Ghulam Ghouse and Anr.\t\t\t\t\n\nDATE OF JUDGMENT: 09\/01\/2004\n\nBENCH:\nDORAISWAMY RAJU &amp; ARIJIT PASAYAT\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">J U D G M E N T<br \/>\n(Arising out of SLP(Crl.)No. 2914 of 2003)<\/p>\n<p>ARIJIT PASAYAT,J<\/p>\n<p>\tLeave granted.\n<\/p>\n<p id=\"p_1\">The interim order passed by a Division Bench of the<br \/>\nBombay High Court is under challenge by the Union of India<br \/>\nand the Special Director, Enforcement Directorate, Ministry<br \/>\nof Finance, Govt. of India. Respondent No.1 filed a writ<br \/>\npetition before the Bombay High Court questioning legality<br \/>\nof the show cause notice no.T-4\/144\/SDE\/(AKB)\/B\/2002 dated<br \/>\n31st May, 2002 issued by the appellant No.1 and prayed<br \/>\nthat the same may be quashed and set aside, for allegedly<br \/>\nbeing illegal, null and void.  A prayer for interim relief<br \/>\nwas made to the effect that pending hearing and final<br \/>\ndisposal of the writ petition, the Court be pleased to pass<br \/>\nan order of injunction restraining the respondents i.e.<br \/>\npresent appellants before this Court and the State of<br \/>\nMaharashtra (respondent No.3 in the present appeal) and\/or<br \/>\nhis subordinates or any other officer acting on his behalf<br \/>\nfrom initiating any proceeding pursuant to the show cause<br \/>\nnotice referred to above, as issued by the present<br \/>\nappellants. The High Court passed the following order on<br \/>\n11.9.2002:\n<\/p>\n<p id=\"p_2\">&#8220;Rule. Status quo&#8221;.\n<\/p>\n<p id=\"p_3\">According to the appellants the writ petition is<br \/>\nthoroughly misconceived as it challenges a show cause notice<br \/>\nand in any event the final relief as sought for by<br \/>\nrespondent No.1-writ petitioner in relation to the show<br \/>\ncause notice should not have been granted by an interim<br \/>\norder of the nature passed by withholding any further action<br \/>\nin this regard . It was pointed out that respondent No.1 is<br \/>\nresponsible for financial irregularities involving nearly<br \/>\nRupees 270 crores and documents have been forged, accounts<br \/>\nhave been manipulated; and in any event respondent No.1 was<br \/>\nfree to canvass all the points that were taken in the writ<br \/>\npetition before the authority issuing the notice. Instead of<br \/>\ndoing that he rushed to the High Court and unfortunately the<br \/>\nHigh Court not only entertained the writ application but<br \/>\nalso granted interim relief which was in effect allowing the<br \/>\nwrit petition even before it was heard on merits. The final<br \/>\nrelief sought for itself, in substance, was granted by the<br \/>\ninterim order. There was clear violation of the provisions<br \/>\nof <a href=\"\/doc\/27905\/\" id=\"a_1\">Foreign Exchange Regulation Act<\/a>, 1973 (in short the<br \/>\n&#8216;FERA&#8217;) and <a href=\"\/doc\/600757\/\" id=\"a_1\">Foreign Exchange Management Act<\/a>, 1999 (in short<br \/>\nthe &#8216;FEMA&#8217;). The Enforcement Directorate has clearly<br \/>\nindicated in the notice the various infractions which led to<br \/>\nsuch large scale illegal transactions of more than Rupees<br \/>\n270 crores. Respondent No.1 (writ petitioner) was clearly<br \/>\nguilty of various provisions of FERA and FEMA. The High<br \/>\nCourt should have thrown out the writ petition at the<br \/>\nthreshold.\n<\/p>\n<p id=\"p_4\">Per contra, learned counsel for respondent No.1<br \/>\nsubmitted that the show cause notice is clearly unfounded in<br \/>\nlaw, cannot stand the test of legal scrutiny and the High<br \/>\nCourt was justified not only in entertaining writ petition<br \/>\nbut also in granting the interim protection.\n<\/p>\n<p id=\"p_5\">This Court in a large number of cases has deprecated<br \/>\nthe practice of the High Courts entertaining writ petitions<br \/>\nquestioning legality of the show cause notices stalling<br \/>\nenquiries as proposed and retarding investigative process to<br \/>\nfind actual facts with the participation and in the presence<br \/>\nof the parties. Unless, the High Court is satisfied that the<br \/>\nshow cause notice was totally non est in the eye of law for<br \/>\nabsolute want of jurisdiction of the authority to even<br \/>\ninvestigate into facts, writ petitions should not be<br \/>\nentertained for the mere asking and as a matter of routine,<br \/>\nand the writ petitioner should invariably be directed to<br \/>\nrespond to the show cause notice and take all stands<br \/>\nhighlighted in the writ petition. Whether the show cause<br \/>\nnotice was founded on any legal premises is a jurisdictional<br \/>\nissue which can even be urged by the recipient of the notice<br \/>\nand such issues also can be adjudicated by the authority<br \/>\nissuing the very notice initially, before the aggrieved<br \/>\ncould approach the Court. Further, when the Court passes an<br \/>\ninterim order it should be careful to see that the statutory<br \/>\nfunctionaries specially and specifically constituted for the<br \/>\npurpose are not denuded of powers and authority to initially<br \/>\ndecide the matter and ensure that ultimate relief which may<br \/>\nor may not be finally granted in the writ petition is<br \/>\naccorded to the writ petitioner even at the threshold by the<br \/>\ninterim protection, granted.\n<\/p>\n<p id=\"p_6\">In the instant case, the High Court has not indicated<br \/>\nany reason while giving interim protection. Though, while<br \/>\npassing interim orders, it is not necessary to elaborately<br \/>\ndeal with the merits, it is certainly desirable and proper<br \/>\nfor the High Court to indicate the reasons which has weighed<br \/>\nwith it in granting such an extra ordinary relief in the<br \/>\nform of an interim protection. This admittedly has not been<br \/>\ndone in the case at hand.\n<\/p>\n<p id=\"p_7\">\tWhile issuing notice on 7.7.2003, this Court had<br \/>\ngranted interim stay of the impugned interim order. The<br \/>\nrespondent had entered appearance and we have heard the<br \/>\nlearned senior counsel on either side. In the fitness of<br \/>\nthings, taking into account the above circumstances, we<br \/>\ndispose of the appeal with a direction that the proceedings<br \/>\nemanating from the show cause notice shall be continued, but<br \/>\nthe final order passed pursuant thereto shall not be<br \/>\ncommunicated to the respondent No.1 (writ petitioner)<br \/>\nwithout leave or further orders of the High Court. The writ<br \/>\npetition shall be disposed of on merits in accordance with<br \/>\nlaw. Any observation made in this appeal shall not be<br \/>\nconstrued to be expression of any opinion on the merits of<br \/>\nthe matter pending before the High Court. Since the<br \/>\ncontroversy is of a very limited as well as serious nature,<br \/>\nthe High Court may explore the possibility of early disposal<br \/>\nof the writ petition.
