No.85 of 2010\n                       *********************\n                Dated this the 2nd day of July, 2010\n\n                           JUDGMENT\n<\/pre>\n<p id=\"p_1\">BASANT, J.\n<\/p>\n<p id=\"p_1\">     Investigating Officer has filed a statement. The statement<\/p>\n<p>shows that the investigation has now revealed that the alleged<\/p>\n<p>detenu is no more.     He has allegedly been murdered.        The<\/p>\n<p>accused has already been arrested. Investigation is in progress.<\/p>\n<p>Final report will be filed shortly in Crime No.158 of 2010 of<\/p>\n<p>Kannavam Police Station.      The learned Government Pleader<\/p>\n<p>submits that, in these circumstances, this petition for issue of a<\/p>\n<p>writ of habeas corpus may now be closed recording the above<\/p>\n<p>facts.\n<\/p>\n<p id=\"p_2\">     2.    The learned counsel for the petitioner accepts the<\/p>\n<p>submission of the learned Government Pleader. It having been<\/p>\n<p>reported to this Court and accepted by both sides that the<\/p>\n<p>alleged detenu is no more, we are satisfied that this petition for<\/p>\n<p>issue of a writ of habeas corpus to search for, trace and produce<\/p>\n<p>the alleged detenu need not now continue.<\/p>\n<p id=\"p_3\">     3. No.85 of 2010<br \/>\n                          *********************<br \/>\n                  Dated this the 17th day of May, 2010<\/p>\n<p>                                ORDER<\/p>\n<p>     The petitioner has filed this application for issue of a writ of<\/p>\n<p>habeas corpus to search for, trace and produce the alleged<\/p>\n<p>detenu, his nephew-Sinoj, the alleged detenu&#8217;s father having<\/p>\n<p>expired earlier.       The alleged detenu has been missing from<\/p>\n<p>12.08.2009.       It is the petitioner&#8217;s grievance that no serious<\/p>\n<p>efforts have been made by the police officers, ie. respondent<\/p>\n<p>Nos.1 to 5 to trace the alleged detenu.<\/p>\n<p id=\"p_6\">     2.      This petition was filed as early as on 08.03.2010. The<\/p>\n<p>learned     Government      Pleader     only   submits that  proper<\/p>\n<p>investigation is in progress.          But the alleged detenu has<\/p>\n<p>admittedly not been traced so far.\n<\/p>\n<p id=\"p_7\">     3.      We are, in these circumstances, satisfied that specific<\/p>\n<p>directions must be issued to respondent Nos.1 to 5.             The<\/p>\n<p>Investigating Officer shall make all efforts to trace the alleged<\/p>\n<p>detenue within a period of one month from this date. The 2nd<\/p>\n<p>respondent, the Director General of Police, shall ensure that the<\/p>\n<p>needful is done in the matter within such period.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(Crl.) No.85 of 2010              &#8211; 2 &#8211;<\/span><\/p>\n<p id=\"p_8\">     4.      Call this petition again on 28.06.2010. If by that date<\/p>\n<p>the alleged detenue has not been traced or his fate ascertained,<\/p>\n<p>the Investigating Officer shall file a report about the steps taken<\/p>\n<p>and the progress achieved.
