Government Pleader appearing for the respondents.<\/p>\n<p id=\"p_1\">      2.    The petitioner retired from service on 31.8.2007 on<\/p>\n<p>attaining the age of superannuation. The grievance voiced by the<\/p>\n<p>petitioner in this writ petition is that though more than 19 months<\/p>\n<p>have passed after his retirement, the retirement benefits have not<\/p>\n<p>so far been sanctioned or disbursed.\n<\/p>\n<p id=\"p_2\">      3.    The petitioner contends that the retirement benefits due<\/p>\n<p>to him have not been disbursed for the reason that the disciplinary<\/p>\n<p>proceedings initiated against him as per Ext.P2 memo of charges<\/p>\n<p>have not been finalised. The respondents have filed a counter<\/p>\n<p>affidavit contending that the disciplinary proceedings initiated<\/p>\n<p>against the petitioner as per Ext.P2 memo of charges are still<\/p>\n<p>pending. Sri.M.P.Prakash, the learned Special Government Pleader<\/p>\n<p>submits on instructions that the disciplinary proceedings initiated<\/p>\n<p>against the petitioner as per Ext.P2 memo of charges will be<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C) No. 23421 of 2008-L          2<\/span><\/p>\n<p>finalised on or before 30.4.2009. The learned Government Pleader<\/p>\n<p>also submits that in respect of the charges set out in Ext.P4 the<\/p>\n<p>report of enquiry has been received and the Chief Conservator of<\/p>\n<p>Forests will finalise the proceedings expeditiously.    The learned<\/p>\n<p>Government Pleader also submitted that a vigilance enquiry against<\/p>\n<p>the petitioner was also conducted in respect of an act of misconduct<\/p>\n<p>and that the file is presently with the Government.<\/p>\n<p id=\"p_3\">       4.    Nearly 19 months have passed after the petitioner retired<\/p>\n<p>from service. In my opinion, the competent authority among the<\/p>\n<p>respondents has to take a decision in the various disciplinary<\/p>\n<p>proceedings pending against the petitioner.         In view of the<\/p>\n<p>submission made by the learned Government Pleader that final<\/p>\n<p>orders in respect of Ext.P2 memo of charges will be passed on or<\/p>\n<p>before 30.4.2009 and in respect of Ext.P4 memo of charges<\/p>\n<p>expeditiously, I dispose of this writ petition with the following<\/p>\n<p>directions:\n<\/p>\n<p id=\"p_4\">       i)    The competent authority among the respondents shall<\/p>\n<p>pass final orders in respect of disciplinary proceedings initiated<\/p>\n<p>against the petitioner as per Ext.P2 memo of charges on or before<\/p>\n<p>30.4.2009.\n<\/p>\n<p id=\"p_5\"><span class=\"hidden_text\" id=\"span_1\">W.P(C) No. 23421 of 2008-L          3<\/span><\/p>\n<p id=\"p_6\">       ii)   Final orders in relation to Ext.P4 memo of charges shall<\/p>\n<p>be passed within three months from today after affording the<\/p>\n<p>petitioner a opportunity of being heard.\n<\/p>\n<p id=\"p_7\">       iii)  The Government shall within a period of three months<\/p>\n<p>from today decide whether the vigilance enquiry against the<\/p>\n<p>petitioner should be proceeded with and whether there are<\/p>\n<p>adequate grounds to proceed against him.\n<\/p>\n<p id=\"p_8\">       I make it clear that I have not expressed any opinion on the<\/p>\n<p>merits of the petitioner&#8217;s contentions and that if the petitioner is<\/p>\n<p>aggrieved by the orders to be passed by the Government\/other<\/p>\n<p>competent authority, it will be open to him to challenge the same in<\/p>\n<p>other appropriate proceedings.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                         Sd\/-\n<\/p>\n<p id=\"p_11\">                                    P.N.RAVINDRAN<br \/>\n                                          JUDGE<\/p>\n<p>                          \/\/True Copy\/\/<\/p>\n<p>                                          PA to Judge<br \/>\nab<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">W.P(C) No. 23421 of 2008-L    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.K.Sivan vs State Of Kerala on 6 April, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 23421 of 2008(L) 1.
