BASANT, J.\n                           - - - - - - - - - - - - - - - - - - - -\n                         Crl.R.P.No.  1017 of   2006\n                          -  - - - -  - - - - - - - - - - - - - - -\n                 Dated this the 16th  day of   October, 2006\n\n\n                                      O R D E R\n<\/pre>\n<p id=\"p_1\">       This  revision petition is directed against the concurrent verdict<\/p>\n<p>of guilty, conviction and sentence in a prosecution under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a><\/p>\n<p>of the N.I. Act.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     When   this   revision   petition   came   up   for   hearing,   it   is<\/p>\n<p>submitted   at   the   Bar   by   counsel   for   the   rival   contestants   that   the<\/p>\n<p>matter has been settled and the offence has been compounded by the<\/p>\n<p>complainant.   A joint compromise petition  duly signed by the rival<\/p>\n<p>contestants     and  counter   signed   by  their  respective  counsel  is  also<\/p>\n<p>filed.   The learned counsel for the respondent\/complainant  vouches<\/p>\n<p>that the signature appearing in the application for composition is that<\/p>\n<p>of the complainant.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.     The   offence   under   <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section   138<\/a>   of   the   N.I.   Act   is   now<\/p>\n<p>compoundable after the amendment to the <a href=\"\/doc\/1132672\/\" id=\"a_2\">N.I. Act<\/a>.   I am satisfied,<\/p>\n<p>from the submissions made at the Bar and the joint statement filed by<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  1017 of   2006                2<\/span><\/p>\n<p>them, that the parties have settled their dispute amicably.  I find no reason<\/p>\n<p>not to accept the composition.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      4.  In the result:\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">      (a)   Crl.M.A.No.   10361 of 2006 is allowed and the composition is<\/p>\n<p>accepted.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">      (b)     The   acceptance   of   the   composition   shall   have   the   effect   of<\/p>\n<p>acquittal of the accused of the offence punishable under <a href=\"\/doc\/1823824\/\" id=\"a_3\">Section 138<\/a> of the<\/p>\n<p>N.I. Act as stipulated under <a href=\"\/doc\/1876710\/\" id=\"a_4\">Section 320(8)<\/a> Cr.P.C.<\/p>\n<p id=\"p_11\">      )    Consequently,  this  revision  petition  is allowed.    The impugned<\/p>\n<p>judgments are set aside.  The bail bond executed by the accused shall stand<\/p>\n<p>discharged and he is set at liberty.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">      5.   It is said that an amount of Rs.25,000\/-   is in deposit before the<\/p>\n<p>trial court.   The counsel pray that the said amount may be released to the<\/p>\n<p>accused\/petitioner herein.  Request accepted.  The amount, if any, deposited<\/p>\n<p>shall be released to the  accused\/petitioner herein.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  1017 of   2006       3<\/span><\/p>\n<p id=\"p_14\">                                       (R.
