Permission as prayed for is granted. The matter is<br \/>\ntaken up for final hearing today.\n<\/p>\n<p id=\"p_1\">2.0\tThis<br \/>\nappeal is directed against the judgement and decree dated 28.12.1995<br \/>\npassed by the learned Judge of the City Civil Court No.7, Ahmedabad<br \/>\nin Civil Suit No. 1162  of 1982 dismissing the suit of the<br \/>\nappellant-plaintiff.\n<\/p>\n<p id=\"p_2\">3.0\tThe<br \/>\nfacts of the case in brief are that the defendant No.1 has filed<br \/>\napplication in the Civil Court with the respect to the suit will.<br \/>\nThereafter  Civil Suit No. 473 of 1982 was filed for administration<br \/>\nin respect of suit property in accordance with the suit Will without<br \/>\nimpleading the plaintiff as a party thereto with a view to obtain<br \/>\nconvenient order behind her back. The appellant-original plaintiff<br \/>\nhas challenged the legality and validity of the suit will. According<br \/>\nto her, the suit property in the hands of the deceased testator was<br \/>\nan ancestral property and he had no right to dispose of it of by<br \/>\nmeans of testamentary document to the exclusion of the plaintiff. The<br \/>\nappellant has also made an application for impleading her as a party<br \/>\ndefendant. The learned Judge after framing the issues dismissed the<br \/>\nsuit of the appellant. Hence, this appeal.\n<\/p>\n<p id=\"p_3\">4.0\tLearned<br \/>\nadvocate appearing for the appellant has submitted that  disputed<br \/>\nWill was not genuine Will of the deceased Gangaram Pashottmdas.<br \/>\nLearned advocate for the appellant has further submitted that<br \/>\ndeceased testator had no right or authority to make the Will in<br \/>\nquestion in view of the fact that the suit property was not his<br \/>\nself-acquired property but was the ancestral property in his hand.\n<\/p>\n<p id=\"p_4\">5.0\tThe<br \/>\nTrial Judge has framed the following issues at Exh. 20:\n<\/p>\n<p id=\"p_5\">\t(1)\tDoes<br \/>\nthe plaintiff prove that the suit  executed by \tdeceased \tGangaram<br \/>\nParshottamdas on 11th August, 1940 is illegal and\tinvalid<br \/>\nand not binding to her?\n<\/p>\n<p id=\"p_6\">\t(2)\tIs<br \/>\nthe suit had on account of inadequate court fees paid \tthereon?\n<\/p>\n<p id=\"p_7\">\t(3)\tIs<br \/>\nthe suit not maintainable in law?\n<\/p>\n<p id=\"p_8\">\t(4)\tIs<br \/>\nthe suit barred by principles of delay, acquiescences and \testopple?\n<\/p>\n<p id=\"p_9\">\t(5)\tIs<br \/>\nthe suit barred by the law of limitation?\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">\t(6)<\/span><\/p>\n<p id=\"p_10\"> Is the suit bad on account of misjoinder and non-joinder<br \/>\nof\tparties?\n<\/p>\n<p id=\"p_11\">\t(7)\tWhat<br \/>\nrelief or reliefs, if any, is the plaintiff-entitled to claim in<br \/>\n\tthis suit?\n<\/p>\n<p id=\"p_12\">\t(8)\tWhat<br \/>\nfinal order and decree?\n<\/p>\n<p id=\"p_13\">6.0\tWhile<br \/>\nconsidering the above issues, the Trial Judge has found that suit is<br \/>\nfiled by the appellant-original plaintiff for seeking declarations to<br \/>\nillegality and invalidity of the suit will. No other relief,<br \/>\nindependent or consequential has been claimed by the plaintiff in<br \/>\nthis suit. It is also found that the suit was admittedly executed on<br \/>\n11.08.1940. The deceased testator admittedly died on 08.11.1942.  The<br \/>\nsuit was filed nearly 42 years after the death of the deceased<br \/>\ntestator. There is thus prima facie inordinate delay on the part of<br \/>\nthe plaintiff in filing the suit. Further, in cross-examination at<br \/>\nExh. 39, she has admitted that at the time of her father&#8217; s death,<br \/>\nshe knew that she was also an heir of her father along with her<br \/>\nsister. Thus it is clear that plaintiff never asserted her right as<br \/>\nheir in her father&#8217;s property after his death. It is further held<br \/>\nthat plaintiff had acquiesced in enjoyment of her father&#8217;s property<br \/>\nby her sister despite the fact that the former was also an heir in<br \/>\nthe father&#8217;s property. The learned Judge has discussed oral as well<br \/>\nas documentary evidence in detail. I am in complete agreement with<br \/>\nthe findings recorded by the Trial Judge. I do not find any reason to<br \/>\nreverse the findings of the Trial Judge. Learned Advocate for the<br \/>\nappellant has failed to prove  that Trial Judge has committed error<br \/>\nin passing the judgement and decree. The appeal is devoid of merits<br \/>\nand the same is dismissed.
