It was<br \/>\nthe case of the prosecution before the Court that the original<br \/>\ncomplainant Food Inspector in discharge of his duties as such, on<br \/>\n22.4.2003 at about 9:30 hrs. visited the premises of the accused No.1<br \/>\nalong with his helper. The owner was present in the shop. The panch<br \/>\nwitnesses were summoned. The Food Inspector collected the pouches of<br \/>\npasteurized whole milk of  Ankita Brand. Two pouches were collected<br \/>\non payment of Rs.8.50 ps. The pouches contained label of Ankita<br \/>\npasteurized whole milk of 500 ml. maximum price Rs.8.50 ps. inclusive<br \/>\nof all taxes and marked as Ankita Dugdhalaya, Vijapur, packed by<br \/>\nRatna Dairy, Vijapur. Food Inspector purchased 750 ml. pasteurized<br \/>\nwhole milk for examination by the Public Analyst after adding<br \/>\npreservative formalin, divided it into 3 parts and thereafter added<br \/>\nformalin preservative and sealed the bottles as per the law. One of<br \/>\nthe samples was sent to Public Analyst, who concluded to be not in<br \/>\nconformity with the standards laid down by law and the prosecution<br \/>\nwas lead. Necessary sanction was obtained from the competent<br \/>\nauthority.  The Court has come to the conclusion that there was<br \/>\nnon-compliance of Rule 14 of the Prevention of Food Adulteration<br \/>\nRules,1954 with regard to vessels which were used for collecting the<br \/>\nsample. There was also no evidence with regard to notice under<br \/>\n<a href=\"\/doc\/56546430\/\" id=\"a_4\">Section 13(2)<\/a> being served upon the accused. The Court also held that<br \/>\nthe methodology employed for examining the sample by Public Analyst<br \/>\nbeing Gurber  was not certified proper test and formalin preservative<br \/>\nwhich was added was not added before the sample was divided into<br \/>\nthree parts. The brand contained name of Ankita Dugdhalaya  who had<br \/>\nnot been joined as party and ultimately on theses grounds the<br \/>\nacquittal came to be ordered which is impugned in this appeal.\n<\/p>\n<p id=\"p_2\">3.\tShri<br \/>\nNanavaty, learned Additional Public Prosecutor submitted that the<br \/>\nCourt has pressed into service many grounds for acquitting the<br \/>\naccused but many of them are not sustainable. However, Shri Nanavaty<br \/>\ncould not controvert indicating anything contrary to the record so<br \/>\nfar as reasoning with regard to evidence in respect of non-compliance<br \/>\nof Rule 14 of the Prevention of Food Adulteration Rules, 1955 is<br \/>\nconcerned as well as with regard to notice under <a href=\"\/doc\/56546430\/\" id=\"a_5\">Section 13(2)<\/a> and<br \/>\nGurber Test.\n<\/p>\n<p id=\"p_3\">4.\tShri<br \/>\nModi relied upon the decision of this Court in the case of<br \/>\nCorporation of the City of Nagpur vs. Neetam Manikrao Kature and<br \/>\nothers reported in 1998 Supreme Court Cases(Cri.) 564; in the<br \/>\ndecision of this Court (Coram: S. R. Brahmbhatt, J. ) in the case of<br \/>\nG.K. Upadhayay vs. Kanubhai Raimalbhai Rabari decided on 14.2.2007 in<br \/>\nCriminal Miscellaneous Application No. 3572 of 2006 and in the<br \/>\ndecision of this Court (Coram: R.S. Garg, J.) in the case of K. G.<br \/>\nPatel, Food Inspector vs. Navinchandra Bhagvandas Lapsiwala and<br \/>\nothers decided on 11.4.2007 in Criminal Miscellaneous Application<br \/>\nNo.10843 of 2006; in respect of  Gurber test and its vulnerability<br \/>\nand on that count justified the order of the trial Court.\n<\/p>\n<p id=\"p_4\">\tShri<br \/>\nModi relied upon the decision of this Court (Coram: D.N.Patel, J.) in<br \/>\nthe case of <a href=\"\/doc\/139356\/\" id=\"a_6\">State of Gujarat vs. Kaushikbhai Ambalal Patel<\/a> decided on<br \/>\n20.12.2004 in Criminal Appeal No.489 of 2002 and in the case of <a href=\"\/doc\/1616430\/\" id=\"a_7\">State<br \/>\nof U.P. vs. Badri<\/a> reported in 1998(2) Prevention of Food Adulteration<br \/>\nCases 18 and submitted that the preposition of law with regard to<br \/>\naddition of formalin preservative in milk sample is also rightly<br \/>\nappreciated as in the cases cited hereinabove. The Court has come to<br \/>\nthe conclusion that the formalin preservative is to be added in the<br \/>\nmilk before it is to be divided into three parts whereas, in the<br \/>\ninstant case, the milk was first divided in three parts and,<br \/>\nthereafter formalin preservative is added. This evidence is on<br \/>\nrecord.\n<\/p>\n<p id=\"p_5\">5.\tThis<br \/>\nCourt has heard the learned advocates for the parties and perused the<br \/>\nfindings of the court below.\n<\/p>\n<p id=\"p_6\">6.\tThis<br \/>\nCourt is of the view that the acquittal appeal is required to be<br \/>\nrejected for the following reasons:-\n<\/p>\n<p id=\"p_7\">1)\tCourt<br \/>\nhas rightly held that Rule 14 of the Prevent of Food Adulteration<br \/>\nRules, 1955 had not been complied with as there was no positive<br \/>\nevidence placed on record with regard to employment of the vessels<br \/>\nand  its cleaning which is mandatory requirement of Rule 14 of the<br \/>\nPrevention of Food Adulteration Rules, 1955. So far as service of<br \/>\nnotice upon the accused is concerned, the Court has clearly recorded<br \/>\nthat the notice cannot be said to have been served with proper<br \/>\nevidence as of postal acknowledgment containing signature of one Shri<br \/>\nJayantibhai who is in no way linked with the accused.\n<\/p>\n<p id=\"p_8\">7.\tThis<br \/>\nbrings the Court to the third submission with regard to test adopted<br \/>\nby the Public Analyst for examining the milk sample i.e Gurber test.<br \/>\nThe evidence has come on record that the test employed was not<br \/>\nfoolproof, satisfactory or approved test, which clearly cannot be<br \/>\nsaid to be in any way perverse.  The<br \/>\norder impugned, therefore, is required to be sustained. Appeal is<br \/>\nrequired to be dismissed and the same is  dismissed.
