Heard learned counsels.\n\n\n\n2.             By the impugned order Annex.R2\/1 dated 8.7.2009, the\n\nrespondent Bharat Petroleum Corporation Ltd. (for short 'BPCL')\n\nrejected the application of the petitioner for LPG Gas Distributorship\n\non three grounds:-\n\n\n\n               (i) That the petitioner failed to maintain the minimum\n\n               balance of Rs.10 lacs in her Saving Bank.\n\n               (ii) That the requisite land in question was not owned\n\n               and possessed by the petitioner; and\n\n               (iii) There is variance in the income affidavit submitted\n\n               with the application and finding at the field investigation.\n\n\n\n3.             The learned counsel for the petitioner submits that the\n\npetitioner had applied for the same distributorship in the category of\n\nPara-Military Forces (PMF) as her husband was awarded gallantry\n CW-5948\/2009-Smt. Vinod Kanwar Vs. The Union of India &amp; Ors.   Judgment dt.13.4.2010\n\n                                         2\/3\n\n\naward \"Shourya Chakra\" by the President of India. He, therefore,\n\nsubmitted that the grounds taken by the respondent company are not\n\ngood enough for rejecting the application as the temporary\n\nwithdrawal from the saving bank account does not mean that she did\n\nnot have sufficient financial resources and secondly one bigha land\n\nwas purchased by the petitioner and agreement to sale was also in\n\nfavour of her minor children and, therefore, it is also not a good\n\nground.\n\n\n\n4.             On the other hand, Mr. Vijay Bishnoi, learned counsel\n\nfor the respondent Company submits that it is for the respondent-\n\ncompany to consider the application of similarly situated persons in\n\nthis category objectively and since the particulars given in the\n\napplication were found to be incorrect by the applicant as the\n\nagreement to sale even if assumed to be in favour of the applicant do\n\nnot confer any ownership rights on the petitioner and since in this\n\nmanner the petitioner did not have any title for the land in question\n\nrequisite for setting up of the said distributorship establishment, she\n\ncould not be considered for the same. Even the temporary withdrawal\n\nfrom her Bank account of Rs.1 lacs on 4.12.2007 as stated in the\n\nimpugned order dis-entitled her from such consideration.\n\n\n\n5.             Having heard learned counsels, this court is of the view\n\nthat findings arrived at in the impugned order are sufficient and\n CW-5948\/2009-Smt. Vinod Kanwar Vs. The Union of India &amp; Ors.   Judgment dt.13.4.2010\n\n                                         3\/3\n\n\nreasonable ground for rejection of the said application of the\n\npetitioner. If in the opinion of this respondent Corporation BPCL if\n\nthe applicant did not fulfill the conditions as stipulated in the\n\nadvertisement on the date of application to the satisfaction of the\n\nrespondent Corporation, they cannot be faulted in rejecting the\n\napplication of the petitioner. It is true that with mere agreement to\n\nsale in her possession, the petitioner cannot be said to be possessing\n\nthe title over the land in question. Even if subsequent purchase of\n\none bigha of land by the petitioner is assumed to be correct, the same\n\ncannot be taken as sufficient compliance of the requirement of\n\nadvertisement.      Therefore, the impugned order of the respondent-\n\nCorporation cannot be assailed successfully under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the\n\nConstitution of India.\n\n\n\n6.             The writ petition is found to be devoid of merit. The\n\nsame is accordingly dismissed.\n\n                                                [ DR.
