The learned<br \/>\nJudge of the Reference Court disposed of the above reference by his<br \/>\njudgment and order dated 22.10.1993 and allowed all the references<br \/>\npartly.\n<\/p>\n<p id=\"p_1\">2.0.\t\tOn<br \/>\nbehalf of the acquiring body, certain lands were sought to be<br \/>\nacquired on temporary basis for the purpose of its project work by<br \/>\nissuing  Notification under <a href=\"\/doc\/448607\/\" id=\"a_1\">Section 35<\/a> of the Act.  The Land<br \/>\nAcquisition Officer after issuing personal notices to the claimants<br \/>\nand after considering the evidence on record has fixed the amount of<br \/>\nRs.51 per Are as yearly rent.  The claimants were not satisfied with<br \/>\nthe same and, therefore, requested for Reference under <a href=\"\/doc\/1517117\/\" id=\"a_2\">Section 18<\/a> of<br \/>\nthe Act.  The Land Acquisition Officer referred the matter to the<br \/>\nDistrict Court under <a href=\"\/doc\/1517117\/\" id=\"a_3\">Section 18<\/a> of the Act.  According to the<br \/>\nclaimants, looking to the  potentiality of the land the yearly rent<br \/>\nshould be fixed at Rs.151 per Are.  The quantum of compensation in<br \/>\neach of these appeals are different.  However the point is common.<br \/>\nThe aforesaid references were thereafter disposed of by the learned<br \/>\nJudge by recording evidence in Reference No.1025 of 1987.  The<br \/>\nlearned Judge thereafter by the impugned order partly allowed the<br \/>\nReferences by enhancing the rent.  In each of the References<br \/>\nadditional amount was awarded as per the final directions in the<br \/>\njudgment of the trial Court.   It is not necessary to go into the<br \/>\nquantum fixed by the Court as the learned advocate Mr. R. R. Marshal<br \/>\nfor the appellant-Corporation has restricted his arguments regarding<br \/>\ncertain directions issued in the operative part of the judgment<br \/>\nwherein the Reference Court has observed as under:-\n<\/p>\n<p id=\"p_2\">?SThe applicant is<br \/>\nentitled to get additional amount of yearly rent at the rate of<br \/>\nRs.100\/- per Are over the rent fixed by ONGC from time to time with<br \/>\nthe interest at the rate of 9% per annum from the date of due date of<br \/>\nrunning till the date of payment is made.??\n<\/p>\n<p id=\"p_3\">2.1.\t\tIn<br \/>\neach of the References such direction is issued by the Reference<br \/>\nCourt.  Mr. Marshall submitted that this direction is contrary to law<br \/>\nand there is no provision for fixing the future increase without<br \/>\nknowing whether the ONGC would continue with the temporary<br \/>\nacquisition or as to what would be the future that would be fixed by<br \/>\nthe ONGC.  He, therefore, submitted that the Court could not have<br \/>\nfixed the rent for future period.  He submitted that even otherwise<br \/>\nwhen the acquisition is for a temporary court, the Court should not<br \/>\nhave issued such directions.\n<\/p>\n<p id=\"p_4\">2.2.\t\tA<br \/>\ngroup of first appeals being First Appeal No.792 of 2003 and other<br \/>\ncognate matters have been disposed of by the learned Single Judge of<br \/>\nthis Court vide order dated 21.03.2006 wherein the learned Single<br \/>\nJudge has observed in paragraph 5.2 as under:-\n<\/p>\n<p id=\"p_5\">?S5.2\tOn the facts<br \/>\nof the case, it is evident that the Reference Court has also<br \/>\ndetermined the further rent which issue was not before it.  I am,<br \/>\ntherefore, of the opinion that the contention raised by the learned<br \/>\nAdvocate for the appellant that the observation or direction issued<br \/>\nby the Reference Court in the operative part of the orders require to<br \/>\nbe quashed and set aside, is required to be accepted.  If the said<br \/>\ndirection is allowed to remain, then it would amount to granting the<br \/>\nrent which is over the rent fixed by the appellant-ONGC from time to<br \/>\ntime.  Moreover, the same has been fixed without considering as to<br \/>\nwhat would be the future rent fixed by the appellant ONGC, which is<br \/>\nbeyond the scope of reference.  Hence, if the said observation is<br \/>\nallowed to remain then, in that event such compensation would be much<br \/>\nmore than the amount which has been found to be adequate by the<br \/>\nCourt.??\n<\/p>\n<p id=\"p_6\">2.3.\t\tIn<br \/>\nthe present group of appeals the appellant ?  ONGC has prayed as<br \/>\nunder:-\n<\/p>\n<p id=\"p_7\">?S5(a)\tto quash and<br \/>\nset aside the part of the impugned judgment and award dtd. 22.10.1993<br \/>\npassed by the Ld. Extra Asst. Judge, Mehsana, in LAR Case No.1025\/87<br \/>\nwhereby the Court orders the payment of yearly rent of Rs.100\/- per<br \/>\nacre over the rent fixed by ONGC from time to time and that too with<br \/>\nrunning interest @ 9% p.a.??\n<\/p>\n<p id=\"p_8\">3.0.\t\tConsidering<br \/>\nthe aforesaid facts, all the appeal is allowed.  The observations of<br \/>\nthe learned trial Judge, ?S&#8230;over the rent fixed by ONGC from<br \/>\ntime to time with the interest at the rate of 9% per annum from the<br \/>\ndate of due date of running till the date of payment is made?? are<br \/>\nset aside.
