(Oral)\n<\/pre>\n<p id=\"p_1\">            By this order, I propose to dispose of two writ petitions i.e.<\/p>\n<p>C.W.P.No.3322 of 1989 <a href=\"\/doc\/1299108\/\" id=\"a_1\">Punjab State Civil Supplies Corporation vs.<\/p>\n<p>Presiding Officer, Labour<\/a> Court and another and C.W.P.No.8917 of<\/p>\n<p>1989 Makhan Singh vs. The Presiding Officer, Labour Court, Bathinda<\/p>\n<p>and another, wherein challenge has been made to the award dated 3.5.1988<\/p>\n<p>(Annexure P-1) passed by the Labour Court, Bathinda.<\/p>\n<p id=\"p_1\">            Both the parties, the management as well as the workman, are<\/p>\n<p>aggrieved of the said award and have approached this Court for decision<\/p>\n<p>thereon.\n<\/p>\n<p id=\"p_2\">            The facts are not in dispute in the present case.   The workman<\/p>\n<p>was appointed by the Management and he continued in service until his<\/p>\n<p>services were terminated with effect from 2.7.1982. He contends that<\/p>\n<p>his services were terminated without notice, charge-sheet, enquiry or<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> C.W.P.No.3322 of 1989                                          -2-<\/span><\/p>\n<p>compensation, which fact has not been disputed by the Management but the<\/p>\n<p>stand taken therein is that he was appointed on 89 days basis and was given<\/p>\n<p>extensions time and again till the date of his termination which according to<\/p>\n<p>them was in accordance with his contract as the period of his appointment<\/p>\n<p>had come to an end.\n<\/p>\n<p id=\"p_3\">             Counsel for the petitioner in C.W.P.No.3322 of 1989 preferred<\/p>\n<p>by the Management, contends that since the        period of the workman&#8217;s<\/p>\n<p>appointment had expired he had no right to continue on the said post. He<\/p>\n<p>contends that the claim of the workman would be covered against him as the<\/p>\n<p>same would fall under Section 2 (oo) clause (bb) of the <a href=\"\/doc\/500379\/\" id=\"a_1\">Industrial Disputes<\/p>\n<p>Act<\/a>, 1947 (hereinafter referred to as the &#8216;Act&#8217;). He contends that since that<\/p>\n<p>would be the position as far as his termination is concerned, the provisions<\/p>\n<p>of <a href=\"\/doc\/1056316\/\" id=\"a_2\">Section 25-F<\/a> of the Act would not be applicable and therefore, the award<\/p>\n<p>cannot be sustained for the reason that although the workman would have<\/p>\n<p>served with the Management for more than 240 days yet he would not be<\/p>\n<p>entitled to the benefit under the Act which would have accrued to him<\/p>\n<p>under <a href=\"\/doc\/1056316\/\" id=\"a_3\">Section 25-F<\/a> of the Act.\n<\/p>\n<p id=\"p_4\">             On the other hand, counsel for the workman has contended that<\/p>\n<p>the termination of the workman was with effect from 2.7.1982 whereas<\/p>\n<p>clause (bb) to <a href=\"\/doc\/1418464\/\" id=\"a_4\">Section 2(oo)<\/a> of the Act came into effect from August, 1984.<\/p>\n<p>The day on which the termination of the workman had come into existence<\/p>\n<p>the provisions relied upon by the counsel for the petitioner were not on the<\/p>\n<p>statute book and, therefore, the same cannot be enforced qua the workman<\/p>\n<p>in the present case.\n<\/p>\n<p id=\"p_5\">             In the    light of   this factual position which cannot be<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> C.W.P.No.3322 of 1989                                          -3-<\/span><\/p>\n<p>controverted, the submission of the counsel for the petitioner cannot be<\/p>\n<p>accepted and is hereby rejected.\n<\/p>\n<p id=\"p_6\">            Counsel for the workman has vehemently argued that since the<\/p>\n<p>termination of the workman has been held to be in violation of <a href=\"\/doc\/1056316\/\" id=\"a_5\">Section 25-F<\/a><\/p>\n<p>of the Act, he,    apart from reinstatement with continuity of service is<\/p>\n<p>entitled to back-wages as well.\n<\/p>\n<p id=\"p_7\">            A perusal of the record would show that there was a delay on<\/p>\n<p>the part of the workman in approaching the Competent Authority with the<\/p>\n<p>demand notice. Further in view of the peculiar facts and circumstances of<\/p>\n<p>the present case, I am of the opinion that the order passed by the Labour<\/p>\n<p>Court with regard to back-wages is also quite justified and reasonable.<\/p>\n<p>Since there is no illegality in the award impugned herein, I do not intend to<\/p>\n<p>interfere in the said award and therefore, both the writ petitions deserve to<\/p>\n<p>be dismissed.
