BASANT, J.\n                   - - - - - - - - - - - - - - - - - - - - - -\n                    Crl.M.C.No. 277 of 2009\n                   - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 20th day of January, 2009\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioner is the defacto complainant in a prosecution<\/p>\n<p>initiated, inter alia, under <a href=\"\/doc\/1466184\/\" id=\"a_1\">Section 471<\/a> I.P.C.               The crux of the<\/p>\n<p>allegations is that an fixed deposit receipt was forged and<\/p>\n<p>encahsed on the strength of the forged signature of the defacto<\/p>\n<p>complainant     in such fixed deposit receipt.                Investigation is<\/p>\n<p>complete. Final report has already been filed. Cognizance has<\/p>\n<p>been taken. Trial is about to commence.\n<\/p>\n<p id=\"p_1\">       2. At this juncture the petitioner has realised that there has<\/p>\n<p>been no proper investigation in the case.                  He is particularly<\/p>\n<p>aggrieved by the fact that the allegedly forged signature has not<\/p>\n<p>been sent to an expert to solicit his expert opinion as to whether<\/p>\n<p>the signature in the fixed deposit receipt is forged or not. This<\/p>\n<p>inadequacy may help the accused and defeat the cause of justice.<\/p>\n<p>It is in these circumstances that the petitioner has come to this<\/p>\n<p>Court for issue of appropriate direction under Section 482<\/p>\n<p>Crl.M.C.No. 277 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. The petitioner points out that earlier he had requested the<\/p>\n<p>Superintendent of Police to take necessary action to get a further<\/p>\n<p>investigation conducted under <a href=\"\/doc\/274924\/\" id=\"a_2\">Section 173(8)<\/a> Cr.P.C. But no effective<\/p>\n<p>action has been taken.\n<\/p>\n<p id=\"p_2\">       3.   The grievance of the petitioner prima facie appears to be<\/p>\n<p>legitimate on the basis of the submissions made at the Bar. But the<\/p>\n<p>course adopted by the petitioner cannot certainly be          said to be<\/p>\n<p>justified. I find no justification in his rushing to this Court with this<\/p>\n<p>application under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> Cr.P.C. He has an equally efficacious<\/p>\n<p>alternative remedy to move the learned Magistrate under <a href=\"\/doc\/1412034\/\" id=\"a_4\">Section 173<\/a><\/p>\n<p>(8) <a href=\"\/doc\/445276\/\" id=\"a_5\">Cr.P.C<\/a>. The decision in <a href=\"\/doc\/1756335\/\" id=\"a_6\">Shaji v. State<\/a> (2003 (2) KLT 929) makes<\/p>\n<p>it crystal clear that a defacto complainant aggrieved by inadequate<\/p>\n<p>quality of investigation conducted can request the Magistrate to direct<\/p>\n<p>a further investigation to be conducted. Instead of doing that, the<\/p>\n<p>petitioner has unnecessarily rushed to this Court.<\/p>\n<p id=\"p_3\">       4. I am satisfied that this Crl.M.C. only deserves to be dismissed,<\/p>\n<p>but with the specific observation that the option of the petitioner<\/p>\n<p>Crl.M.C.No. 277 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>under law to move the learned Magistrate for directions under <a href=\"\/doc\/274924\/\" id=\"a_7\">Section<\/p>\n<p>173(8)<\/a> Cr.P.C. shall remain unfettered by the dismissal of this Crl.M.C.<\/p>\n<p id=\"p_4\">     5. This Crl.M.C. is accordingly dismissed.<\/p>\n<p id=\"p_5\">     6. Hand over the order.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">                                             (R.
